a residential care facility from six to twelve adult residents at 8

The proposal is to expand an existing residential care facility for six elderly residents into a
residential care facility for twelve emotionally disturbed adults between the ages of 18 and 59
years of age at 8 Tourmaline Street in the R-l zone.
Residential care facilities for six or fewer residents are preempted by State law from local land
use regulation and oversight, but the State does not preempt local control for facilities which
accommodate seven or more residents. The zoning ordinance considers such facilities as
"Unclassified Uses" which can be considered for location in any zone subject to the issuance of
a conditional use permit by the Planning Commission and City Council.
The Environmental Review Coordinator has concluded that there will be no significant
environmental impacts associated with the project, and therefore recommends adoption of the
Negative Declaration issued on Initial Study IS-95-18.
RECOMMENDATION: That the Planning Commission adopt attached Resolution
PCC-95-24, recommending that the City Council deny the proposal in accordance with the
attached Draft City Council Resolution and the findings contained therein.
DISCUSSION:
Site Characteristics
The site is an 8,700 sq. ft. R-l single family parcel located at the southeast corner of
Tourmaline Street and Hilltop Drive. The property contains a 3,000 sq. ft. dwelling which has
recently been remodelled to include 6 bedrooms, three baths, and two separate family rooms.
The site is bounded by walls and fences of 3-4 feet high on the front and sides, and 5 ft. high
in the rear.
The property is adjacent to R-I single family areas to the north, northwest, and east, and limited
industrial areas to the south and west. The site is elevated approximately 30 ft. above and 60

ft. distant from the industrial development to the south. The closest single family home is
located 15 ft. to the east.

The dwelling is currently being used as a residential care facility for up to six elderly residents.
The residents are referred from County social service agencies and generally require little
medical care. Services include lodging, meals, laundry, transportation to necessary medical and
dental services, and cleaning of the facility. Three employees work eight hour shifts, providing
one staff person present at all times. Visitors are allowed between 9:00 a.m. and 7:00 p.m.
Such operations are considered by the State to be a "family" for purposes of zoning, and thus
are exempt from any special local regulations or standards other than those which would apply
to any single family dwelling.
Proposed Use
The proposal is to increase the number of residents from 6 to 12 and to change the resident
profile from elderly (60 yrs+) to emotionally disturbed adults between the ages of 18-59 years.
As noted above, any facility serving seven or more residents is not considered a "family" by the
State and thus is subject to all local zoning requirements.
The same services would be provided, but a minimum of two staff would be required in order
to serve the additional residents. Assistance with medications would also be provided, along
with "observation" and other assistance as required. The applicant reports that the residents do
not have their own vehicles and thus there is no need to provide additional parking. The
residents are free to come and go as they wish as long as they sign in and out.
As is the case with the existing operation, the proposed use is a for-profit enterprise. The only
"residents" of the facility are those receiving care, whereas the staff or caregivers come and go
as shifts change. The facility is licensed by the State and would receive residents from the
County Department of Mental Health.

Public Forum
On June 1, 1995, a Public Forum was convened at Loma Verde Elementary School for the
purpose of allowing interested parties to question both the applicant and Planning Department
staff, and for staff to solicit and record comments from neighboring residents. Thirteen
neighboring property owners and residents attended. Minutes of that public forum are attached.
Since the public forum, the Planning Department has received a petition with thirty-one
signatures as well as two letters from the immediate neighborhood asking that this application
be denied (please see attached).
ANALYSIS:
As we have stated several times in the past, it is difficult to find an ideal location for a use of
this type. It is generally acknowledged that there are compel1ing reasons for placing individuals
with emotional and developmental disabilities in a residential setting, particularly where they do
not require an intensive level of care, and the proponents typically believe that these are
primarily residential uses and that a location in a residential area is entirely appropriate. On the
other hand, these are institutional as well as residential uses by the fact that there is a staff and
the occupants are clients as wel1 as residents and often require supervision and a certain level
of treatment in addition to room and board. These differences can create both real and
perceived conflicts with residential areas.
We have generally encouraged such facilities to seek locations in interface areas between
multiple family and commercial districts. This places the clients, which, as in this case, most
often do not drive, within convenient walking distance of commercial services. It also
ameliorates the potential conflicts with and understandable concern of residents by placing the
facility on the fringe rather than in the middle of a residential area, and in an area favoring
similar transitory housing rather than owner-occupied dwel1ings.
In this instance, the facility would meet what appears to be an important social need -- the
provision of shelter, food and assistance for emotionally disturbed adults. With regard to
parking, the property could apparently accommodate the use considering that the clients
generally do not drive, and the staff and occasional guest would normally number no more than
three or four at anyone time. The site is also within walking distance of two convenience
markets at the southwest and northwest corners of Hilltop Drive and Orange Avenue, and there
are bus stops at both the Orange and Main Street intersections with Hilltop.
On the other hand, this property is a standard single family lot located within, albeit on the
periphery of, an R-l single family neighborhood. Generally we would not support an
institutional type use under these circumstances. A finding was made in the case of Casa
Nuestra that the number of clients served is not inconsistent with the size of a larger household

and, in fact, a facility for six or fewer residents plus staff would be permitted as a matter of
right pursuant to State law. Conversely, this dwelling would accommodate up to 12 residents
and two staff at anyone time. Clearly, 14 occupants appears to be well beyond even the largest
household that could be expected in a typical single family home, and would likely generate
activity levels more consistent with multiple family zones.
With regard to need, County Mental Health has indicated that while there is a shortage of
"good" beds for emotionally-disturbed residents, there is no shortage of "total" beds available
to serve this group. While both Community Care Licensing and County Mental Health have
declined to categorize this facility, they have described a "good" facility as one providing a high
level of supervision, a high staff to resident ratio, organized activities, attractive and spacious
surroundings located within easy wa1king distance of a wide range of goods and services, and
public transit. By these standards, the proposed facility would appear to provide only the
minimum in terms of physical facilities, staffing, activities and location.
In order to further evaluate the impact this type of facility may have in a single family setting,
the applicant was asked to provide the location of a comparable facility so that staff could inspect
the site and speak with surrounding neighbors if necessary. The applicant referred us to a 15
bed facility run by an individual well known to her at 4311 49th Street in the City of San Diego.
The facility may have originally been a single fami1y residence, and there were several single
family residences on the street, but the neighborhood is one in transition, with multi-family
interspersed with commercial activities, including an auto body shop across the street, and a taco
stand two doors down. Based on the dissimilar character of the area we did not feel it was
worthwhile to interview the neighbors.
County Mental Health and State Licensing were also contacted to determine if they could direct
us to a like facility. State licensing cou1d not help because they do not categorize facilities based
on zoning and/or neighborhood setting, and thus cou1d only direct us to a facility of similar size
but not necessarily in a sing1e family home or neighborhood. We have been unab1e to contact
the appropriate staff from County Mental Health.
We have informed the applicant that should they be able to direct us to an appropriate facility
between now and the hearing date, we will visit the site and report our findings to the
Commission. We also expect to hear back from County Menta1 Health, and will report to the
Commission on that as well.
In Conclusion, however, based upon the information before us and the issues discussed in this
report, we are recommending denial of the request based on the findings in the attached
Resolutions.

RESOLUTION OF THE CITY OF CHULA VISTA PLANNING
COMMISSION RECOMMENDING THAT THE CITY
COUNCIL DENY A CONDITIONAL USE PERMIT TO
EXPAND A RESIDENTIAL CARE FACILITY FROM SIX TO
TWELVE ADULT RESIDENTS AT 8 TOURMALINE STREET
IN THE R-l (SINGLE FAMILY RESIDENTIAL) ZONE
WHEREAS, a duly verified application for a conditional use permit was filed with the
City of Chula Vista Planning Department on November 23, 1994 by Trinidad M. Dela Rosa,
and;
WHEREAS, said application requests approval to expand an existing residential care
facility for six elderly residents into a residential care facility for twelve emotionally disturbed
adults between the ages of 18 and 59 years of age at 8 Tourmaline Street, and;
WHEREAS, the property consists of a single family residence which is located on the
southeast corner of Hilltop Drive and Tourmaline Street in the R-l Single Family zone, and;
WHEREAS, on June 1, 1995 a public forum was noticed and held at Loma Verde
Elementary School in order to inform and solicit comments on the proposal from the surrounding
neighbors, and;
WHEREAS, the Environmental Review Coordinator has conducted an Initial Study, IS-
95-18, and has concluded that there will be no significant environmental impacts associated with
the project and recommends adoption of the Negative Declaration issued on Initial Study IS-95-
18, and;
WHEREAS, the Planning Director set the time and place for a hearing on said
conditional use permit application and notice of said hearing, together with its purpose, was
given by its publication in a newspaper of general circulation in the city and its mailing to
property owners within 500 feet of the exterior boundaries of the property at least 21 days prior
to the hearing, and;
WHEREAS, the hearing was held at the time and place as advertised, namely July 12,
1995, at 7:00 p.m., in the Council Chambers, 276 Fourth Avenue, before the Planning
Commission and said hearing was thereafter closed.

NOW, THEREFORE, BE IT RESOLVED THAT THE PLANNING COMMISSION
hereby recommends that the City Council deny the request in accordance with the attached draft
City Council Resolution and the findings contained therein, and that a copy of this Resolution
be transmitted to the City Council.

WHEREAS, the parcel which is the subject matter of this resolution is
diagrammatically represented in Exhibit A attached hereto and incorporated herein
by this reference, and commonly known as 8 Tourmaline Street, and for the
purpose of general description herein consisting of an 8,700 square foot lot, with
an existing six-bedroom single family residence, currently used as a residential
care home for six elderly residents, herein after known as the "Project Site"; and,
B. Project; Application for Conditional Use Permit
WHEREAS, a duly verified application for a Conditional Use Permit, PCC-95-
24, was filed with the City of Chula Vista on November 23, 1994, by Mr.
Trinidad Dela Rosa; said application requesting permission to establish a
residential care facility for twelve emotionally disturbed adults between the ages
of 18 and 59 on the Project Site, herein after known as the "Project"; and
C. Public Forum Record on Application
WHEREAS, on June 1, 1995, a public forum was noticed and held at Lorna
Verde Elementary School in order to inform and solicit comments from
surrounding property owners on the Project, and the minutes resulting therefrom
are hereby incorporated into the record of this proceeding; and,
D. Planning Commission Record on Application
WHEREAS, the Planning Commission held an advertised public hearing on the
Project on July 12, 1995 and voted _ to recommend that the City Council
deny the application in accordance with Resolution PCC-95-24, and the
proceedings and all evidence on the Project introduced before the Planning
Commission, and the minutes and resolution resulting therefrom, are hereby
incorporated into the record of this proceeding; and,

NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby find,
determine and resolve as follows:
II. CONDITIONAL USE PERMIT FINDINGS
The City Council of the City of Chula Vista does hereby make the findings required by
the City's rules and regulations for the issuance or denial of conditional use permits or
modifications thereto, as hereinbelow set forth, and sets forth, thereunder, the evidentiary
basis that permits the stated finding to be made.
A. That the proposed use at the location is necessary or desirable to provide a
service or facility which will contribute to the general well being of the
neighborhood or the community,
The County Department of Mental Health reports that there is no shortage of total
beds within the area to serve the emotionally disturbed population which would
be served by this facility. Although there is a shortage of "good beds" to serve
this population, based on the factors noted by County Mental Health and
Community Care licensing in describing "good beds", i.e., a high level of
supervision, a high staff to resident ratio, organized activities, and attractive and
spacious surroundings located within easy walking distance of a wide range of
goods and services and public transit, the Project and Project Site would appear
to provide the minimum in terms of staffing, physical facilities, activities and
location.
B. That such use will not under the circumstances of the particular case, be
detrimental to the health, safety or general welfare of persons residing or
working in the vicinity or injurious to property or improvements in the
vicinity.
The introduction of a residential care facility with as many as 14 occupants at any
one time is inconsistent with the family size and activity levels generally
associated with an R-1 single family zone and neighborhood, and could adversely
effect the residential enjoyment of surrounding residents. The neighbors have
expressed concerns about the level of supervision with the existing facility
wherein residents have been observed wandering the neighborhood in a state of
confusion and, on occasion, unclothed. The neighbors have also expressed
concerns about the change in population from elderly to emotionally disturbed
residents and the impact this may have on their security, understanding that the
residents are free to come and go as they please and can require psychotropic
drugs in order to function normally.
C. That the proposed use will comply with the regulations and conditions
specified in the code for such use.
Other than Building and Fire regulations, the Municipal Code does not specify
regulations or conditions for such uses, but rather specifies the requirement to
obtain a conditional use permit and comply with any conditions deemed
appropriate to apply in any particular case. In this instance, there are no
conditions deemed adequate to address the shortcomings of the use at this location
as described in the findings above.
D. That the granting of this conditional use permit will not adversely affect the
general plan of the City or the adopted plan of any government agency.
The granting of this permit would be inconsis'tent with city policies to protect and
enhance the residential quality and enjoyment of existing residential
neighborhoods.
III. DENIAL OF PERMIT
The City Council hereby denies Conditional Use Permit PCC-95-24 to expand a
residential care facility from six to twelve adult residents at 8 Tourmaline Street in the
R-I Single Family zone.
IV. NOTICE OF DETERMINATION
City Council directs the Environmental Review Coordinator to post a Notice of
Determination and file the same with the County Clerk.

working in the vicinity or injurious to property or improvements in the
vicinity.
The introduction of a residential care facility with as many as 14 occupants at any
one time is more consistent with the densities encountered in a multiple family
zone than with the family size and activity levels generally associated with an R-l
single family zone and neighborhood, and could thus adversely effect the
residential enjoyment of surrounding residents. The establishment of multiple
family densities and activity levels within a single family zone is found to be
contrary to good zoning practice and detrimental to the general welfare of the
neighborhood.
C. That the proposed use will comply with the regulations and conditions
specified in the code for such use.
Other than Building and Fire regulations, the Municipal Code does not specify
regulations or conditions for such uses, but rather specifies the requirement to
obtain a conditional use permit and comply with any conditions deemed
appropriate to apply in any particular case. In this instance, there are no

OPERATIONAL PROFILE
Trinity Adult Re8idential Care Home, started as a place to
provide a quality residential care home for individuals between
18 to 59 years old, placed by the county medical services,
with allowable conditions which requires incidental medical
services who are mentally and physically capable of operating
equipment for their own use. We also provide care for persons who
because of forgetfulness or physical limitations need only be
reminded or to be assisted to take prescribed medications,
persons with temporary emotional disturbance resulting from
personal loss or change of living arrangement (their length of
stay in the facility depend on physician's recommendation)
We provide these individuals with three square meals a day
and snacks, do their laundry, and take them to recreational
centers, medical/dental appointments, banks, and library.

The facility is a non-medical care facility which normally
is not allowed to provide medical or nursing care. This type of
residential care facility is licenced by the Department of Social
Services.
A. The basic general services rendered to client are the
following:

ADMISSION AGREEMENT
All community care facilities are required to bave written
admission agreement between tbe facility and eacb client/resident
(or autborized representative) who is received for services
pursuant to applicable sections of the California Code of
Regulations, Title 22, Division 6.

5. EVICTION PROCEDURES: ADULT RESIDENTIAL CARE FACILITY
A. The licensee/administrator of the facility may, upon thirty
(30) days written notice to the client/resident, evict the
resident for one or more of the following reasons:
1) Nonpayment of the rate for basic services within ten days
of due date.
2) Failure of the resident to comply with state or local law
after receiving written notice of the alleged violation.
3) Failure of the resident to comply with the written general
policies fo the facility which are for the purpose of
making it possible for residents to live toagether.
4) Non-compatibility with other clients/residents.
5) Inability fo the licensee/administrator to meet the
resident's needs. Based upon a reassessment, the facility
is not appropriate for the client and the client has been
given the opportunity to relocate.
6) Change of use of the facility.
B. The licensee/administrator of the facility may, upon
obtaining prior and/or documented telephone approval from
the licensing agency, evict the client/resident upon three
(3) days written notice to quit. The licensing agency may
grant approval for the eviction upon finding of good cause.
C. The licensee/administrator of the facility shall, in
addition to either serving thirty (30) days notice or
seeking approval from the Department and serving three (3)
days notice to the resident, notify or mail a copy of the
notice to quit to the resident's authorized representtative.
A written report of any eviction shall be sent to the
licensing agency within five (5) days.
6. FACILITY VISITING POLICY:

Hours: 9:00 AM - 7:00 PM DAILY
Bringing and giving over-the-counter medications to residents
without the knowledge of the facility staff is prohibited.
7. NOTICE OF RATE CHANGE:
If rates are increased, the resident or authorized
representative will be given at least 30 days written notice
of the change. However, residents whose care is funded at
rates prescribed by government funded programs may have the
basic rate change effective on the operative date of any
change made in that program without notice.
8. MONTHLY RATE:
The total monthly rate set forth in this agreement will be
prorated on a daily basis upon the client/resident's
admission to the facility during the month.
9. REFUND POLICY:
No refund shall be issued to resident if he decides to leave
the facility any day within the present month.
10. HOLDING RATE FOR BED:
If the resident leaves the facility temporarily; i.e. go on
vacation with family or has been admitted to the hospital,
the holding rate for his bed will be the monthly basic
services rate.
11. The facility will not be responsible for any valuables or
personal property brought into the facility unless these
items are delivered to the licensee/administrator for
safeguarding.
12. The resident wil not be destructive of the property of the
facility or that of the other clients.
13. The resident shall provide thirty (30) days notice of intent
to move from the facility unless the resident's physical
condition prevents this being done.
14. The signature of the Client/Resident or Authorized
Representative below, indicates that he/she has read, or had
read and explained to him/her, the provisions of this
agreement voluntarily.

A. Proiect Setting
The project setting consists of a 8,700 square foot parcel with an existing six bedroom single-
family residence. The residence is currently used as an residential care facility for up to six
elderly and/or indigent residents. The facility is a non-medical care facility for individuals
between 18 to 59 years old, who are placed by County Medical Services. These individuals
may have conditions, as outlined below, which require incidental medical services, but the
clients are mentally and physically capable of operating equipment for their own use. Care
is provided for persons, who because of forgetfulness or physical limitations, need to be
reminded or assisted in taking prescribed medications. Clients may be persons with
temporary emotional disturbance, resulting from personal loss or change of living
arrangements.
The residents length of stay depends upon a physician referral and vary. Individuals with
any type of violent outbreaks or criminal records are not permitted in the facility. Services
provided by the present three staff members include lodging, meals, laundry, transportation
to necessary medical and dental services and cleaning of the facility. Visitors are allowed
on the premises between 9:00 a.m. and 7:00 p.m.
Single-family residences are located to the north, east and west and a warehouse, an
industrial use, is located to the south. The average graded slope of the site is 2 %.
B. Proiect Description
The project applicant has submitted a request to convert the facility from an that of elderly
care to obligatory adult care and increase the capacity of the existing residential care facility
from six to twelve residents. Services which would be provided would essentially remain
the same and be provided by the same staff. Community Care Licensing has indicated,
however 0 that the increase to twelve residents would require an increase in staffing levels,
regardless of the type of disability.
The two parking spaces in the garage and three spaces on site are provided for the facility.

The applicant will be required to comply with any requirements of the Sweetwater Authority
to ensure that impacts to water facilities are less than significant.
Building and housing has indicated that bedroom window sizes must meet emergency escape
requirements of Uniform Building Code Section 1204. The applicant will be required to pay
additional sewerage fees due to the change in use and increase in sewer generation from the
parcel. The proposed capacity increase of the existing facility requires the approval of a
Conditional Use Permit.
C. Comvatibility with Zoning and Plans
The proposed project site is zoned R-I and designated for low-medium residential. A
residential care facility is a conditional use in the R-I zone. The project is in compliance
with the General Plan and Zoning Ordinance.
D. Identification of Environmental Effects
An initial study conducted by the City of Chula Vista (including the attached Environmental
Checklist Form) determined that the proposed project will not have a significant
environmental effect, and the preparation of an Environmental Impact Report will not be
required. This Negative Declaration has been prepared in accordance with Section 15070
of the State CEQA Guidelines.
E. Mandatorv Findings of Significance
1. Does the project have the potential to substantially degrade the quality of the
environment, substantially reduce the habitat of a fish or wildlife species, cause
fish or wildlife population to drop below self-sustaining levels, threaten levels,
threaten to eliminate a plant or animal community, reduce the number or
restrict the range of a rare or endangered plant or animal, or eliminate
important examples of the major periods of California history or prehistory?
The project site is currently used for a residential care facility and there are no
significant resources present. There are no habitats of fish or wildlife present. There
are no cultural resources present.
2. Does the project have the potential to achieve short-term environmental goals to
the disadvantage of long-term environmental goals?
The short-term goal of providing residential facilities to adults who have special
needs and require daily living support will be provided. The proposed increased
capacity to an existing residential care facility will not have the potential to be a
disadvantage to long-term environmental goals provided that the program meets with
all of the code requirements.
3. Does the project have possible effects which are individually limited but
cumulatively considerable? As used in the subsection, "cumulatively
considerable" means that the incremental effects of an individual project are

considerable when viewed in connection with the effects of past projects, the
effects of other current projects, and the effects of probable future projects.
The increased capacity of a residential facility will not have any cumulative adverse
impacts on the environment. Rather, the program will provide for increased housing
to adults who are either physically or mentally limited and who require residential
care support services which are provided by the applicant.
4, Will the environmental effects of a project cause substantial adverse effects on
human beings, either directly or indirectly.
The proposed project is in compliance with threshold standards for fue, police, and
other public services as discussed in the threshold section of the Initial Study. The
proposed project will not cause significant environmental impacts to humans, either
directly or indirectly.

ADT volume. In addition, as the residents of the care facility require transporation services (therfore
do not drive), the trips generated are over the current activity are expected to be negligible. The
primary access roads are adequate to serve the project and traffic mitigation is not required; impacts
are considered to be negligible. The two parking spaces in the garage and three spaces on-site are
adequate for the facility.

Comments: The project applicant has submitted a request to increase the capacity of the existing
residential care facility from six to twelve residents. The facility is a non-medical care facility which
normally is not allowed to provide medical care or nursing for individuals between 18 to 59 years old,
placed by the County Medical Services with allowable conditions which require incidental medical
services, who are mentally and physically capable of operating equipment for their own use. The
increase in capacity from 6 to 12 adult residents with special needs is expected to generate a less than
significant increase in noise levels.

a) FirelEMS
The Threshold Standards requires that fire and medical units must be able to respond to
calls within 7 minutes or less in 85% of the cases and within 5 minutes or less in 75% of
the cases. The City of Chula Vista has indicated that this threshold standard will be met,
since the nearest fire station is 2 miles away and would be associated with a 5 minute
response time. The proposed project will comply with this Threshold Standard.
Comments: The Facility meets the requirements put forth by the State Fire Marshall. The fire
clearance will be approved and routed to state and county offices if the facility meets the
requirements.
The fire department will be able to provide an adequate level of emergency service for the proposed
project area without an increase in equipment or personnel.

The Threshold Standards require that police units must respond to 84% of Priority I calls
within 7 minutes or less and maintain an average response time to all Priority I calls of
4.5 minutes or less. Police units must respond to 62.10% of Priority 2 calls within 7
minutes or less and maintain an average response time to all Priority 2 calls of 7 minutes
or less. The proposed project will comply with this Threshold Standard.
Comments: The police department will be able to provide an adequate level of service for the
proposed project area.
c) Traffic
The Threshold Standards require that all intersections must operate at a Level of Service
(LOS) "C" or better, with the exception that Level of Service (LOS) "D" may occur
during the peak two hours of the day at signalized intersections. Intersections west of
1-805 are not to operate at a LOS below their 1987 LOS. No intersection may reach LOS
"E" or "F" during the average weekday peak hour. Intersections of arterials with freeway
ramps are exempted from this Standard. The proposed project will comply with this
Threshold Standard.
Comments: The project is expected to generate 36 ADT; 18 ADT over the existing use and 26 ADT
over the zoned use. These volumes do not exceed the City's level-of-service (L.O.S.) "C" design
ADT volume. The primary access roads are adequate to serve the project and traffic mitigation is not
required; impacts are considered to be negligible.
d) Parks/Recreation
The Threshold Standard for Parks and Recreation is 3 acres/l,OOO population. The
proposed project will comply with this Threshold Standard.
Comments: The project proposes increasing the capacity of an existing facility and Park and
Recreation impacts are not expected.
e) Drainage
The Threshold Standards require that storm water flows and volumes not exceed
City Engineering Standards. Individual projects will provide necessary
improvements consistent with the Drainage Master Plan(s) and City Engineering
Standards. The proposed project will comply with this Threshold Standard.
Comments: Existing on-site drainage facilities allow surface flows to Tourmaline Street and Hilltop
Drive. These facilities are adequate to serve the project.
Existing off-site facilities consists of surface flow/curb and gutter flow along Hilltop Drive. These
facilities are adequate to service the project.

Comments: The proposed project may result in the need for new water systems or substantial
alterations to the existing water system. Once the fire flow is provide by the Fire Department to the
Sweetwater Authority, the Authority will determine if new water systems are required. The City will
work with the Authority to determine if the existing water facilities are adequate prior to issuance of a
building permit.

Dear Mr. Reid:
This is to advise you that the project proposed for 8 Tourmaline Street is within
the Chula Vista Elementary School District which serves children from
Kindergarten through Grade 6. The subject project is located in the Rohr School
attendance area
District enrollment has been increasing at the rate of 3 - 4 percent over the past
several years, and this is projected to continue. Permanent capacity has been
exceeded at many schools and temporary relocatable classrooms are being
utilized to accommodate increased enrollments. The District also buses
students outside their attendance areas, both to accommodate growth and assist
in achieving ethnic balance.
State law currently provides for a developer fee of $1.72 per square foot of
assessable area to assist in financing facilities needed to serve growth. The fee
is split between the two school districts with our District receiving
$ . 76/sq. ft. and Sweetwater Union High School District receiving $.96/sq. ft.
This fee is assessed for new residential construction and additions/remodels of
over 500 square feet. Since this project is increasing capacity of an existing
facility, fees will only be charged on new square footage.

Dear Mr. Reid:
This letter is in response to your Notice of Initial Study for the
subject project within the Sweetwater Authority service area. There
is a 8-inch water main located on the east side of Hilltop Drive
adjacent to the proposed development. Our records indicate that
there is one water service to this property. Enclosed is a copy of
1/4 SEC. 23-B map which shows the existing water facilities.
At this time, we cannot comment on the adequacy of the existing
system to provide fire protection for this project. As plans
develop for structures, the Owner must submit a letter to the
Authority from the appropriate fire agency stating fire flow
requirements. Based on this requirement, this project may result
in the need for new water systems or substantial alteration to the
existing water system . The Authority recommends that your Agency
work with ours to determine if the existing water facilities are
adequate to meet the added demands prior to issuing a building
permit.
If the Owner provides the required fire flow information and enters
into an agreement for water facility improvements with the
Authority, water service can be obtained at a pressure ranging from
a maximum of 76 p.s.i. to a minimum of 61 p.s.i.

This Agreement ("Agreement") between the City of Chula Vis<a, a chartered municipal corporation ("City")
and the forenamed applicant for an Initi:ll Study ("Applicant"), effective as of the Agreement Date set forth above,
is made with reference to the following facts: '
Wher""" the Applicant has applied to the City for an Initial Study of the type aforereferenced ("lniliaJ
Study") which the Cily has required to be obtained as a condition to pennitting the Applicant to develop a parcel
of property; and,
Wher"",. the City will incur expenses in ordcr to process said Initial Study through the various departments
and before the various boards and commissions of the City ("Processing Services"): and,
Wherc.'\S, Ihe purpose of Ihis agreement is to reimburse the City for all expenses it will incur in connection
with providing the Processing Services;
Now. Iherefore, Ihe parties do hereby agree, in exchange for lhe mutual promises herein contained, as
follows:
I. Applicant's Duty to Pay.
The Applicant shall pay all of the City's expenses incurred in providing Processing Service related to
applicant's Initial Study, including all of the City's direct and ovemead costs related thereto. This duty of
the Applicant shall be referred to herein as the "Applicant's Duty to Pay."
A. Applicant's Deposit DUly
As partial perfonnance of the Applicant's Duty to Pay, the Applicant shall deposit the amount
aforereferenced ("Deposit").
1. The City shall charge its lawful expenses incurred in providing Processing Services
against the Applicant's Deposit If, after the conclusion of processing the Applicant's
Initial Study, any portion of the Deposit remains, the City shall return said balance to the
Applicant without interest thereon. If, during the processing of the Applicant's Initial
Study, the amount of the Deposit becomes exhausted. or is imminently likely to become
exhausted in the opinion of the City, upon notice of same by the City. the Applicant shall
forthwith provide such additional deposit as the Cily shall calculate as reasonably
necessary to conlinue to provide Processing Services. The duty of tbe Applicant to
initiaJly deposit and to supplement said deposil as herein required shall be known as the
"Applicant's Deposit Duty".
II. City's Duty
The City shall, upon the condition thai the Applicant is not in breach of the Applicanl'S Duty to Payor the
Applicant's Deposit Duty, use good faith 10 provide processing services in relation to the Applicant's Initial
Study application.

A. The City shall have no liability hereunder to the Applicant for the failure to process the Applicant's
Initial, Study application. or for failure to process the Applicant's Initial Study within the time
frame requested by the Applicant or estimated by the City.
B. By execution of this agreement, the Applicant shall have no right to direct or otherwise influence
the conduct of the Initial Study for which the applicant has applied. The City shall use its
discretion in evaluating the Applicant's Initial Study application without regard to the Applicant's
promise to pay for the Processing Services, or the execution of the Agreement.
III. Remedies
A. Suspension of Processing
In addition to all other rights and remedies which the City shall otherwise have at law or equity,
the City has the right to suspend and/or withhold the processing of the Initial Study which is the
subject matter of ttUs Agreement, as well as the Initial Study which may be the subject maner of
any other Pennit which Applicant has before the City.
B. Civil Collection
In addition to all other rights and remedies wtUch the City shall otherwise have all law or equity,
the City has the right to collcct all sums which are or may become due hereunder by civil action,
and upon instituting litigation to collect same, the prevailing party shall be entitled to reasonable
attorney's fees had costs.
IV. Miscellaneous
A. Notices
All notices, demands or requests provided for or pennined to be given pursuant to this Agreement
must be in writing. All notices, demands and requests to be sent to any party shall be deemed to
have been properly given or served if personally served or deposited in the United States mail,
addressed to such party, postage prepaid, registered or certified, with return receipt requested. at
the addresses identified adjacent to the signatures of the parties represented.
B. Governing LawNenue
This Agreement shall be governed by and construed in accordance with the Laws of the State of
California. Any action arising under or relating to this Agreement shall be brought only in the
federal or state courts located in San Diego County, State of California, and if applicable. the City
of Chula Vista, or as close thereto as possible. Venue for this agreement, and perfonnance
hereunder, shall be the City of Chula Vista.
C. Multiple Signatories
II there are multiple signatories to this agreement on behalf of Applicant, each of such signatories
shall be jointly and severally liable for the perfonnance of Applicant's duties herein set forth.
D. Signatory Authority
The signatory to this agreement hereby WarT3l1ts and represents that it is the duly designated agent
for the Applicant and has been duly authorized by the Applicant to execute this Agreement on
behalf of the Applicant. Signatory shall be personally liable for Applicant's Duty to Pay and
Applicant's Duty to Deposit in the event it has not been authorized to execute ttUs Agreement by
the Applicant.

E. Hold Hannless
Applicant shall defend, indemnify and hold harmless the City, its elected and appointed offiCers
and employees, from and against all claims for damages, liability, cost and expense (including
withoutlimilalion attorneys' fees) arising oot of processing Applicant's lnilia1 Study, except only
for those claims arising from the sole negligence or sole willful conduct of the City, incurred by
the City, its officers, agents, or employees in defending against such claims, whether the same
proceed to judgement or noL Further. the Applicant, at its own expense, shall, upon written
request by the City, defend any such suit or action brought against the City, its officers, agents,
or employees. Applicant's indemnifcation of the City shall be limited by any prior or subsequent
declaration by the Applicant
F. Administrative Claims Requirements and Procedmes.
No suit or arbitration shall be brought arising out of this agreement, against the City unless a claim
has fllSt been presented in writing and rued with the City of Chula Vista and acted upon by the
City of Chula Vista in accordance with the procedures set forth in Chapter 1.34 of the Chula Vista
Municipal Code, as same may from time to time be amended, the provisions of which are
incorporated by the reference as if fully set forth herein. and such policies and procedures used by
the City in the implementation of same. Upon request by the City. the Applicant shall meet and
confer in good faith with the City for the purpose of resolving any dispute over the tenns of this
Agreement.
Now. therefore, the parties hereto. having read and understood the terms and conditions of this agreement,
do hereby express their consent to the tenns hereof by selling their hand hereto on the date set fonh adjacent thereto.

5. EVICTION PROCEDURES: ADULT RESIDENTIAL CARE FACILITY

A. The licensee/administrator of the facility may, upon thirty
(30) days written notice to the client/resident, evict the
resident for one or more of the following reasons:
1) Nonpayment of the rate for basic services within ten days
of due date.
2) Failure of the resident to comply with state or local law
after receiving written notice of the alleged violation.
3) Failure of the resident to comply with the written general
policies fo the facility which are for the purpose of
making it possible for residents to live toagether.
4) Non-compatibility with other clients/residents.
5) Inability fo the licensee/administrator to meet the
resident's needs. Based upon a reassessment, the facility
is not appropriate for the client and the client has been
given the opportunity to relocate.
6) Change of use of the facility.
B. The licensee/administrator of the facility may, upon
obtaining prior and/or documented telephone approval from
the licensing agency, evict the client/resident upon three
(3) days written notice to quit. The licensing agency may
grant approval for the eviction upon finding of good cause.
C. The licensee/administrator of the facility shall, in
addition to either serving thirty (30) days notice or
seeking approval from the Department and serving three (3)
days notice to the resident, notify or mail a copy of the
notice to quit to the resident's authorized representtative.
A written report of any eviction shall be sent to the
licensing agency within five (5) days.
6. FACILITY VISITING POLICY:
Hours: 9:00 AM - 7:00 PM DAILY
Bringing and giving over-the-counter medications to residents
without the knowledge of the facility staff is prohibited.
1. NOTICE OF RATE CHANGE:
If rates are increased, the resident or authorized
representative will be ~iven at least 30 days written notice
of the change. However, residents whose care is funded at
rates prescribed by government funded programs may have the
basic rate change effective on the operative date of any
change made in that program without notice.
8. MONTHLY RATE:
The total monthly rate set forth in this agreement will be
prorated on a daily basis upon the client/resident's
admission to the facility during the month.
9. REFUND POLICY:
No refund shall be issued to resident if he decides to leave
the facility any day within the present month.
10. HOLDING RATE FOR BED:
If the resident leaves the facility temporarily; i.e. go on
vacation with family or has been admitted to the hospital,
the holding rate for his bed will be the monthly basic
services rate.
11. The facility will not be responsible for any valuables or
personal property brought into the facility unless these
items are delivered to the licensee/administrator for
safeguarding.
12. The resident wil not be destructive of the property of the
facility or that of the other clients.
13. The resident shall provide thirty (30) days notice of intent
to move from the facility unless the resident's physical
condition prevents this being done.
14. The signature ot the Client/Resident or Authorized
Representative below, indicates that he/she has read, or had
read and explained to him/her, the provisions of this
agreement voluntarily.

provide a quality residential care home for individuals between
18 to 69 years old, placed by the county medical services,
with allowable conditions which requires incidental medical
services who are mentally and physically capable of operating
equipment for their own use. We also provide care for persons who
because of forgetfulness or physical limitations need only be
reminded or to be assisted to take prescribed medications,
persons with temporary emotional disturbance resulting from
personal loss or change of living arrangement (their length of
stay in the facility depend on physician's recommendation)

and snacks, do their laundry, and take them to recreational

We wish to go on record with all concerned that our wish is that we are unanimously

dated May 24, 1995. All residents who learned of this proposal who attended meeting at 6pm on
1 June 1995 at Loma Verde elementary school, chaired by Ann Pedder Pease, Planning
Technician with the Chu1a Vista Planning Department, expressed our strong recommendation of
unanimous denial for this pennit in its present state for the following reasons:
1. We do not wish to have emotional disturbed residents in a residential neighborhood, and
further any permit which does not expressly forbid such residents; would not be considered.
2. Present staffing as stated by the Dela Rosa's would be for 3 people. TI1ese are to be divided
into 3 8hr shifts which means only 1 staff member on duty at a time. The Dela Rosa's stated at
neighborhood meeting that they do have other part time day help, but, the planning commission
reports only these 3. They provide cooking, laundry etc. This is inadequate as 1 person can only
care for 1 person at a time, and leaves no one to care for other 11 in an emergency situation, or
none if cooking or perfonning other chores.
3. Being a residential neighborhood, there are no provisions for staff, resident or visiting persons
parking beyond a normal resident home, probably 4 vehicles maximum.
4. This would have further impact upon trash and possible medical waste if such a permit were
granted.
5. Fire is an additional concern.
6. This is a residential neighborhood with many children as well as many elderly residents and
we would be concerned with anyone requiring medication as to their mental stability.
7. At neighborhood meeting Dela Rosa's stated they did not realize that their application was for
any emotionally disturbed patients, but, were unable to come up with any alternative at meeting.

Dear Commissioners,
We're sorry we can't be with you for the June 14th meeting regarding the
request submitted by our neighbors to run an adult residential care home. We're in
Fresno right now, but we will be back by the end of Fall.
Please be kind enough to read this letter out loud at the gathering.
We commend Trinidad De La Rosa for trying to help emotionally disturbed
people, but there's no way we're living next to a looney tunes farm. We and our
neighbors have worked too hard maintaining our homes to allow a bunch of mentally
unstable people to lower our property values and to endanger our safety.
If the applicants truly want to do this, they should sell their home and move to a
more suitable area where open spaces would be more beneficial to their guests.
Don't force us into seeking injunctions and other ugly legal maneuvers, let's
keep our area the way it is now: safe; quiet; in general, a great place to live.
Thank you, we hope you do the right thing by rejecting De La Rosa's well intended
request.

PROCEEDINGS OF
PUBLIC FORUM HELD ON JUNE 1, 1995
REGARDING PCC-95-24
The subject of the meeting, held at Lorna Verde Elementary School,
was the application, by Mr. & Mrs. Trinidad Dela Rosa, to expand
the Residential Care Facility at 8 Tourmaline Street, Chula Vista,
from six to twelve residents.
In attendance were Mr_ & Mrs.

The forum began at 6:00 p.m.
Ann pedder Pease gave a brief introduction, explaining that the
purpose of the meeting was for the applicant and planning staff to
be available to answer neighbors' questions and for planning staff
to note neighbors' comments. She explained the Conditional Use
Permit process and why it was necessary in this case. She then
turned the meeting over to Mr. & Mrs_ Dela Rosa, inviting them to
make a verbal presentation.
Mr. Dela Rosa introduced his wife and himself, indicated that they
had been operating a residential care facility for six elderly
residents for some time and then asked if there were any questions_
The first question, from a neighbor, was about the level of
supervision_ She expressed concern that there would be only one
staff person at a time on duty for twelve residents and then
described problems that had occurred in the past with just six
residents. Mrs. Dela Rosa stated that the staff-to-resident ratio
was determined by Community Care Licensing and that her facility
met their requirements. The neighbor further indicated that,
because of the number of children in the neighborhood, she worried
that emotionally disturbed residents would be a threat to the
children if they weren't adequately supervised_
Mr. Dela Rosa stated that he took exception to the term
"emotionally disturbed", since that did not accurately describe the
residents. Ann pedder Pease pointed out to him that the term was
used in the Operational Profile which accompanied the application,
and suggested she read that statement. Following the reading, Mr.
Dela Rosa stated that he disagreed with it, although Mrs. Dela Rosa
indicated that she had written it. When asked to describe the
residents, Mr. Dela Rosa stated that they would be "ambulatory",
but with no emotional problems.
One of the neighbors questioned Mr. Dela Rosa further about the
types of problems the residents might have, and whether they might
be physically disabled. Mrs. Dela Rosa indicated that they would
not care for physically disabled or convalescing residents, and Mr.
Dela Rosa said he was not sure what problems they had, but he was
sure they were not emotional problems.

He was then asked why he did not simply expand the facility to care
for up to twelve elderly residents, rather than changing to a
different category of resident. Ann pedder Pease stated that a
Conditional Use Permit would still be necessary, and Mr. Dela Rosa
stated that he thought some changes to the facility, such as a fire
sprinkler system, might be necessary and he did not think they
could afford it.
All of the neighboring residents in attendance proceeded to state
their objection to a residential care facility for people with
emotional problems. One neighbor said that she did not feel it was
appropriate in a residential neighborhood. Another neighbor
stated that it was not appropriate in a neighborhood where there
were "upwards of thirty small children on our street alone". And
yet another neighbor stated that he thought there were already too
many similar facilities in the immediate area, referring to a home
for homeless teenagers and another facility that he believed housed
a drug and alcohol rehabilitation program.
Mrs. Dela Rosa was asked if they proposed to accept residents
recovering from drug or alcohol problems, and Mr. Dela Rosa stated
emphatically that they would not. Mr. Dela Rosa was then asked,
by a neighbor, if he himself was opposed to the establishment of a
residential care facility for the emotionally disturbed at this
location, to which he answered that he was.
Upon questioning, Mr. Dela Rosa stated that he would withdraw his
application and work with Community Care Licensing to change his
application with them. Ann Pedder Pease suggested that he might
want to continue the Conditional Use Permit application until a
later date, to give him time to work out the details with Community
Care Licensing, and the Dela Rosas agreed.
The meeting closed at 7:30 p.m.

not prepared any statements relating to Planning Commission's
recommendations for the coming year, however, a Summary of
Activities and recommendations, which the Planning Commission
authorized for 93-94, has been attached to provide you with
information regarding last year's recommendations.

Serves as the official planning agency of Chula Vista and evaluates major land use proposals in terms of their
impact on the City. It conducts public hearings on significant planning, zoning and land subdivision matters,
and recommends action and policy to the City Council. The General Plan and specific plans are prepared under
the guidance of the Planning Commission.
HIGHLIGHTS OF ACTIVITIES DURING THE PAST YEAR:
. The Planning Commission's efforts for FY 94-95 were concentrated on new or revised planning
documents, to provide clarity and measurable standards to aid the public and staff. As a result the
Commission recommended approval of:
1. a new City Design Manual
2. a new City Landscape Manual which incorporated requirements for private and public
landscaping projects
3. a new Child Care Element
Note: Both the Child Care Element and the Design Manual have been honored by the local San Diego
Planning Association.
. Subdivision activity increased in 94-95 with the Planning Commission recommending approval of five
subdivisions totalling nearly 500 single family homes. A large percentage of these units involved higher
density, small lot products which required a more detailed analysis than traditional single family lots.
. Planning Commission completed several Zoning Ordinance amendments including an amendment
allowing damaged condominiums to be rebuilt at existing densities thus eliminating potentially costly
refinancing delays facing property owners.
. The Planning Commission provided recommendations and input on a number of high profile and/or
highly debated projects such as:
1. the 1-54/Broadway industrial to commercial rezone
2. establishing a new car wash facility at the corner of Bonita Road and Lynwood Drive
3. placing time limits on interim private schools within industrial business park areas
4. providing additional quality low-income housing projects in western and eastern Chula Vista

. The purpose of both the Design Review and CUP subcommittees is to help draft new guidelines,
making the City's processing more efficient and user friendly.
. The Planning Commission placed a heavy emphasis on being more educated and more informed in
the planning process by:
holding various workshops with the Planning and Engineering staff involving tentative and
final map, reviewing the environmental impact analysis and Initial Study processing;
reviewing the Advance Planning Division's work program;
receiving an update on the ability of the State water program to deliver water.
. In addition, two Planning Commissioners were fortunate enough to be able to attend the American
Planning Association National Conference in San Francisco, which focused on a variety of p1anning
programs, such as housing affordabilityprograms, regional planning, and planning for high-technology
industry.
COMMENTS AND RECOMMENDATIONS TO COUNCIL:
. The Summary of Activity Reports filed with the City Council in the last two years has included a
recommendation asking that the Planning Commission members be compensated for meetings.
Compensating planning commissions is a common practice both county and statewide. The Planning
Commission urges Council to either provide compensation for each meeting (see reference on
compensation on next page) or amend the Planning Commission budget for conferences and travel
from $3,100 to $7,000. This increase would make it possible for all seven members to attend a
conference and become better informed on issues.

The Commission also requests that joint workshop meetings be scheduled with the Councilor that
Council include Planning Commission members on the various City tours that are scheduled. In lieu
of joint meetings with the entire Council and Commission, it is suggested that Council consider having
the Mayor and the Planning Commission Chair meet on a quarterly basis.

Compensation - At the Planning Commission's request, various cities throughout the County were
polled last year regardingwhether they are providing compensation for their Planning Commissioners.
Out of 10 cities surveyed, one-half are providing compensation with the lowest being La Mesa and
Lemon Grove at $35 per meeting and the highest at $100 per meeting for El Cajon. Note: The City
adjacent to us, National City, provides $75 per meeting.
