PUBLIC HEARING: PCM-94-09: ReDort on General Plan consistency of DroDosed vacation of Moss Street between AIDine Avenue and NaDles Street - San Diego Country Club and Country Club Villa Estates PartnershiD A. BACKGROUND San Diego Country Club and the owners of the triangular piece of property between Alpine Avenue, Moss and Naples Street, have requested that the City vacate the portion of Moss Street between Alpine Avenue and Naples Street. The Planning Commission is required to report on the General Plan consistency of street vacations prior to their consideration by the City Council. The Environmental Review Coordinator has concluded that the determination of General Plan consistency is exempt from environmental review under Section 15061 (General Rule) of the CEQA Guidelines. An Initial Study and Negative Declaration, IS-94-01, will be considered by Council prior to action on the street vacation. B. RECOMMENDATION Adopt the attached Resolution reporting to Council that the Commission has found that the proposed street vacation is consistent with the Chula Vista General Plan. C. DISCUSSION Street vacations are acted upon by the City Council with recommendations from the Engineering Department and Safety Commission. The Planning Commission's sole responsibility is to report on whether or not the proposed street vacation is consistent with the Chnla Vista General Plan. Please see the attached memo and accompanying information from the Engineering Department which discusses the street vacation. On September 9, 1993, the Safety Commission voted unanimously to support the Engineering staff recommendation to: 1. Vacate Moss Street as requested; 2. Widen Alpine Avenue between Moss and Naples to 52 feet; 3. Provide an all-way stop at this "T" intersection; 4. Prohibit access to Alpine Avenue from applicant's property. D. ANALYSIS The City Traffic Engineer has found that the requested vacation, along with the recommended conditions of approval, would meet the General Plan Circulation Element City Planning Commission Agenda Item for Meeting of October 27, 1993 Page 2 street standards, and would enhance traffic safety by eliminating the acute angle at which Moss Street now intersects with Naples Street. The Circulation Element diagram shows Moss Street intersecting with Naples Street near First Avenue and/or Alpine Avenue and thus the proposed configuration would be consistent with the General Plan (see attached Circulation Plan). The General Plan Land Use Element would not be affected by the street vacation. The General Plan presently designates the property as Low-Medium Density Residential (3-6 du/ac), and the property is zoned R-l (Single Family Residential, 7,000 sq. ft. minimum lot size). The additional developable acreage created by the vacation could only be developed in accordance with the present General Plan designation and zoning unless a redesignation and rezoning were subsequently requested and approved following public hearings before the Planning Commission and City Council. Based upon the foregoing, it is recommended that the Commission report to the Council that the proposed street vacation is consistent with the Chula Vista General Plan. A letter dated October 11, 1993, has been received from Mr. and Mrs. Coughln which cites several objections to the request (please see attached letter). The objections are mainly related to traffic and safety issues related to specifics of the vacation and not to the issue of General Plan consistency. There will be a representative from the Engineering Department at the Commission hearing to help answer any questions on traffic and safety. But these issues are most appropriately addressed with the Safety Commission and City Council. F""""'e\p1omUng\l391.93 RESOLUTION NO. PCM-94-09 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CHULA VISTA REPORTING ON THE GENERAL PLAN CONSISTENCY OF A PROPOSED VACATION OF MOSS STREET BETWEEN ALPINE A VENUE AND NAPLES STREET WHEREAS, the San Diego Country Club and Country Club Villa Estates, owners of the triangular piece of property bounded by Moss Street, Alpine Avenue and Naples Street, have requested that the City vacate the portion of Moss Street between Alpine Avenue and Naples Street; and WHEREAS, on September 9, 1993, the City Safety Commission voted unanimously to support the recommendation of the City Engineering Department to approve the vacation of Moss Street as requested subject to the following conditions: 1. Widen Alpine Avenue between Moss and Naples to 52 feet; 2. Provide an all-way stop at this intersection of Alpine A venue and Naples Street; 3. Prohibit access to Alpine A venue from the applicant's property; and WHEREAS, the Planning Commission is required by Government Code Section 65402(a) to report on the General Plan consistency of street vacations prior to action thereon by the City Council; and WHEREAS, the Director of Planning set the time and place for a hearing on said report and notice of said hearing, together with its purpose, was given by its publication in a newspaper of general circulation in the City and its mailing to property owners within 1,000 feet of the exterior boundaries of the project site at least 10 days prior to the hearing; and WHEREAS, the hearing was held at the time and place as advertised, namely October 27, 1993, at 7:00 p.m. in the Council Chambers, 276 Fourth Avenue, before the Planning Commission and said hearing was thereafter closed; and NOW, THEREFORE, BE IT RESOLVED THAT THE PLANNING COMMISSION hereby finds that: 1. The requested vacation, along with the recommended conditions of approval as noted above, would meet the General Plan Circulation Element street standards and would enhance traffic safety by eliminating the acute angle at which Moss Street now intersects with Naples Street; 2. The Circulation Element diagram shows Moss Street intersecting with Naples Street near First Avenue and/or Alpine Avenue and thus the proposed configuration is consistent with the General Plan; 3. The Land Use Element and other Elements of the General Plan would not be affected by the proposed street vacation, and therefore the proposal is consistent with the Chula Vista General Plan and all of its Elements.
