PCS-91-07 - Consideration of tentative subdivision
map for Park Wav Place Townhomes. Chula Vista Tract
91-07 - Juan and Noelia Sanchez
A. BACKGROUND
The applicant has submitted a tentative subdivision map known as Park Way
Place Townhomes, Chula Vista Tract 91-07, in order to convert an 8-unit
apartment project into a one-lot 7-unit condominium on 0.32 acres at
364-368 Park Way.
The project is exempt from environmental review as a Class l(k) exemption.
B. RECOMMENDATION
Based on the fi ndi ngs conta i ned inSect ion "En of thi s report, adopt a
motion to approve the tentative subdivision map for Park Way Place
Townhomes, Chula Vista Tract 91-07, subject to the following conditions:
1. The conversion of two 2-bedroom units to a single 4-bedroom unit
(designated as Unit 7 on the tentative map) shall be completed prior
to the consideration or approval of a final map by the City Council.
2. Park Acquisition and development fees currently estimated at $3,810
per unit shall be paid prior to the approval of a final map.
3. The amount of any fees applicable to the project, including but not
1 imited to PAD fees, shall be those in effect at the time they are
collected.
4. The subdivider shall file with the City a copy of the CC&R's
applicable to the property. The CC&R's shall include:
a. Proh i bit i pn of 1. V. antennas, garage convers ions and parking
outside designated areas.
b. Maintenance of common areas and driveways.
5. The applicant shall submit evidence that each of the tenants of the
proposed condomi ni urn convers ion project has recei ved the foll owi ng
written notifications:
a. The subdivider shall provide proof to the satisfaction of the
City Engineer that the tenants have been notified at least 10
days prior to City Council consideration of the Final Map.

b. Ten days' notification that an appl ication for a publ ic report
will be, or has been, submitted to the State Department of Real
Estate, and that such report will be available on request.
c. One hundred eighty days' written notice of intention to convert
pri or to termi nat i on of tenancy due to convers i on or proposed
conversion.
6. Prior to approval of the final map the applicant shall submit
evidence that each of the tenants of the proposed condominium, has
been, or will be, given notice of an exclusive right to contract for
the purchase of his or her respective unit upon the same terms and
conditions that such unit will be initially offered to the general
public or terms more favorable to the tenant. The right shall run
for a period of not less than 90 days from the date of issuance of
the subdivision public report pursuant to Section 1101B.2 of the
Business and Professions Code, unless the tenant gives prior written
notice of his or her intention not to exercise the right.
7. All monuments of the subdivision shall be in place prior to approval
of the final map.

Existinq site characteristics.
The project is located on the south side of Park Way, east of Fourth
Avenue. The site is developed with an B-unit apartment project
consisting of two structures, each containing four 2-story townhouse type
units. A central driveway separates the two structures and provides
access to a total of 14 on-site parking spaces.
Tentative map.
The purpose of the subdivision map is to convert the project from rental
apartments to for-sale condominiums. The project was designed with 400
cu. ft. of private storage per unit within each of the eight garage
parking spaces. The requirement for private storage is the only
additional standard for condominiums versus apartments.

The project was constructed under previous parking standards which
allowed for a certain number of the required spaces -- in this case two
spaces -- to be accommodated with on-street spaces contiguous to the
site. In order to convert the project it must meet the current parking
standards of two spaces per unit, all on-site. The proposal, therefore,
is to convert two of the un its into a s i ngl e unit. Thi s results in a
total of seven units and 14 on-site parking spaces.
E. FINDINGS
Pursuant to Section 66473.5 of the Subdivision Map Act, the tentative
subdivision map for Park Way Place Townhomes, Chula Vista Tract 91-07, is
found to be in conformance wi th the vari ous el ements of the City's General
Plan based on the following:
1. The site is physically suitable for residential development and the
proposal conforms to all standards establ ished by the City for such
projects.
2. The design of the subdivision will not affect the existing
improvements -- streets, sewers, etc. -- which have been designed to
avoid any serious problems.
3. The project is in substantial conformance with the Chula Vista
General Plan Elements as follows:
a. land Use - The project dens ity of 22 du/ac is cons i stent with
the General Plan designation of High Density Residential (18-27
du/ac) .
b. Ci rcul at i on - The convers i on does not impact the General Pl an
circulation network.
c. Housing - The conversion will provide a for-sale product at the
low end of the range for ownership housing.
d. Conservation The site is presently developed, and thus
approval of the map will not impact conservation issues.
e. Park and Recreat ion, Open Space - The proposal wi 11 be requi red
to contribute PAD fees to provide for park and recreation
facil ities in the central area.
f. Sei smi c Safety - There are no concerns with sei smi c safety on
the site that were not addressed with original construction.
g. Safety - The project is within acceptable response times for all
public safety agencies.
h. Noise - The project is in conformance with City noise standards.

i. Scenic Highway - The project site is not on a scenic highway.
j. Bicycle Routes - The project site is not adjoining a designated
scenic route.

Statement of disclosure of certain ownership interests, payments, or campaign contributions, on all matters
which will require discretionary action on the part of the City Council, Planning Commission, and all other
official bodies. The following information must be disclosed:
1. List the names of all persons having a financial interest in the contract, i.e., contractor,
subcontractor, material supplier.
2. If any person identified pursuant to (1) above is a corporation or partnership, list the names of all
individuals owning more than 10% of the shares in the corporation or owning any partnership
interest in the partnership.
