A Regular Meeting of the City Council of tile City of Chula Vista was called to order at 6:05 p.m. in the Council Chambers located in the Public Services Building, 276 Fourth Avenue, Chula Vista, California Councilmembers Davis, Moot, Padilia, and Deputy Mayor Salas. (Councilmember Padilia arrived at 6:09 p.m) ABSENT: Mayor Horton, who was out of town on City business ALSO PRESENT: City Manager Rowlands, City Attorney Kaheny, City Clerk Bigelow 2 PLEDGE OF ALLEGIANCE TO THE FLAG, MOMENT OF SILENCE 3 APPROVAL OF MINUTES of May I I, 1999 and May 18, 1999 (Regular Meeting of tile City Council) and May 18, 1999 (Joint Meeting of the Redevelopment Agency, City Council and the Housing Authority) ACTION: Councilember Davis moved approval of the minutes as submitted. Councilnember Moot seconded the motion, and it carried 3-0 with (Councilmember Padilia not yet present. 4 SPECIAL ORDERS OF THE DAY - None were submilled CONSENT CALENDAR (Items 5 through 14) A member of the public asked that Consent Calendar Item #6 (A-T) be removed for separate consideration. Staff'asked that Item #9C be removed from the Consent Calendar and considered as an Action Item. 5. WRITTEN CON'IMUNICATI()NS A Letter from the City Attorney stating that to the best of his knowledge from observence of actions taken in Closed Session on May 18, 1999, there were no actions taken which are reqnired under the Brown Act to be reported. Stafff recommendation: The letter be receivcd and filed I, ROLL CALL PRESENT: CONSENT CALENDAR (Continued) B. Letter of resignation from the Human Relations Commission - Rafael J. Aguilar. Staff recommendation: The resignation be accepted with regret and the City Clerk be directed to post immediately according to the Maddy Act in the Clerk's Office and the Public Library. ORDINANCE 2790, AMENDING VARIOUS SECTIONS OF THE MUNICIPAL CODE RELATING TO TITLE DESIGNATIONS DUE TO DEPARTMENTAL REORGANIZATIONS (FIRST READING) In July, 1998, the Department of Planning and the Department of Building and Housing were reorganized The reorganization removed the titles of Planning Director and Director of Building and Housing and replaced it with Director of Planning and Building. As a result, severaI Municipal Code sections must be changed to reflect the title changes. Staff recommendation: Council place the ordinance on first reading. (Director of Planning and Building) RESOLUTION 19470, AMENDING THE FISCAL YEAR 1998/99 INSURANCE BUDGET AND APPROPRIATING FUNDS THEREFOR (4/5TH'S VOTE REQUIRED) This action appropriates funding for payment of previously authorized claim settlements and expenditures. Staff recommendation: (Council adopt the resolution. (Risk Manager and City Attorney) 9.A. RESOLUTION 19280, APPROVING AN AMENDMENT TO COUNCIL POLICY NUMBER 505-02 REGARDING TllE USE OF EARLY L1ENING PROCEDURE (CONTINUED FROM JANUARY 19, 1999.) RESOLUTION 19281, APPROV1NG THE FORM OF THE SECOND AMENDED ACQUISITION/FINANCING AGREEMENT FOR ASSESSMENT DISTRICT NUMBER 97-2 (OTAY RANCH, VILLAGE ONE) Assessment District 97-2 provides public funding for the acquisition of public improvements within Otay Ranch, Village One. The district was formed under the Municipal Improvement Act of 1913. Current Council Policy Number 505-2 requires that a project be fillly completed and accepted by the City prior to acquisition. The amended policy is incorporated in the proposed amendment to the Acquisition/Financing Agreement which establishes the procedure for acquiring the improvements from the developer. RESOLUTION 19471, APPROVING AGREEMENTS WITH WILLDAN ASSOCIATES FOR ACQUISITION SERVICES ASSOCIATED WITH COMMUNITY FACILITIES DISTRICT NUMBER 97-3 AND ASSESSMENT DISTRICT NUMBER 97-2, AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENTS At the request of the developers, Council approved the formation of Community Facilities District Number 97-3 and Assessment District Number 97-2 to finance the acquisition of public infrastructure serving Otay Ranch SPA One properties. The two agreements with Willdan Associates are for auditing services associated with the acquisition of public improvements financed by said districts Staff recommendation: Council adopt the resolution (Director of Public Works) 11. RESOLUTION 19472, AWARDING A ONE-YEAR CONTRACT, WITH A TWO-YEAR EXTENSION AT CITY'S OPTION, TO SPECIAL DISTRICT FINANCING & ADMINISTRATION, LLC FOR PERFORMANCE OF SPECIAL DISTRICT ADMINISTRATIVE SERVICES FOR COMMUNITY FACILITIES DISTRICT, AND AUTHORIZING THE MAYOR TO EXECUTE THE AGREEMENT During Fiscal Year 1998/1999, the City established six new Community Facilities Districts in the Otay Ranch and Sunbow developments for the construchon of public facilities or for the maintenance of open space areas. The City requires the services of a consultant to perform services necessary to administer the districts, including calculating charges to be levied on each parcel and delivering a magnetic tape with this information to the County prior to the August 10th deadline. Staff recommendation: Council adopt the resolution (Director of Public Works) 12. RESOLUTION 19473, APPROV1NG A THREE-YEAR AGREEMENT WITH THE SAN DIEGO UNIFIED PORT DISTRICT FOR TIDEL AND MAINTENANCE SERVICES 1N THE AREA OF BAYSIDE PARK, CHULA VISTA BAYFRONT PARK, MARINA VIEW PARK AND ADJACENT MEDIANS OF SAN DIEGO UNIFIED PORT DISTRICT PROPERTY The City and San Diego Unified Port District staff have negotiated a new three-year maintenance agreement for Port District property at the Bayfront Park, Marina View Park, Bayside Park and landscaped medians on Tidelands Avenue between Sandpiper Way and West "J" Street. The Agreement amount is not to exceed $339,120 per fiscal year unless a written request and documentation is submitted to the Port District for approval Staff recommendation: Council adopt the resolution (Director of Public Works) 13.A. RESOLUTION 19474, APPROVING A DEFERRAL AGREEMENT WITH SHEA HOMES AND OTAY PROJECT LLC CONCERNING TIlE DEVELOPMENT OF CERTAIN LOTS IN NEIGHBORHOODS R-7 AND R- I 0 OF OTAY RANCH SPA ONE, VILLAGE ONE AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT Page 3 - Council 05/25/99 CONSENT CALENDAR (Continued) RESOLUTION 19475, APPROVING FINAL MAPS OF TRACT NUMBER 96-04, OTAY RANCH, VILLAGE ONE, NEIGHBORHOODS R-7 AND R-10, ACCEPTING ON BEHALF OF THE CITY, GENERAL UTILITY AND ACCESS EASEMENTS, AND WALL EASEMENTS GRANTED ON SAID MAPS WITHIN SAID SUBDIVISIONS, ACKNOWLEDGING THE IRREVOCABLE OFFER OF DEDICATION OF FEE INTEREST FOR OPEN SPACE AND OTHER PUBLIC PURPOSES, APPROV1NGTHE SUBDIVISION IMPROVEMENT AGREEMENT FOR THE COMPLETION OF IMPROVEMENTS REQUIRED BY SAID SUBDIVISION, AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT RESOLUTION 19476, APPROVING SUPPLEMENTAL SUBDIVISION IMPROVEMENT AGREEMENT FOR THE FINAL "B" MAPS OF NEIGHBORHOODS R-7 AND R-10 1N VILLAGE ONE, SPA ONE OF THE OTAY RANCH PROJECT The agreement provides that Shea Homes will deli:r construction of 84 homes in R-7 and 71 homes in R-I 0 in order to obtain final map approval for both neighborhoods at this time. The total number of non-deferred units is 99, which is within the threshold limits for SPA One set by the Olympic Parkway Agreement. Staff recommendation: Council adopt the resolutions. REPORT ON THE FISCAL STATUS AS OF THE END OF THE THIRD QUARTER OF FISCAL YEAR 1998/99 In accordance with Charter Section 504(f), the fiscal status report as of March 31, 1999, was presented to Council. The adoption of these Codes is in conformance with Council Policy 500-04, as adopted by Resolution 5656, which endorses the establishnqent and maintenance of Uniform Building Regulations within the jurisdictions of the County of San Diego. Staff recommendation: Council adopt the urgency ordinances and place the remaining ordinances on first reading (Director of Planning and Building) Carolyn Butler, 97 Bishop Street, stated that she did not want any changes made to the City Charter. RESOLUTION 19282, AUTHORIZING AND PROVIDING FOR THE ISSUANCE OF LIM1TED OBLIGATION IMPROVEMENT BONDS FOR ASSESSMENT DISTRICT NUMBER 97-2 (OTAY RANCH VILLAGE ONE), APPROVING THE FORM OF BOND INDENTURE, BOND PURCHASE AGREEMENT AND OTHER DOCUMENTS AND AUTHORIZING CERTAIN ACTIONS IN CONNECTION THEREWITH Staff's description and recommendation regarding this item appears on page two, under Consent Calendar Items 9A and 9B. Page 6 - Council 05/25/99 ORAL COMMUNICATIONS Carolyn Butler, 97 Bishop Street, accused the City of unlawful practices with regard to real estate issues and asked that there be no changes made to the City Charter prior to August 10"1. OTHER BUSINESS 15. CITY MANAGER'S REPORTS A. The City Manager stated that the June I, 1999 City Council meeting has been canceled. B. Fiscal Year 1999/2000 Budget Overview The City Manager presented an overview of the budget, stating that budget hearings are scheduled for June 15th, 16th, and 17th, and the budget reflects Council's directions and policy, as well as Mayor Hortons "renewal" theme in her 1999 State of the City address. 16.
