Lippitt, Director of Public Works {~ SUBJECT: NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) MUNICIPAL PERMIT, ORDER NO. 2001-01 Introduction On February 21, 2001, The Regional Water Quality Control Board, San Diego Region (RWQCB) adopted the new NPDES Municipal Permit Order No. 2001-01 (Permit). The new Permit replaces NPDES Municipal Permit Order No. 90-42. Pursuant to the Federal Clean Water Act and the California Porter-Cologne Water Quality Control Act, the City of Chula Vista, as a discharger of storm water to the waters of the United States, and with a population of more than 100,000 is required to maintain coverage under the NPDES Municipal Permit, and comply with its requirements. Order No. 2001-01 is a general permit encompassing all the cities within the San Diego County as well as the County of San Diego and the San Diego Unified Port District. Each agency covered by the Permit is referred to as a Copermittee. In total, twenty Copermittees are covered under the Permit. Summary of Permit Requirements The following information is a brief summary of issues concerning the new Permit, and their impact on the City, its residents and developers, as well as existing industrial and conm~ercial facilities. In order to attain compliance, the Permit requires the Copermittees to perform numerous tasks, which can be classified under two major sections, i.e. A) Jurisdictional Urban Runoff Management Program, and B) Watershed Urban Runoff Management Program. Each of the above sections include several components as summarized below: A. Jurisdictional Urban Runoff Management Program (JURMP) This section includes five major components as follows: 1. Land-Use Planning for New Development and Redevelopment Component Under this component, the City is required to assess and revise or modify its General Plan, development project approval processes, environmental review processes; and conduct education efforts focused on new development and redevelopment. Informational Item 2 December 13, 2001 2. Construction Component The City is required to ensure compliance with the Permit by the developers and contractors during grading and construction stages of development projects. This component includes updating the grading ordinance, modifying construction and grading approval processes, and implementing or requiring the developers and contractors to implement pollution prevention methods and Best Management Practices (BMPs). The City is also required to identify and prioritize active construction sites according to their threat to water quality, inspect construction sites for water quality on a frequent basis, and enforce the Permit requirements, and finally report non-compliant sites, and educate developers and contractors. 3. Existing Development Component Under this component, the City is required to identify various facilities and land uses which may be potential sources of storm water pollution, including municipal, industrial, commercial and residential; and prioritize such facilities or land uses according to their threat to water quality. The City is then responsible to designate pollution prevention measures and BMPs for each facility and land use, make regular inspections, and take enforcement measures if necessary in order to ensure compliance. It may be determined that some industrial sites require monitoring of non-point-source runoff for water quality. Under such circumstances, the City is to implement or require implementation of monitoring programs, and report non-compliant sites. Mandatory municipal BMPs include annual cleaning of municipal storm drainage systems, regular sweeping of streets, and management of pesticides, herbicides, and fertilizers on public open spaces, parks, golf courses, etc. 4. Education Component The education component may include newspaper advertisements, informational brochures or posters, technical workshops, Internet outreach, and participation in public events for dissemination of storm water quality information to the public. The targeted groups will include municipal departments and personnel; construction site owners and developers; industrial owners and operators; commercial owners and operators; residential community, general public, school children; and quasi-governmental agencies/districts. 5. Illicit Discharge Detection and Elimination Component This section comprises a program, by which NPDES Staff become aware of illicit discharges and illegal connection to the City's storm water conveyance system. A 24-Hour hotline is to be established for reporting of any violations. NPDES Staff are required to respond to such reports as soon as possible. A second part of this component includes Dry Weather Field Screening and Analytical Monitoring. This section was required under the previous permit, but in the new permit, it has been expanded to include additional water quality Informational Item 3 December 13, 2001 testing and analysis. The City is already implementing parts of this component regarding sanitary sewer surveys and maintenance, sewage spill prevention and response, and used oil and toxic materials disposal. In addition, the JURMP shall include, as part of the new Permit requirements, other components such as: the Public Participation Component, Assessment of the JURMP Effectiveness Component, and Fiscal Analysis Component. B. Watershed Urban Runoff Management Program This section of the Permit comprises development and implementation of a Watershed Urban Runoff Management Program (WURMP) by the Copermittees sharing the same watershed. Chula Vista is located within the San Diego Bay Watershed, together with nine other agencies. Several joint tasks are included in the Watershed program, including assessment of water quality of all receiving waters (wet weather monitoring), development of a watershed map, identification and prioritization of major water quality problems, and watershed based educational program. City of Chula Vista is presehtly participating in the Countywide wet weather monitoring, but the new Permit will require more extensive monitoring and testing to be carried out in each watershed. Implementation Schedule Implementation periods for the above tasks generally range from 180 to 365 days from the date of adoption of the Permit, i.e. August 21, 2001 to February 21, 2002. Exceptions are assessment of Field Screening results, assessment of JURMP, fiscal analysis of URMP; and Development and implementation of WURMP, that are scheduled for January 31, 2003. Actions to Date 1. Model Programs - In order to develop consistent programs across the county, the Copermittees have been participating in various workgroups formed under the County of San Diego (the Principal Copermittee) Project Clean Water initiative. The goal of the workgroups has been to develop model programs for each category of the Permit requirements. The workgroups have had several meetings, and some have come up with draft model programs. Other workgroups are in the process. The Model Programs will ultimately be used by each Copermittee as a basis for development of their individual JURMPs. 2. Legal Authority - Another action taken by the Copermittees in compliance with the Permit requirements, has been the submittal of statements to the Regional Water Quality Control Board, certifying that the Copermittees have adequate legal authority to implement and enforce each of the requirements contained in the federal regulations (40CFR 122.26(d)(2)(i)(A-F)), and the Permit. The City Attorney's Office prepared and submitted to the RWQCB, such a statement on August 21, 2001 on behalf of the City of Chula Vista. Informational Item 4 December 13, 2001 3. Interdepartmental Coordination - Several meetings have taken place between various City departments and sections to discuss the responsibilities of each department or section in execution of the Permit requirements. Exhibit 1 lists various tasks to be undertaken under the new Permit, together with the deadlines for completion of each task, and sections or departments responsible for the implementation of the tasks. Based on the outcome of these meetings, the following departments and sections will be involved in NPDES issues: a. Engineering NPDES Section will oversee and coordinate all efforts; will be the lead section for contact with other agencies, including RWQCB; ensure that all necessary monitoring and reporting are done in a timely manner; participate in workshops, seminars, and meetings relating to NPDES; conduct education and public outreach activities; initiate consultant selection process and oversee proper execution of the work; inspect existing industrial, commercial, residential, and municipal facilities, as well as new construction (building work) developments for compliance with the Permit; initiate and follow through enforcement action as necessary; assess JURMP effectiveness and prepare compliance annual reports; and prepare fiscal analysis for implementation of the Permit requirements. b. Engineering - Construction Inspection Section will inspect construction sites (civil work) for compliance with the Permit Construction Component. They will ensure that the developers and contractors implement their Storm Water Pollution Prevention Plans (SWPPPs), proper BMPs are in place at all times, and runoff from the site is monitored during the rainy season as required under the NPDES General Construction Permit. c. Engineering - Land Development and NPDES Sections will review each subdivision's development plans and SWPPPs, and recommend necessary changes to ensure that the development will not adversely impact the water bodies of the region. d. Engineering Project Management and Design Section will include pollution prevention measures in the design of public projects, and prepare SWPPPs for such projects. e. Management and Information Services GIS Section will prepare databases and maps for all drainage systems; use existing databases to identify sources and prepare priority lists for industrial, commercial, construction, municipal and residential land uses; and develop and prepare other maps and data as required by the Permit. Such data and maps are required to be reviewed and revised on an annual basis. f. Planning Department & Engineering will include requirements in the permit and environmental review process, such that developers are made aware of the NPDES pollution prevention requirements from the earliest stages of the permit application; and will review development studies and designs to ensure that they include adequate features for permanent pollution prevention. Informational Item 5 December 13, 2001 g. Public Works Operations Section will develop, implement, and maintain BMPs within all public land uses. Such land uses include City facilities and buildings, public streets, parks, and storm water conveyance systems; prevent and respond to sewage spills; and survey and monitor sanitary sewer and storm drainage pipes. h. City Attorney's Office will take over enforcement cases where initial enforcement actions by the Engineering Staff do not result in compliance. The City Attorney's Office has been working on amendments to Chapter 14.20 of the Chula Vista Municipal Code (Storm Water Management and Discharge Control) to include provisions based on the new Permit requirements, and City staff experience from the previous permit enforcement. i. Special Operations Section and Engineering (NPDES Section) will perform public outreach and education; facilitate hazardous waste disposal, oil recycling and conservation. j. Fire Department will implement BMPs for non-emergency fire fighting flows. 4. A consultant engineering company was hired to develop the City's JURMP. The first draft of the document was submitted to the City on December 3, 2001, and copies were distributed to various departments for their review and comment, before preparation of the final version. Impact on Developments Under the new Permit, the City will be responsible to evaluate each industrial and commercial facility operating in the City, for their threat to water quality, and require the high priority facilities to implement BMPs to prevent pollution of the storm drainage systems. Some of the industrial and commercial facilities will be financially impacted, particularly small businesses. Impact on the City of Chula Vista Public Works/Engineering Division The City is presently in compliance with the requirements of the superseded permit (Order No. 90-42). In order to attain compliance with the additional requirements of the new Permit, the City will need to deploy additional resources and funds as follows: 1. Additional staff for development and administration of programs, coordination and reporting, and review of development studies and designs. 2. Additional staff for inspection and enforcement of new construction, and existing industrial, commercial, residential, and municipal sites. 3. Additional staff for public education and outreach. Informational Item 6 December 13, 2001 According to the City of Chula Vista Reference Book 2000 Edition, in the Year of 1999, there were 3,500 new construction Permits processed (2,561 residential, 35 Commercial, and 904 miscellaneous). In compliance with the new Permit, beginning February 21, 2002, the City is required to inspect high priority construction sites weekly. Also, the City is required to inspect existing commercial facilities (as needed), industrial facilities (high priority facilities annually), municipal sites and facilities (high priority facilities annually), and residential sites (as necessary). The new Permit will require additional resources including monetary and staff; which will require budget enhancement for the NPDES Section. While many questions remain as to exactly how this program will be implemented, it is clear that significant program changes will be needed. Therefore, additional appropriation will be needed to cover the new requirements. Substantial portions of the costs will be chargeable to developers for review and inspection services. However, the other portions of the cost that are related to the existing facilities (commercial, industrial, municipal, and residential) are not associated with a chargeable deposit account. Therefore, staff will continue to evaluate the extent of additional resources after the completion of the JURMP in February of 2002. The Public Works Department, Finance Department, and the City's Attorney Office are working together to identify funding sources to cover additional costs associated with the implementation of the new Permit. Public Works/Operation Division Since the NPDES permit is new, it is currently unknown what maintenance demands will be placed on the Operations Division to maintain the City's storm drain system. Therefore, staff is unable to adequately estimate the staffing and equipment needs at this particular time. The consultant will determine what maintenance is required to be performed under the new permit, so that staff can then determine what staffing and equipment will be needed to perform the necessary maintenance. Future staffing requests may be forthcoming once the full scope of work is known.
