Concerns were expressed by Mr. Michael Spata representing United Enterprises' interests relative to: (1) extension of trunk sewers into his client's holdings, and (2) the need for environmental processing of the ordinance because of its growth inducing aspects. Council decided to continue its hearing and consideration of the ordinance for three weeks until March 19, 1985. Duri ng the i nterveni ng time, staff has met wi th Uni ted Enterpri ses representatives and has modified both the Fee Study and the proposed ordinance in a manner designed to minimize or eliminate the expressed concerns. RECOMMENDATION: That Council place the ordinance on First Reading. BOARDS/ClJIIIIISSIONS REC()IIIENDATION: Not applicable. DISCUSSION: Chul a Vi sta is one of very few agenci es whi ch does not impose a charge agai nst new constructi on for sewage treatment pl ant and/or trunk sewer capaci ty. Capacity in such facilities is characteristically provided at public expense and typically allows latitude for community development. It is proposed that a sewerage facility participation fee be implemented so as to permit the citizenry to be repaid for the investment to allow development of Chula Vi sta. The Ci ty Engi neer' s study submi tted to Council on January 22, 1985, described the justification and basi s of the proposed fee. That study has been revised and is submitted herewith. The system of fees proposed is based on a charge of $300 per equival ent dwelling unit (EDU). EDU equivalencies for many common land uses are included in the proposed schedule. Both the plat and the various references have been stricken in the modified study. As originally presented the study could have been interpreted as being "growth inducing" and therefore subject to environmental review. The modified study includes no references to trunk sewer extensions, nor does it depict conceptual future trunks to serve the eastern territory.
