RESOLUTION NO. 2007-
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA RATIFYING THE PROCLAMATION OF
LOCAL EMERGENCY ISSUED BY THE CITY DIRECTOR OF
EMERGENCY SERVICES AND EXTENDING THE
PROCLAMATION UNTIL OCTOBER 25,2007, AT 1 :00 P.M.
WHEREAS, Chapter 2.14 of the City of Chula Vista Municipal Code empowers the
Director of Emergency Services (City Manager) to proclaim the existence or threatened
existence of a local emergency when the City is affected or likely to be affected by a public
calamity and the City Council is not in session; and
WHEREAS, a meeting of the City Disaster Council was convened by the Chair (Mayor)
and the Director of Emergency Services at or around 8 :00 am. on October 22, 2007, in order to
assess the threat posed by multiple uncontrolled fIres burning at and around the perimeter of the
City, which began on October 21, 2007 [Fires]; and
WHEREAS, based upon the input and analysis of the various members of the Disaster
Council, including City Fire and Police Department personnel, as of 1 :00 p.m., October 22,
2007, the Director of Emergency Services determined that: (1) conditions of extreme peril to the
safety of persons and property had arisen within the City of Chula Vista caused by the Fires; and,
(2) these conditions were likely to be beyond the control of the services, personnel, equipment,
and facilities of the City; and
WHEREAS, at that time, the City Council was not in session and could not immediately
be called into session; and
WHEREAS, based upon the facts and circumstances set forth above, the Director of
Emergency Services declared a local state of emergency throughout the City effective as of
1 :00 p.m. on October 22, 2007, pursuant to the Proclamation of Local Emergency attached as
Exhibit A [proclamation]; and
WHEREAS, the Proclamation shall expire at 1:00 p.m. on October 25, 2007, unless
extended by action of the City Council of the City of Chula Vista; and
WHEREAS, pursuant to California Government Code section 54956.5, an emergency
meeting was properly noticed by the City Clerk and called by a majority of the City Council at
6:00 p.m. on October 23,2007, in order to reassess the threat posed by the multiple Fires and the
state of local emergency; and
WHEREAS, such reassessment requires the prompt action by the City Council in order to
protect the public health and safety; and

WHEREAS, at the emergency meeting, the Director of Emergency Services presented to
the City Council the following information:
I. Several large Fires are currently burning simultaneously throughout the County of
San Diego requiring all available emergency personnel to immediately respond on
a mutual aid basis.
2. The Chula Vista Fire Department has currently deployed resources necessary to
provide immediate assistance for the Harris and Witch Creek Fires and the
surrounding community.
3. The Harris Fire poses an extreme threat to eastern Chula Vista and the potential
for spread of the Harris Fire to the heavily fueled corridors of the City poses a
danger to the population and property in the eastern Chula Vista neighborhoods of
Bella Lago, Rolling Hills, San Miguel Ranch and The Woods at Eastlake.
4. The City of Chula Vista has a unique urban interface characteristic of heavily
urbanized development located adjacent to wild land.
5. The threat of burning and out of control Fires remains a risk to the City depending
on fire behavior, unburned fuels, and weather conditions.
6. The Chula Vista Fire Department has deployed its resources throughout the
region as part of the mutual aid response to the multiple Fires burning within the
San Diego County Region that impacts readily available resources for the City.
NOW, THEREFORE, based on the facts and circumstances set forth above, the City
Council of the City ofChula Vista hereby resolves as follows:
I. The Proclamation issued by the Director of Emergency Services is hereby ratified.
2. A state oflocal emergency is extended until October 25, 2007, at 1:00 p.m. unless
further extended by action of the City Council, or earlier terminated by action of
the Director of Emergency Services.
3. During the existence of the local emergency, the powers, functions, and duties of
the City Disaster Council and the Director of Emergency Services shall be those
prescribed by state law, and by the Charter, ordinances, and resolutions of the
City, including, without limitations, the provisions of Chula Vista Municipal
Code section 2.14.080.
4. The City Clerk is directed to comply with the posting requirements of
Government Code section 54956.5(e).

PROCLAMATION OF LOCAL EMERGENCY
WHEREAS, Chapter 2.14 of the City of Chula Vista ("City") Municipal Code empowers
the Director of Emergency Services (the City Manager) to proclaim the existence or
threatened existence of a local emergency when the City is affected or likely to be
affected by a public calamity and the City Council is not in session;
WHEREAS, The Director of Emergency Services at or around 8:00 a.m. on October 22,
2007 activated the City's Emergency Operations Center (EOe) in order to access the
threat posed by The Harris Potrero Fire at and around the perimeter of the City, which
began on or about October 21, 2007;
WHEREAS, based upon the input and analysis of the various members of the EOC
Management/Policy Group, including City fire and police department persounel, as of
I :00 pm October 22, 2007, the Director of Emergency Services determined that (I)
conditions of extreme peril to the safety of persons and property had arisen within the
City of Chula Vista caused by the Fires; and (2) these conditions were likely to be beyond
the control of the services, personnel, equipment, and facilities of the City;
WHEREAS, the City Council of the City is not in session and cannot immediately be
called into session;
NOW, THEREFORE, IT IS HEREBY PROCLAIMED by the Director of Emergency
Services that, based upon the facts and circumstances set forth above, a local emergency
exists throughout the City of Chula Vista effective as of I :00 p.m. on October 22, 2007;
IT IS FURTHER PROCLAIMED AND ORDERED that during the existence of said
local emergency, the powers, functions, and duties of the City Disaster Council and the
Director of Emergency Services shall be those prescribed by state law, and by the charter,
ordinances, and resolutions of the City including, without liruitation the provisions of
Chula Vista Municipal Code Section 2.14.080.
This emergency proclamation shall expire at I :00 p.m. on October 25, 2007 unless
extended by action of the City Council of City of Chula Vista. This emergency
declaration shall be submitted to the City Council for ratification at its regular meeting of
October 23, 2007.
