IV ASSISTANT CITY MANAG R L.,. r SUBMITTED BY: REVIEWED BY: 4/STHS VOTE: YES D NO 0 BACKGROUND In June of 2005, the Chula Vista Redevelopment Agency (Agency) and Sunroad CV Auto, Inc., entered into an Owner Participation Agreement (OPA) for the development of the Chula Vista Toyota auto dealership. One of the terms of the OP A is that the Agency will diligently facilitate the construction of an auto park directional sign for the benefit of the entire auto park. ENVIRONMENTAL REVIEW The Environmental Review Coordinator has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA) and has determined that the activity is not a "Project" as defined under Section 15378 of the State CEQA Guidelines because at this time the action only involves authorizing staff to negotiate the purchase of property; therefore, pursuant to Section 15060 (c )(3) of the State CEQA Guidelines the activity is not subject to CEQA. Although environmental review is not necessary at this time, once a project has been specifically defmed, environmental review will be required and a CEQA determination completed prior to commencing any construction activities on the subject property. RECOMMENDATION That the Redevelopment Agency adopt the resolution authorizing the Executive Director, or his designee, negotiate the acquisition of interest in real property located at 4555 Main Street and enter into an agreement subject to the Agency's approval to allow for the development of a directional sign for the Chula Vista Auto Park. 1-1 August 14,2007 Item_ Page 2 of2 BOARDS/COMMISSION RECOMMENDATION Not Applicable DISCUSSION As stated above, in 2005 the Agency entered into an OPA with the developer of the Chula Vista Toyota dealership. The OP A contains several provisions, one of which states that the Agency shall diligently pursue the facilitation of construction of an auto park directional sign in the vicinity of Main Street and east of Interstate 805 for the purpose of directing travelers to the Chula Vista Auto Park. The cost of the sign construction was to be paid using Redevelopment Agency funds. The action before the Agency would authorize staff to negotiate with the owner of the property located at 4555 Main Street. This action does not authorize the construction of the directional sign or the expenditure of any funds for the construction of a directional sign. If the negotiations with the property owner are successful, staff would return to the Agency at a future date to review the terms of the agreement. The Agency would also at that time have the opportunity to review the merits of a proposed directional sign and any financial impacts, as well as any alternatives that may be proposed by members of the community or staff. Based upon the direction given to staff at a previous meeting, a proposed sign design and the related financial impacts would be presented to the Agency for their review and consideration. Sign Regulations In July 2003, the City amended its Sign Ordinance with the primary purpose of properly legislating the City's long-standing prohibition of new billboard signs. The new Sign Ordinance completely prohibits the construction, erection or use of any billboards, other than those which legally exist in the City, or for which a valid permit has been issued and has not expired, as of the date on which the provision is first adopted. The Ordinance further states that no permit shall be issued for any billboard which violates this policy, and the City will take immediate abatement action against any billboard constructed or maintained in violation of this policy, The new Sign Ordinance split the city's rules and policies into two separate and distinct chapters (CVMC 19.60.060). The Sign Ordinance regulates only signs located on private property. The second sets policies for signs on property owned or controlled by the City (Council Policy 465-02). An auto park sign on property owned or controlled by the City or Agency would be considered a directional sign, which is a permitted use while a similar sign on private property would be considered a billboard, which is prohibited. DECISION MAKER CONFLICT Staff has reviewed the property holdings of the Redevelopment Agency Members and has found no property holdings within 500 feet of the boundaries of the property which is the subject of this action. FISCAL IMPACT Adoption of the resolution only commits staff resources to negotiate interest in the property. No other costs are anticipated as a result of this action. However, the Owner Participation Agreement contemplates the expenditure of up to $1.2 million for the design and construction of the sign. The $1.2 million was part of the approved Agency budget for fiscal year 2007/08.
