Twenty-one Community Facilities Districts (CFDs) were formed during fiscal years 1998
through 2006. Each year, a special tax must be levied in each of the districts to pay for
the maintenance of open space and preserve areas and maintenance of other public
facilities, or to repay bondholders. Adoption of the resolutions authorizes the levy of
maximum special taxes. (Acting Assistant City Manager/City Engineer)

STATE MANDATED WASTE DIVERSION AND RECYCLING PROGRAMS AS
PROVIDED FOR UNDER THE WASTE MANAGEMENT ACT (AB 939)
AB 939, known as the Waste Management Act of 1989, requires cities and counties to
divert 50% of the waste going to the landfills. AB 939 was an unfunded mandate, which
provided for jurisdictions to charge for the programs and services required to meet this

According to the terms and conditions of the City's franchise agreement for solid waste
and recycling services, the contractor is entitled to an annual rate adjustment. The
adjustment formula has very specific limiting factors, which ensure that the ratepayers of
Chula Vista will continue to have some of the lowest rates for service in San Diego

BACKGROUND

or to repay bondholders. The present item will authorize the levy of maximum special
taxes for CFDs 97-1, 97-2, 97-3, 98-1, 98-2. 98-3, 99-1, 99-2, 2000-1, 2001-1, 2001-2,
06-1,07-1, 07-M, 08-M, 08-1, 09-M, ll-M, 12-1, 12-M, 13-1 and 13-M.

ENVIRONMENTAL REVIEW
The Environmental Review Coordinator has reviewed the proposed actlvlty for
compliance with the California Environmental Quality Act (CEQA) and has determined
that the activity is not a "Project" as defined under Section 15378 of the State CEQA
Guidelines because it involves an intention to levy and collect assessments for existing
activities in the Community Facilities Districts and does not involve any new activities,
therefore pursuant to Section l5060(c)(3) of the State CEQA Guidelines the activity is
not subject to CEQA. Thus, no environmental review is necessary
RECOMMENDATION
That Council adopts the resolutions:
. Authorizing the levy of maximum special taxes for Fiscal Year 2007/08 within
Community Facilities Districts 97-1, 97-2, 97-3, 98-1, 98-2, 98-3, 99-1, 99-2,
2000-1,2001-1,2001-2,07-1,08-1, 08-M, 09-M, ll-M, 12-1, l2-M, 13-1, and 13-
M and delegating to the City Manager the authority to establish the special tax for
each District.
. Authorizing the levy of maximum special taxes for Fiscal Year 2007/08 within
the Community Facilities Districts 06-1 and 07-M and delegating to the City
Manager the Authority to establish the special tax for each District.
. Amending the Fiscal Year 2007/08 services and supplies budget of CFD l2-M by
appropriating $432,486 from the available balance of the fund.

DISCUSSION
In January 1998, City Council adopted the City ofChula Vista Statement of Goals and
Policies Regarding the Establishment of Community Facilities Districts. This document
allowed the use of CFDs as a public financing mechanism for:
. Acquisition and/or construction of public improvements and facilities;
. Financing of authorized public services; and
. To repay bonded indebtedness or other related expenses.
During Fiscal Years 1998/99 through 2006/07, the following CFDs were formed in the
Otay Ranch, Sunbow II, San Miguel Ranch, Eastlake, and the Rolling Hills Ranch areas:

Maximum Rate & Actual Rate
The City of Chula Vista makes the distinction between the maximum special tax rate and
the amount that the City may collect against the special tax rate (i.e., the actual rate). The
maximum special taxes for Fiscal Year 2007/08 are proposed at the Fiscal Year 2006/07
maximum special tax rates and adjusted by an inflation factor as defined in each district's
special tax report. The actual rate, on the other hand, is the amount actually collected
from the property owner and is equal to, or lower than, the proposed maximum special
tax rate. The actual rate is based on the budget, the reserve requirement, savings and

fund balances, earned interest, and prior years' savings. Each year, the Council
authorizes the levy of special taxes on the maximum authorized special tax rates, and
delegates to the City Manager the authority to establish the specific special tax rate
applicable to each parcel.
The maximum special tax rate and actual special tax rate for these existing infrastructure
and open space maintenance CFDs are detailed in Exhibits A through U, and are
accompanied by district maps.
Fiscal Year 2007/08 Rates
Maximum Special Tax Rate
According to the Rate and Method of Apportionment for open space maintenance CFDs
97-1,97-2,98-1,98-3 and 99-2, the Maximum Special Tax Rates (see exhibits) for each
fiscal year after the initial year shall be increased or decreased by the lesser of the annual
percentage change in the San Diego Metropolitan Area All Urban Consumer Price Index
(CPI) or the annual percentage change in the estimated California Fourth Quarter Per
Capita Personal Income as contained in the Governor's budget published in January of
each year. The CPI increase between the second half of 2005 and the second half of 2006
was approximately 3.3998%, while the estimated California Fourth Quarter Per Capita
Personal Income increase was 5.05%. Staff therefore used the CPI (3.3998%), which is
the lesser of the annual percentage change.
According to the Rate and Method of Apportionment for open space maintenance CFDs
08-M, 09-M, and 12-M the Maximum Special Tax shall be increased each fiscal year
after the initial year and by a factor equal to the annual percentage change in the San
Diego Metropolitan Area All Urban Consumer Price Index. The CPI increase between
the second half of 2005 and the second half of 2006 was approximately 3.3998%.
According to the Rate and Method of Apportionment for open space maintenance CFD
l3-M, the Maximum Special Tax shall be levied beginning in Fiscal Year 2007-2008 and
increased each fiscal year thereafter by a factor equal to the greater of the annual
percentage increase if any, in the San Diego Metropolitan Area All Urban Consumer
Price Index (All Items) as reported by the State of California Department of Finance, or
4%. This will be the initial year of this assessment.
The maximum authorized and projected annual Special Tax rates for all Community
Facilities Districts are given in the exhibits. Square footage (SF) refers to building floor
area, and acreage refers to the total lot size. For CFD 98-3, a single-family dwelling unit
is equivalent to one EDU. Costs are spread to multi-family units on the basis of 0.8 EDU
per unit for street medians and parkways, and 1.0 EDU per unit for all other facilities in
the CFD.
Actual Special Tax Rate
The Special Tax Levy Reports for maintenance CFDs 97-1, 97-2 98-1, 98-3, 99-2, 08-M,
09-M, ll-M, l2-M and 13-M require the establishment ofa fund reserve for each district
of up to 100% of the total annual operating budget in order to provide revenue for the

first half of the fiscal year before any income is received and to provide for cost overruns
and delinquencies. A 50% reserve has been provided in some of these CFDs by
including an additional 50% of the Fiscal Year 2007/08 budgets. The reserves should
provide sufficient funding through December 31, 2007. Additional reserves may be
realized depending on the schedule for accepting new landscaping improvements during
the fiscal year.
The Fiscal Year 2007/08 actual special tax rates are not projected at this time due to the
volume of building permit activity within the City of Chula Vista and large volume of
subdivision activity in the County of San Diego. Staff proposes that the City Manager be
authorized to modify the projected annual special tax rates based on actual square footage
and acreage provided such annual special tax rates do not exceed the maximum
authorized special tax. Since the rates have been rounded, actual revenue may be slightly
different.
The final Special Tax Levy Reports will include a list of all parcel numbers and charges
applicable to each parcel. The valid parcel numbers cannot be known for certain until
after the special taxes have been submitted to the County for inclusion on the County
property tax bills. The final reports will be prepared in August.
Budget Amendment for CFD 12M
The landscaped areas for CFD 12M are being turned over to the City for maintenance
sooner than anticipated. Therefore, for FY07/08, a budget amendment of $432,486 is
required for the City to provide adequate landscape and storm drain maintenance
services. The landscape services include turf, ground cover, shrubs, trees, plants,
irrigation and drainage systems, ornamental lighting structures, masonry walls or other
fencing, trails, and associated appurtenant facilities located within the streetscape
(parkway, median and slope perimeter landscaping) surrounding the development and
trails, perimeter wall, and perimeter fencing. The storm water quality services include,
but are not limited to, maintenance, repair, and replacement of storm drains, catch basin
inserts, hydrodynamic devices, infiltration basins, and other similar facilities.
DECISION MAKER CONFLICT
Staff has reviewed the property holdings of the City Council and has found a conflict
exists, in that Council Member John McCann has property holdings within 500 feet of the
boundaries of certain Community Facilities Districts, which are the subject of this action.
FISCAL IMPACT
Infrastructure Districts
The scheduled debt service for bonded infrastructure districts in FY 2007/08 totals
$17,352,835 and is detailed in the table below. Projected special tax revenues will be
sufficient to cover these amounts with no impact to the General Fund.

Maintenance Districts
The full cost of providing maintenance services in these districts totals $6,748,519.71.
This entire amount is recovered through the CFDs' special tax levies and reserves,
resulting in no net impact to the General Fund.
CFD l2-M
All landscape maintenance costs associated with the Fiscal Year 2007/08 budget
amendment will be borne by the respective homeowners in CFD 12-M. Therefore, there
is no impact to the General Fund

monitoring, preserve security, and preserve improvements. The Fiscal Year 2007/08 budget is

biological surveys will need to be conducted at an estimated cost of $75,000. In addition to

CFDs 98-1 and 98-2 were created as interim districts because the areas of Otay Ranch included
in these districts were not developed and the density of development was not yet known at the
time that these districts were established. These districts were formed to provide a guarantee for
the financing of a portion of the cost of the maintenance of portions of the parkways and medians
along Telegraph Canyon Road, Paseo Ranchero, and Olympic Parkway. They also include the
Telegraph and Poggi Canyon detention basins and channels allocable to the properties within
these districts. Both CFD 98-1 and CFD 98-2 will remain in place until a permanent financing
plan is established for the maintenance of the facilities, through the formation of new CFDs.
A portion of CFD 98-1 has been absorbed by CFD 99-2 with other portions absorbed by CFD's
08-M, 12-M and 13-M. The Fiscal Year 2007/08 budget for this District totals $102,418.
A portion of CFD 98-2 has been taken over by maintenance district, CFD 08-M, with other
portions of the district covered by CFD 12-M. None of the improvements in CFD 98-2 are
expected to be turned over to the City in Fiscal Year 2007/08 and therefore no special taxes will
be levied within this district in Fiscal Year 2007/08.

$781,318.37. The CFD Special Tax Levy Report for maintenance 09-M requires the
establishment of a fund reserve for each district of up to 100 percent of the total annual operating
budget in order to provide revenue for the first half of the fiscal year before any income is
received and to provide for cost overruns and delinquencies, A 95% reserve has been provided
by including an additional 95% of the fiscal year 2007/08 budget. The reserves should provide
sufficient funding through December 31, 2007. Additional reserves may be realized depending
on the schedule for accepting new landscaping improvements during the fiscal year.
CFD 09-M (Maintenance District)
The full cost of providing maintenance services in this district totals $893,565. This entire
amount is recovered through the CFD's special tax assessments and reserves, resulting in no net

Road, and west of Magdalena A venue. The budgets for Fiscal Year 2007/08 are estimated to be
approximately $452,486 for both Improvement Area No.1 and Improvement Area No.2.

BUDGET BY APPROPRIATING $432,486 FROM

WHEREAS, the landscaped areas for CFD 12M are being turned over to the City
of Chula Vista for maintenance sooner than anticipated; and
WHEREAS, for Fiscal Year 2007-2008, a budget amendment of $432,486 is
required for the City to provide adequate landscape and storm drain maintenance
services; and
WHEREAS, landscape services include, but are not limited to, turf, ground cover,
shrubs, trees, plants, irrigation and drainage systems, ornamental lighting structures,
masonry walls or other fencing, trails, and associated appurtenant facilities located within
the streetscape (parkway, median and slope perimeter landscaping) surrounding the
development and trails, perimeter wall, and perimeter fencing; and
WHEREAS, the storm water quality services include, but are not limited to,
maintenance, repair, and replacement of storm drains, catch basin inserts, hydrodynamic
devices, infiltration basins, and other similar facilities; and
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of

BACKGROUND
AB 939, known as the Waste Management Act of 1989, requires cities and counties to divert 50% of the
waste going to the landfills. AB 939 was an unfunded mandate, which provided for jurisdictions to
charge for the programs and services required to meet this goal.
Public Resources Code 4190: "A city, county [,J or city and county may impose fees in amounts
sufficient to pay the costs of preparing, adopting, and implementing a countywide integrated
waste management plan prepared pursuant to this chapter. The fees shall be based on the types
or amounts of solid waste, and shall be used to pay the actual costs incurred by the city or county
in preparing, adopting, and implementing the plan, as well as in setting and collecting the local
fees. In determining the amounts of the fees, a city or county shall include only those costs
directly related to the preparation, adoption and implementation of the plan and the setting and
collection of the local fees. A city, county, or city and county shall impose the fees pursuant to
Section 66016 of the Government Code."
Public Resources Code 41902: "A local agency may directly collect the fees authorized by this
chapter or may, by agreement, arrange for the fees to be collected by a solid waste hauler
providing solid waste collection for the city or county. "
Events have occurred which have placed substantial strain on the City of Chula Vista's AB 939 funds.
First, State grants no longer allow for Household Hazardous Waste (HHW) disposal costs to be paid for
with State grant funds. The State grants had been covering up to $100,000 in disposal costs at the City's

Household Hazardous Waste Drop-off Facility located at the Public Works Yard, 1800 Maxwell Road,
Chula Vista, 91911.
Then in February 2006, the temporary disposal exemption for residentially generated waste batteries,
fluorescent lamps, and small electronic devices reached its sunset. These items have been identified as
toxic and are banned from disposal in municipal solid waste landfills. They must be specially handled
through collection events, recycling centers and/or at the Household Hazardous Waste Drop-off Facilities.
The disposal/operating costs at the HHW drop-off facility increased 100% as a result of the increased
traffic and corresponding HHW disposal volumes from this change in the law. The Household Hazardous
Waste Program, which is just one (I) of forty-seven (47) programs the Environmental Services Division
of the General Services Department oversees, now requires approximately $240,000 annually.
Finally, the mandated landfill diversion goal of 50% was not met for 2005.
Chula Vista diverted between 46-48% of the waste from the landfill for this
time period. This number has been in steady decline from the high of 54%
in 2001. After discussions with California Integrated Waste Management
Board (CIWMB), Chula Vista staff identified several waste
reduction/diversion and recycling program components, which need to be
implemented, including a Construction and Demolition Debris Recycling
Ordinance. As a result of these discussions with the Waste Board, Chula
Vista has so far been granted a good faith effort "pass" for not achieving 50% in 2005. This pass will last
only as long as we continue to implement and update our waste reduction and diversion plans/programs.
To not do so could subject the City to penalties and fines of up to $10,000 day.

Staff is requesting the fee increase as described above. If not, then the alternative would be to request an
appropriation of $450,000 from the General Fund to the General Services - Environmental Services
budget to fund the State Mandated Waste Diversion and Recycling Programs.
ENVIRONMENTAL REVIEW
The Environmental Review Coordinator has reviewed the proposed activity for compliance with the
California Environmental Quality Act (CEQA) and has determined that there is no possibility that the
activity may have a significant effect on the environment; therefore, pursuant to Section 1506I(b)(3) of
the State CEQA Guidelines the activity is not subject to CEQA. Thus, no environmental review is
necessary.
RECOMMENDATION
Council adopt the resolution to increase the AB 939 fee from 2.5% to 5% in order to fully fund the State
mandated waste diversion and recycling programs as provided for under AB 939, the Waste Management
Act.

DISCUSSION
The City of Chula Vista first implemented the AB 939 fee in fiscal year 1994-95 as 1% of the gross
receipts collected by the franchise hauler and forwarded to the City on a monthly basis. The AB 939 fee is
equitably distributed across commercial, industrial and residential customers, based on their level of
service, This fee was implemented knowing that as recycling program needs developed, adjustments

could be made. Additionally, staff anticipated supplementing these funds with State and local grant funds
as they were available.
In fiscal year 1998-99 the fee was increased from 1% to 2% to fund Household Hazardous Waste
components of the City's AB 939 plan. San Diego County lost the revenue source it used to support
Regional HHW Programs for all County residents when they sold the landfills to a private company. This
placed more of the funding burden on the local jurisdictions.
In 2003 the City increased the AB 939 fee by one-half percent (up to 2.5%) as a response to regulation
changes that banned Cathode Ray Tubes (CRTs) such as televisions and computer monitors from landfill
disposal, as they had been deemed hazardous. The funding increase also went to cover other AB 939
program enhancements such as commercial and industrial recycling and Space Allocation Ordinance
development, implementation and administration, ensuring that adequate recycling and solid waste
collection and storage space is designated in new projects and/or remodel projects, both public and
private.
Once again events have occurred which have placed more program funding burdens on the local
jurisdictions requiring an increase in funding either from the General Fund or increased AB 939 fee: loss
of grant funding; banning of specific items from landfills; not achieving the State mandated 50% landfill
diversion goal for 2005.
Chula Vista's AB 939 fee is collected on the gross receipts for waste services by the Contracted Hauler
and forwarded to the City monthly. The fee is equitably distributed across commercial, industrial and
residential customers, based upon their level of service. It is a pass-through fee, meaning the Contractor
only collects the fee on behalf of the City and does not receive any portion or percentage of these fees.
For fiscal year 2006-07, the 2.5% AB 939 fee generated approximately $450,000. These funds are
supplemented with various grant funds from the California Integrated Waste Management Board and the
California Department of Conservation - Division of Recycling for AB 939 program specific work tasks
(Used Motor Oil and Filter Recycling, Bottle and Can Recycling, Anti-litter Program, etc.).
An AB 939 fee increase from 2.5% to 5% will generate an additional approximate amount of $450,000,
totaling $900,000 annually and would equate to the following on a monthly invoice:
. 32 gal cart = an increase from $.27 to $.56 per month
. 64 gal cart = an increase from $.35 to $.72 per month
. 96 gal cart = an increase from $.42 to $.85 per month
. 3 cubic yd commercial bin, serviced I time per week = an increase from $1.97 to $4.03 per month
The funding received from the proposed increase would be used to:
. Offset the current funding short fall in the Household Hazardous Waste Program
. Open the HHW facility one additional day during the week (as needed to meet the volume

The City Attorney's office has reviewed this proposed rate increase in light of Proposition 218 and has
determined that refuse service rates have been specifically exempted from the voter approval
requirements. Instead, these fees are subject to the majority protest requirement that includes a written
notice to the recorded property owner of each parcel and a public hearing at least 45 days after the notice
is mailed. The public notice included the amount of the proposed fee, the basis for the calculation, the
reason for the fee, and the time, date and location of the public hearing. The fees cannot exceed the funds
required to provide the service; shall not be used for any purpose other than that for which the fee is
imposed; shall not exceed the proportional cost of the service attributable to the property; and the fee
must be for service that is actually used by or immediately available to the property owner. If approved,
the fee adjustment would take place at the annual rate adjustment date for the respective customer service
segments: Large Quantity Generators (commercial and industrial services) would go into effect
retroactive to July I, 2007; Small Quantity Generators (residential cart services) would go into effect
September I, 2007.
DECISION MAKER CONFLICT
Staff has reviewed the decision contemplated by this action and has determined that it is not site specific
and consequently the 500 foot rule found in Califomia Code of Regulations section 18704.2(a)(I) is not
applicable to this decision.
FISCAL IMP ACT
The fee increase would potentially generate $450,000 in additional revenue, which would be used to
offset increased program costs thus reducing the impact to the General Fund.

for the respective customer service segments: large Quantity Generators (commercial and industrial
services) would go into effect July 1, 2007; Small Quantity Generators (residential cart services) would
go into effect September 1, 2007. This is a one-time fee adjustment, not an annual fee adjustment.
EXPLANATION OF ANNUAL ADJUSTMENT
FOR SOLID WASTE GENERAL SERVICE RATES
General Service Rates for solid waste, recycling, yard waste and disposal are established annually. A
private contractor (Contractor) with an exclusive franchise agreement (Agreement) provides these
services in the City of Chula Vista. Under the terms and conditions of the Agreement, the Contractor
undertakes and agrees to collect, transfer, transport, recycle, process and dispose of all recyclables,
yard waste, and solid waste which is generated and placed for collection by or upon all property located
within Chula Vista.
Per the Amended and Restated Recycling and Solid Waste Franchise Agreement, the Contractor is
entitled to an annual rate increase for General Service Rates within the following prescribed terms and
conditions. The City Manager or designee reviews the rates for compliance with these terms.
. The annual adjustment amount for General Service Rates does not exceed sixty-six and two-thirds
percent (66.66%) of the increase in the San Diego Area Consumer Price Index (CPl) for all Urban
Consumers (all items) published by the U.S. Department of Labor, Bureau of Labor Statistics for
the previous twelve-month period (calendar year) for which statistics are available.
CPI X 66.66% :: % of rate adjustment
. Notwithstanding the foregoing, at no time shall the Small Quantity Generator Rates (SQG _ cart
service) exceed ninety percent (90%) of the average for the County of San Diego for the same level
of service - approximately 60-gaJlon cart rate or standard service rate after subtracting any pass-
through fees or local subsidies. This limitation is to be applied only to d~termine whether the
Contractor is entitled to the full CPI adjustment on SQG rates, as described above.
Mean County Average X 90% = Maximum rate for SQG
Rate adjustments are effective July 1, for large Quantity Generators (commercial and industrial bin
service customers) and September 1, for all Small Quantity Generators (cart service customers), annually.

OF CHULA VISTA TO ADOPT THE AB 939 FEE
INCREASE FROM 2.5 PERCENT TO 5 PERCENT,
APPLIED TO THE SOLID WASTE SERVICE RATES,
TO FULLY FUND THE STATE MANDATED WASTE
DIVERSION AND RECYCLING PROGRAMS AS
PROVIDED FOR UNDER THE WASTE
MANAGEMENT ACT (AB 939)
WHEREAS, the Waste Management Act of 1989 (AB 939) authorized cities and counties
to establish a fee to pay for the cost of developing and implementing the programs designed to
meet the state mandate to divert a minimum of 50 percent of their annual waste from landfills;
and
WHEREAS, the City established a one percent fee in 1994-1995 fiscal year, and in 1998-
1999 increased that fee to two percent, to cover household hazardous waste programs when the
County sold the landfills and stopped providing regional household hazardous waste services;
and
WHEREAS, the City increased the fee from two percent (2%) to two and one-half
percent (2.5%) in 2003 to cover the special handling and disposal of televisions and computer
monitors that had been deemed hazardous and banned from landfills; and
WHEREAS, State grant funds will no longer cover household hazardous waste costs in
municipal household hazardous waste programs; and
WHEREAS, waste batteries, fluorescent lamps, and small electronic devices were
deemed toxic and banned from landfill disposal in February 2006, which increased resident
traffic at Chula Vista's Household Hazardous Waste Facility; and
WHEREAS, Chula Vista has not met the 50 percent mandated landfill diversion goal for
2005 and must work to implement new programs and program enhancements to regain the
50 percent mandated diversion goal, including a construction and demolition debris recycling
ordinance.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula
Vista does hereby authorize a two and one-half percent (2.5%) increase in the AB 939 fee to five
percent (5%), applied to the solid waste rates, to fund recycling, solid waste and household
hazardous waste recycling and education programs.

BACKGROUND
The City of Chula Vista has had a franchise agreement for solid waste and recycling services in place for
eight years. Per the terms and conditions of that agreement the contractor is entitled to an annual rate
adjustment. Thus, the issues of whether a rate adjustment is appropriate and if so, how much the
adjustment should be are not negotiable at this time. The adjustment formula has some very specific
limiting factors, which ensure that the ratepayers of Chula Vista will continue to have some of the lowest
rates for service in San Diego County.
However, due to a recent California Supreme Court ruling on Proposition 218 (July 24,2006, Bighorn-
Desert View Water Agency v. Beringson) refuse collection rates, when set by a government agency are
subject to the majority protest regulations within California Constitution, Article XIII D, Section 6. The
City Attorney's office has reviewed this proposed rate adjustment in light of Proposition 218
requirements and determined that refuse service rates are subject to the majority protest requirement that
includes a written notice to the recorded property owner of each parcel and a public hearing at least 45
days after the notice is mailed. Therefore, staff prepared the public notice which included the maximum
amount of the proposed fee, the basis for the calculation, the reason for the fee, and the time, date and
location of the public hearing. The fees cannot exceed the funds required to provide the service; shall not
be used for any purpose other than that for which the fee is imposed; shall not exceed the proportional
cost of the service attributable to the property; and the fee must be for service that is actually used by or
immediately available to the property owner.

On May 25, 2007 public notice was sent to all property owners of record in the City of Chula Vista
outlining the process for annual rate adjustments for General Service Rates for solid waste services as
defined in the Amended and Restated Solid Waste and Recycling Franchise Agreement. A copy of the
public notice has been included with this package.
ENVIRONMENTAL REVIEW
The Environmental Review Coordinator has reviewed the proposed activity for compliance with the
California Environmental Quality Act (CEQA) and has determined that there is no possibility that the
activity may have a significant effect on the environment; therefore, pursuant to Section 15061(b)(3) of
the State CEQA Guidelines the activity is not subject to CEQA. Thus, no environmental review is
necessary.
RECOMMENDATION
Conduct the public hearing and adopt the resolution accepting the rate adjustment calculation for 2007-08
and subsequent rate adjustments per the terms and conditions of the Amended and Restated Recycling
and Solid Waste Franchise Agreement and Proposition 218 requirements.

to an annual rate increase for General Service Rates within the following prescribed terms and conditions.

level of service - approximately 60 gallon cart rate or standard service rate after subtracting any
pass-through fees or local subsidies. This limitation is to be applied only to determine whether
the Contractor is entitled to the full CPI adjustment on SQG rates, as described above. (Staff is
currently working through the rate survey comparison for 2007-08 and will ensure that the SQG
rates will comply with this limiting factor.)

Rate adjustments are effective annually on July I for Large Quantity Generators (commercial and
industrial bin service) and September I for all Small Quantity Generators (cart service customers). The
acceptance of this rate adjustment formula will be for the current fiscal year and subsequent rate
adjustments subject to the same terms and conditions as described above and in the Amended and
Restated Recycling and Solid Waste Franchise Agreement for the duration of the Agreement. Subsequent
rate adjustments do not require Council action and will be brought forward as information items.

Staff has reviewed the decision contemplated by this action and has determined that it is not site specific
and consequently the 500 foot rule found in Califomia Code of Regulations section I 8704.2(a)(I) is not

FISCAL IMPACT
Acceptance of this rate adjustment and subsequent adjustments per the terms and conditions of the

EXPLANATION OF PROPOSED AB 939 FEE INCREASE
AS 939, known as the Waste Management Act of 1989, is a State law that requires cities and counties
to divert 50% of the waste going to the landfills. AS 939 was an unfunded State mandate, which
provided for jurisdictions to charge for the costs to develop, implement and administer programs and
services required to meet this goal.
Chula Vista's AS 939 fee is collected on the gross receipts for solid waste services by the contracted
hauler and forwarded to the City monthly. The fee is equitably distributed across commercial, industrial
and residential customers, based upon their level of trash service. An AS 939 fee increase from 2.5%
to 5% will generate an additional approximate amount of $450,000, totaling $900,000 annually and
would equate to the following on a monthly invoice;
. 32 gal cart =: an increase from $.27 to $.56 per month
. 64 gal cart =: an increase from $.35 to $.72 per month
. 96 gal cart =: an increase from $.42 to $.85 per month

$4.03 per month

AS 939 fees cannot exceed the funds required to provide the service; shall not be used for any purpose

go into effect September 1, 2007. This is a one-time fee adjustment, not an annual fee adjustment.
EXPLANATION OF ANNUAL ADJUSTMENT
FOR SOLID WASTE GENERAL SERVICE RATES
General Service Rates for solid waste, recycling, yard waste and disposal are established annually. A
private contractor (Contractor) with an exclusive franchise agreement (Agreement) provides these
services in the City of Chula Vista. Under the terms and conditions of the Asreement, the Contractor
undertakes and ag~ees to coll~ct, .transfer, transport, recycle, process and dispose of all recyclables,
yard waste, and solid waste whICh IS generated and placed for collection by or upon all property located
within Chula Vista.
Per the Amended and Restated Recycling and Solid Waste Franchise Agreement, the Contractor is
entitled to an annual rate increase for General Service Rates within the folfowing prescribed terms and
conditions. The City Manager or designee reviews the rates for compliance with these terms.
. The annual adjustment amount for General Service Rates does not exceed sixty-six and two-thirds
percent (66.66%) of the increase in the San Diego Area Consumer Price Index (CPI) for all Urban
Consumers (all items) published by the U.S. Department of Labor, Bureau of labor Statistics for
the previous twelve-month period (calendar year) for which statistics are available.

. Notwithstanding the foregoing, at no time shall the Small Quantity Generator Rates (SQG _ cart
service) exceed ninety percent (90%) of the average for the County of San Diego for the same level
of service - approximately 60-gallon cart rate or standard service rate after subtracting any pass-
through fees or local subsidies. This limitation is to be applied only to determine whether the
Contractor is entitled to the full CPI adjustment on SQG rates, as described above.

Rate adjustments are effective July 1, for large Quantity Generators (commercial and industrial bin
service customers) and September 1, for all Small Quantity Generators (cart service customers), annually.
This mailing serves as notice for the proposed increase for 2007-08 and for subsequent annual rate
increases in the manner described above and in the Agreement with the Contractor for the duration
of the Agreement.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA ACCEPTING AND AUTHORIZING THE
SOLID WASTE SERVICE RATE ADJUSTMENT FOR 2007-
2008 AND SUBSEQUENT RATE ADJUSTMENTS FOR THE
TERM OF THE AMENDED AND REST A TED RECYCLING
AND SOLID WASTE FRANCHISE AGREEMENT
WHEREAS, the City of Chula Vista entered into a franchise agreement [Agreement] for
Solid Waste Services with Allied Waste Services (formally Pacific Waste Services) in July 1999;
and
WHEREAS, the Agreement contains specific language and formulas for calculating
annual rate adjustments, which includes limitations that ensure the Chula Vista ratepayers will
continue to have some of the lowest rates for service in San Diego County; and
WHEREAS, the California Constitution, Article XIII D, Section 6 (Proposition 218)
requires a public hearing and property owner notification which includes: the maximum amount
of the fee, the basis for the calculation, the reason for the fee and that the fee be only for the cost
of service and used only for the purpose for which it is collected; and
WHEREAS, the City Council has conducted the public hearing per State regulations.
NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Chula
Vista does hereby accept and authorize the rate adjustment calculation for 2007-2008 and
subsequent rate adjustments per the terms and conditions of the Amended and Restated
Recycling and Solid Waste Franchise Agreement.
