On September 8, 1992, the San Marcos City Council approved a Conditional Use
Permit for expansion of the San Marcos Landfill. Council was informed last week
by an information report (attached) that the final permit required to allow the
expansion to move forward will be requested from CIWMB first through a Board
subcommittee meeting in Orange County on September 21st and ultimately at their
full Board meeting in Fresno on September 23, 1992. CIWMB staff has also
recently stated that this permit request may be rescheduled to a special meeting
of the full Board in Sacramento on September 30, 1992 instead of being heard in
Fresno on the 23rd.
Elected official representation is being requested by the County. A charter bus
is being arranged for the Orange County (subcommittee) meeting. Regarding
attendance at the full Board meeting in Fresno or Sacramento, the County will pay
travel costs. Attendance at the full Board meeting would require a commitment
of at least one day and possibly the evening before for travel.
RECOMMENDATION: That Council designate one member to represent the Chula Vista
City Council at least at the full Board meeting in Fresno (or Sacramento), and
to work with City staff regarding the arrangements. If Council desires and
schedules permit, a representative may also be designated for the subcommittee
meeting in Orange County.

San Marcos Landfill Expansion - Conditional Use Permit
This is a status report regarding the County's request for a modified conditional use
permit (CUP) for expansion of the San Marcos landfill which will be considered by the
San Marcos City Council at the meeting of Tuesday. September 8. 1992. Attachment
A is a copy of the County Board of Supervisors staff report to be heard and acted
upon by the Board in advance of the San Marcos City Council meeting that day. This
report outlines the conditions stated by San Marcos for approval of the CUP, as well
as the County's responses regarding ability to meet and agree to those conditions.

Attachment B is a copy of a support letter to the Board of Supervisors regarding the
expansion CUP application. That letter was filed by the four north county cities
(Carlsbad. Encinitas, Escondido and Oceanside) which had filed lawsuits in the past
against the City of San Marcos on the previously-issued CUP. That letter represents
the position of the four cities and their support of the permit issuance and the landfill
expansion.
Finally, Attachment C is a draft letter proposed by Chula Vista staff for the Mayor's
signature to be sent to the San Marcos City Council urging approval of the permit and
expansion. The timing of positive action by the San Marcos City Council is critical
and approval is in the City's best interest. Staff intends to work with the Mayor to
ensure that a support letter conveying the Council's previously expressed concerns
and urging support be received in time for the September 8th meeting. In addition.
Individual Council members may wish to urge San Marcos City Council members to
support the expansion.
The Next Steo
If the conditional use permit is approved by San Marcos, the next (and final) permit
is required from the California Integrated Waste Management Board (CIWMB). There
will be a CIWMB subcommittee recommendation on the permit at a meeting in Orange
County either September 21.t or 22nd. That recommendation will then be taken to the
full Board at a meeting in Fresno on September 23. 1992. The County is requesting
attendance by a regional representation of elected officials and will pay travel costs.
Details of the time and travel commitment will be determined within the next week,
and County staff is asking for a commitment from the cities at that time. Staff would
strongly urge Council to take appropriate action to ensure attendance by one member
of the Chula Vista City Council and will be available to assist with arrangements.
