HomeMy WebLinkAboutReso 1982-10865 RESOLUTION NO. 10865 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING CONDITIONAL USE PERMIT PCC-82-15 TO ESTABLISH A WAREHOUSE FACILITY FOR PRODUCE AT NORTH FOURTH AND FUTURE BRISBANE IN I-L ZONE - BIG BEAR MARKETS The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, on April 27, 1982, the City Council unanimously approved an amendment to the General Plan designating 6 acres of land between North Fourth and North Glover Avenues from Retail Commercial to Research and Limited Industrial, and WHEREAS, the City Council requested at that time that the conditional use permit be brought to them for review of the site plan, and WHEREAS, an application for a conditional use permit was filed with the Planning Department by Big Bear Markets requesting permission to construct and operate a distribution and warehouse facility for produce on approximately 5.2 acres located between North Fourth Avenue and North Glover at Brisbane Street in the I-L zone, and WHEREAS, the Planning Commission, at their meeting of April 28, 1982, considered said conditional use permit and granted approval subject to the conditions contained in Resolution No. PCC-82-15, and WHEREAS, in accordance with the attached Negative Declaration, IS-82-7 together with the mitigating measures, the proposed conditional use permit will not have a signifiCant impact upon the environment and the City Council hereby certifies that the Negative Declaration was prepared in accordance with the California Environmental Quality Act of 1970, as amended. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby approve Conditional Use Permit PCC-82-15 to establish a warehouse facility for produce at North Fourth and future Brisbane Street in the I-L zone subject to the conditions set forth in Planning Commission Resolution No. PCC-82-15 adopted on the 28th day of April, 1982. Project Setting The project consists of a 6.1 acre vacant parcel of land, bound on the south by the Department of Motor Vehicles, on the west by existing retail commercial uses, on the north by light industrial uses, and on the east by a mobile home park and North Glover Avenue. The project site is relatively level, previously developed, and presently within the backwater area of the Sweetwater River 100-year flood plain. There is no significant vegetation on the project site and there are no known earth- quake faults in the project vicinity. The project site presently has frontage on North Glover Street and will have frontage on a future street (Brisbane Street) upon development of this site. B. Project Descrirtion The project consists of the construction of a 37,500 sq. ft. produce distribution warehouse in addition to a 4,800 sq. ft. maintenance support building. The proposed warehouse facility would be located in the southeast portion of the site with loading doors faci ng north and \;est. The structure is 52 feet from North Glover Avenue and access to the site will be from the proposed Brisbane Street and North Glover Avenue. A total of 37 parking spaces have been provided on site for employees. Approximately 25,000 cubic yards of fill dirt will be imported to raise the proposed site approximately 4 to 6 feet in elevation. Finished floor height for the 20 foot high warehouse structure will be approximately 4 feet higher than surrounding pavement 1 evel s. A detailed description of the project, including hours of operation and the types of vehicles utilized, is attached (see Exhibit A). C. Compatibility with zoning and plans Previously discussed in IS-82-22 was the proposed General Plan Amendment and rezoning of the property to a Limited Industrial designation and I-L zoning. Geology The potential for liquefaction occurring on the project site and the presence of expansive soils has been pointed out by the Engineering Department. To assure stable construction, a soils report shall be prepared by a qualified engineer and subsequent recommendations implemented. 2. Noise (mobile and stationary) A potential noise problem will exist with development of the proposed distri- bution center. An existing mobile home park is the critical noise receptor and is located 100 feet to the east of the proposed warehouse structure. Orientation of the structure is such that noise impacts on the mobile home park will be minimized through mitigation recommended in 15-82-22 (North Glover General Plan Amendment and rezoning) and recommendations included in the attached acoustical analysis (R. W. Young, 1972). 3. Drainage Localized drainage, which currently runs from east to west, crosses under North Glover Avenue (two 14"x25" pipes) at the northeast corner of this site, is absorbed on the project site. A concrete drainage swale exists on North Glover Avenue north of the project site, and currently collects runoff from streets to the north where it terminates at the project boundary. This drainage will be picked up on required street improvements with the proposed project. The developer proposes raising the entire project site above the lOa-year Sweet- water River flood plain, but in doing so existing east to west drainage cannot enter the site. The developer should prepare a drainage study which assures that all localized drainage impacts will be mitigated to the satisfaction of the City Engineer. D. Mitigation necessary to avoid significant effects 1. The screen wall at the northerly end of the warehouse structure will be 18 feet high as recommended in the acoustical analysis (R. W. Young, 1972). 2. Trucks shall be prohibited from utilizing North Glover Avenue for ingress or egress. 3. A drainage study shall be prepared which addresses all localized drainage impacts to the satisfaction of the City Engineer. The study will be required prior to building permit approval. The following mitigation measures are standard engineering requirements: 4. All structures shall be located above the lOa-year flood plain or be floodproofed in accordance with the requirements of Chapter 18.54 of the C~ula Vista Municipal Code (nood Plain Regulations). 5. A soils report shall be prepared by a qulaified soils engineer prior to development of the property. ~~~ 15-82-27 -3- E. Findinqs of insiqnificant impact 1. The site is presently vacant and void of any significant wildlife and there are no significant natural or manmade resources known to be present in the project vicinity. 2. The proposed produce distribution center is in basic conformance with the General Plan and associated elements. A Conditional Use Permit will be required prior to its development. 3. No short term environmental goals will be gained to the disadvantage of long term environmental goals. 4. Proposed mitigation will assure that the project does not have possible environmental impacts which are individually limited but cumulatively considerable. 5. Proposed mitigation will assure that the project will not cause any sub- stantial adverse effects on human beings, either directly or indirectly. F. Cons ulta ti on 1.
