HomeMy WebLinkAboutReso 1982-10813 RESOLUTION NO. 10813 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA CALLING AN ADVISORY ELECTION FOR THE ESTABLISH- MENT OF THE MONTGOMERY COMMUNITY PLANNING COMMITTEE AND REQUESTING CONSOLIDATION WITH THE DIRECT PRIMARY ELECTION AND RESCINDING RESOLUTION NO. 10804 The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the question of the annexation of territory within the Montgomery Fire Protection District to the City of Chula Vista is on the ballot for the June 8, 1982 election; and WHEREAS, the City of Chula Vista desires expression of voter approval or disapproval of the establishment of a community planning committee in the territory of the Montgomery Fire Protection District if the Montgomery reorganization territory is annexed to the City of Chula. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista as follows: 1. An advisory election is hereby called to be held within the territory of the Montgomery Fire Protection District on Tuesday, June 8, 1982 for the purpose of submitting to the qualified electors within that territory the following advisory question: ADVISORY VOTE ONLY Shall there be established a community planning committee to be known as the Montgomery Community Planning Committee in the Montgomery reorganization territory upon annexation to the City of Chula Vista? YE<; NO 2. Pursuant to Part 2.5 (commencing at Section 23300), Division 14 of the Elections Code, the City Council of the City of Chula Vista hereby requests the Board of Supervisors of the County of San Diego to order the advisory election consolidated with the direct primary election to be held on the same date, to-wit: Tuesday, June 8, 1982. The exact form of the advisory question to be voted upon at such election is set forth above. 3. The Board of Supervisors of the County of San Diego is hereby requested to authorize and direct the Registrar of Voters of the County of San Diego to perform services necessary to conduct this advisory election. 4. If the Board of Supervisors directs the Registrar of Voters to perform all services necessary to conduct the advisory election, the Registrar of Voters shall publish a notice of election, no later than fifty (50) days before June 8, 1982 in a newspaper of general circulation once within the territory of the Montgomery Fire Protection District, containing a statement of the date of the election, the purpose of the election, and the hours the polls are to be open. -1- 5. If the Board of Supervisors directs the Registrar of Voters to perform all services necessary to conduct the advisory election, the Registrar of Voters shall publish a synopsis of the measure in the City as well as within the territory of the Montgomery Fire Protection District once a week for two successive weeks, consolidated with the notice of election provided for in Paragraph 4 herein. 6. The City of Chula agrees to indemnify and hold harmless the County, its officers, agents, and employees from expense or liability, including reasonable attorneys' fees as the result of an election contest arising after conduct of this advisory election. 7. prepare and analysis of The City Attorney of the City of Chula Vista shall transmit to the Registrar of Voters an impartial the advisory measure. 8. Arguments for and against the advisory measure shall be submitted in accordance with Article 4 (commencing with Section 5010) of Chapter 3, Division 5, of the Elections Code. 9. The City Clerk shall forthwith cause a certified copy of this resolution to be forwarded to the Board of Supervisors of the County of San Diego and to the Registrar of Voters of the County of San Diego. 10.
