VISTA, APPROVING AGREEMENT BETWEEN THE CITY OF CHULA
VISTA AND CITY OF NATIONAL CITY AND TilE LOHER SlvEETWATER
FIRE PROTECTION DISTRICT
AND AUTHORIZING TilE MAYOR TO EXECUTE SAID AGREEMENT
The City Council of the City of Chula Vista does hereby
resolve as follows:
NOW, THEREFORE, BE IT RESOLVED that that certain agr~ement
between THE CITY OF CHULA VISTA, a municipal corporation, and
City of National City and the Lower Sweetwater Fire Protection District

THIS AGREEMENT is entered into this 23rd day of February , 1982
by and between THE CITY OF CHULA VISTA, THE CITY OF NATIONAL CITY and THE LOWER SWEET-
WATER fIRE PROTECTION DISTRICT:

WHEREAS, the Lower Sweetwater Fire Protection District was organized to provide
fire protection through the use of a skeleton force of professional firefighters sup-
ported by volunteers, and
WHEREAS, District presently maintains property and equipment to provide fire pro-
tection and emergency medical service and employs personnel to provide such services
in the area shown on Exhibit "A", and
WHEREAS, the Cities of National City and Chula Vista surround the District terri-
tory and ma i ntai n professional fi re protection and emergency medi ca 1 servi cewi thi n
their respective cities, and
WHEREAS, due to the limitations of Proposition 13 and the continuing reduction in
the size of the District, it is rewgnized that sometime in the future the fire Protec-
tion District will have'to consider dissolution and its responsibilities assumed by other
government agency oragenci es, and
WHEREAS, 'the Board of Directors for Lo~er Sweetwater Fire Protection District
desire-to -ensure that ,their constituents receive-the hig~estlevel of fire and emergency
medical services'possible during the interim period while continued efforts are made to
provide for long-term fire protection, and
WHEREAS, the Cities of National City and Chula Vista are willing to provide interim
fire protection and emergency medical service to the District area pending final res(11u-
tion of the dissolution question and possible annexation of that area in an acceptable
manner to the two cities, and ,'--
WHEREAS, the Cities of National City' and Chula Vista consider the Sweetwater River
as the approximate division of the area served by the Fire Protection District 6S shown
on Exhibit "A" for the purpose -of future annexation possibilities as well as providing
interim fire protection service to the area, and

NOWi'THEREFORE~ ,IT' IS',MUTUALLY AGREED BY AND BETWEEN THE PARTIES HERETO 'AS fOLLOWS:
1. GENERAL CONDITIONS. The Cities agree to provide fire protection and emergency
medical service to the area presently known as the lower Sweetwater fire Protection Distric'
2. TERM. This agreement will commence on the date a National City
Fire Department Engine Company occupies the District's station after
necessary structural revisions are completed. Revisions are anticipated to
be accomplished by March 1, 1982 or sooner. This agreement will continue in
full force and effect until January 1, 1984 or until such time as District
may be dissolved or unless terminated prior thereto as provided herein.
3. TERMINATION. This agreement may be terminated by any of the parties hereto
upon delivery of a written notice of intent to te~inate from the initiating governing

months from the receipt of notice or at such other date as may be mutually agreed upon
by the parties. '
4. DISTRICT PROPERTY AND EQUIPMENT. The District will continue to own! maintain,
and have complete control of its equipment and property during the te:m of t~ls agreement;
provided, however, District may loan said equipment and property to elth~r Clty unde~
terms and conditions that may be agreed upon and, further, that should Dlstrict be dlS-
solved before January 1, 1984, said equipment and property shall be disposed of in the
manner as prescribed by State law.

~ DISTRICT PERSONNEL. All District fire suppression personnel will, upon the
effectIve date of this agreement, be treated as employees of the respective Fire Depart-
ments,of the Cities as provid,;d herein in Exhibit "B", and shall perform for the duration
of thIs agreement under the dIrection of the respective Fire Departments of the Cities
District personnel will preserve any accumulated vacation sick leave or other benefit~
and will accrue vacation, sick leave and other benefits f~om the effective date of this
agreement as provided by the Memoranda of Understanding existing between the respective
Cities and their firefighters.
District.pers?nnel, ~uring the term of this agreement, shall be considered employees
of the :espectlv~ cltY's.flre department, provided however if this agreement is terminated
as provIded hereIn the CIties may, but are not required to, retain said District personnel.
If, during the term of this agreement, the District is dissolved and said area is
~nnexed to ~he.respective cities, it is agreed that said District personnel will be
Integrated Into th,; :espect~ve departm~nts at the existing city's salaries and ranks as
employees of the cItIes durIng the perIod that contractual protection is furnished. All
prior service and benefits accrued prior to and during the contractual period shall be
retained by District personnel.
6. PAYMENTS. The District will make payments to the cities quarterly
on the first working day of January, April, July, and October. Each payment
shall be in advance for the succeeding quarter. The first payment date will
be the beginning of each "year period". Upon the execution of this agreement,
District shall make a pro rata payment to the Cities for the period from the
effective date of this agreement to the first payment date. The amount due
to the cities for the first year period shall be as shown on Exhibit "C".
Payment to the cities will be based on actual operational costs incurred by
the cities. Adjustment of costs will be made on an annual basis. Actual
costs will be reviewed with the District on a quarterly basis. Estimated amount
due the cities for future year periods of this agreement shall be a sum to be
negotiated upon the request of either party prior to the commencement of the
year period. The District agrees to payoff its obligation of approximately
$64,000 which is the balance owed to P~blic Employees Retirement System (PERS)
on behalf of the three full time paid employees of the department. Said sums
shall be adjusted to reflect then existing circumstances. Cities of National
City and Chula vista will be responsible for determining the appropriate
division of the total annual sum for their administrative services.
7. SERVICE.. The City of National City will ass!gn and.maintai~ an ,;ngine ~ompany.
at the District's station located at 2711 Granger, Nat10nal C1ty, Callfo:nla. ~h1s com-
pany will remain stationed there until the completion of the ~ity of.Natlona~ C1t~'S
new station in the area of Euclid Avenue and 24th Street, NatIonal C1ty, Callforn1a, at
which time the company will be reassigned to the Euclid Avenue station.

training of personnel.

8. IMPLEMENTATION. The cities and District shall exercise their best.ef!orts
to implement the terms and conditions of this agreement; provided, how,;ver, 1t.1S t~e
understanding of both ci~ies and the District.that thi~ agreeme~t p:ov~des an ~nter1m
solution for providing fIre and emergency medIcal servIces to DIstrIct s constItuents
and an ongoing effort will be made to dissolve the Distr1~t and incorporate said area
into the corporate boundaries of Chula Vista and National City.

Dear- Ha?,ors 1-lorgan and Hyde:
This is to inform you of the Lower Sweetwater Fire District's wi~~ingnes
to begin discussions with your cities to provide contractural fire
protection services to our area. Specifically, we would anticipate
National City's using our Granger Avenue fire station to serve Lincoln
Acres and the eastern portion of your City; and a separate agreement
with Chula Vista to serve the Shirley Street area (see attached map).
We recognize the agreements will have to address a number of difficult
issues and have requested the County of San Diego, through Supervisor
Hamilton's office, to provide any technical assistance in drawing up
the contractural_arrangements.
