RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA WAIVING PROCEDURAL REQUIREMENTS OF SECTION
2.56.230 OF THE CHULA VISTA MUNICIPAL CODE AND
ACCEPTING THE BID OF $54,500 FOR CERTAIN SURPLUS
PROPERTY LOCATED AT THE NORTHWEST CORNER OF PALOMAR
STREET AND 1-5 AND AUTHORIZING THE MAYOR TO EXECUTE
THE GRANT DEED THEREFOR
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, pursuant to the provisions of Section 2.56.170,
the City Manager recommends that due to special circumstances,
i.e., the subject property being a surplus piece of property
located at the northwest corner of Palomar Street and 1-5 which
has no access and may not be independently developed without
taking such access across the adjacent property and further is of
such a shape and configuration as to be exceedingly difficult for
any independent development, it is, therefore, to the City's best
interest to sell such real property without compliance with the
bidding procedure in Section 2.56.230 of the Chula Vista Municipal
Code, and
WHEREAS, the adjacent property owner has offered the sum
of $54,500 for the purchase of said property, which property would
be incorporated into the overall development program of the
properties by Inland Industries.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista hereby finds that in accordance with the
special circumstances, i.e., the subject property being a surplus
piece of property located at the northwest corner of Palomar
Street and 1-5 which has no access and may not be independently
developed without taking such access across the adjacent property
and further is of such a shape and configuration as to be
exceedingly difficult for any independent development, it is,
therefore, to the City's best interest to sell such real property
without compliance with the bidding procedure in Section 2.56.230
of the Chula Vista Municipal Code.
BE IT FURTHER RESOLVED that the City Council does hereby
accept the offer of $54,500 for the purchase of said surplus
property by Inland Industries.
BE IT FURTHER RESOLVED that the Mayor of the City of
Chula Vista be, and he is hereby authorized and directed to
execute the corporation grant deed conveying said property to
Inland Industries.
