RESOLUTION NO. 10767
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROVING TENTATIVE SUBDIVISION MAP FOR CHULA
VISTA TRACT 82-2, TELEGRAPH POINT
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, EIR-80-6A and the CEQA findings which are
supplemental to that EIR for the subject property has heretofore
been certified by the City Council, and
WHEREAS, the Planning Commission of the City of Chula
Vista has heretofore approved that certain tentative map of a
subdivision to be known as Chula Vista Tract 82-2, Telegraph Point
and has recommended that the City Council approve said tentative
map subject to the conditions in Planning Commission Resolution
No. PCS-82-2, adopted on the 13th day of January, 1982, a copy of
which is attached hereto and by this reference made a part hereof
the same as though fully set forth herein.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista does hereby approve said tentative
subdivision map in accordance with Planning Commission Resolution
No. PCM-82-2 with the following amendments approved by the City
Council:
A. TELEGRAPH POINT
1. As part of the grading plan for Telegraph Point an
erosion and siltation control plan will be required.
This plan will include details for planting of areas
subject to erosion and/or provision of other devices
to protect against erosion immediately upon
completion of grading work.
2. Telegraph Canyon Road improvements east of Otay
Lakes Road will be constructed in such a manner as
to drain continually to the west.
3. Energy dissipators in accordance with standard
criteria will be constructed at outlets of all
culverts emptying south of Telegraph Canyon Road.
They will angle downstream and be constructed in the
same manner as described in item B3. below.
B. CHARTER POINT
1. Soil apparently washed from Charter Point during
recent rains has been deposited in the main
Telegraph Canyon drainage channel. This material
will be removed by Pacific Scenes at the earliest
opportunity afforded by weather and permission by
United Enterprises to work within the United
Enerprises property.
2. The soil so deposited in the main Telegraph Canyon
drainage channel shall be moved to specified areas
of eros ion, compacted and treated wi th a Hydroseed
application and riprapped at the outlets of the
channel pursuant to the understanding entered into
between Pacific Scenes and United Enterprises.
United Enterprises has granted permission to do this

work. The work will be subject to review and
acceptance by the City of Chula Vista after its
completion in a workmanlike manner. It is further
understood and agreed that during the progress of
work, said work may be reviewed and observed by
United Enterprises engineering consultants and shall
be accepted by the City. However, no additional
work will be required of Pacific Scenes and it is
understood that the City of Chula Vista shall not
unreasonably withhold acceptance thereof.
3. Storm drain outlets will be constructed at angles of
45 or less from the alignment of the main channel.
An earth channel will be provided from each outlet
to the main channel along this angular alignment.
The channels from the outlets to the main channel
will be hydroseeded to ultimately provide
stabilization.
4. United Enterprises will grant a limited right of
entry to Pacific Scenes after the final map and
improvement plans of Charter Point have been given
to and reviewed by United Enterprises engineering
consultants. The right of entry shall be granted in
such a manner that United Enterprises does not waive
any right or remedy in the pending right of way
taking for Telegraph Canyon flood widening and/or
realignment, and United Enterprises shall not suffer
any prejudice by granting such limited right of
entry in the pending right of way taking.
c. TELEGRAPH CANYON ROAD WIDENING/REALIGNMENT
1. That a public hearing will be conducted on the
proposed widening/realignment work. This public
hearing is to include, in addition to a
determination of the necessity of taking
right-of-way, the improvements to be constructed.
Specified items of concern to United Enterprises
are:
a. Protection of existing structures from
accidental damage by vehicles traveling on
Telegraph Canyon Road.
b.
A protected entrance of the main ranch road from
Telegraph Canyon Road, and
c.
Adequate and safe driveway{s) from Telegraph
Canyon Road to existing ranch houses.

RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO
THE CITY COUNCIL THE APPROVAL OF THE TENTATIVE SUBDIVISION
MAP FOR CHULA VISTA TRACT 82-2, TELEX3RAPH POINT
WHEREAS, a tentative subdivision map for Chula vista Tract 82-2,
Telegraph point, was filed by pacific Scene, Inc., to subdivide 34.3 acres
located at the northeast quadrant of Telegraph canyon Road and Otay Lakes Road
into 14 lots to be developed with a condominium project consisting of 256
units, and
WHEREAS, a hearing was held at the same time and place, namely
7:00 p.m., January 13, 1982 in the Council Chambers, public services Building,
276 Fourth Avenue, before the Planning Commission and said hearing was
thereafter closed and
WHEREAS, an environmental impact report, EIR-80-6,
covering
development plans on the subject property was certified by the planning
Commission on February 13, 1980, and EIR-80-6A (supplemental), covering the
proposed development of Telegraph point, Chula Vista tract 82-2, was certified
by the Planning Commission on December 2, 1981.
oow, THEREFORE, BE IT RESOLVED AS FOLLOWS:
From facts presented to the Planning Commission, the Commission
finds that pursuant to Sections 66473.5 of the Subdivision Map Act, the
tentative subdivision map for Telegraph Point, Chula vista Tract 82-2, is
found to be in conformance with the El Rancho del Rey specific Plan and the
various elements of the City's General plan, based on the following:
a. The site is physically suitable for residential development
and the proposal conforms to all standards established by
the City for such projects.
b. The design of the subdivision will not affect the existing
improvements -- streets, sewer, etc. -- which have been
designed to avoid any serious problems.
c. The project is in substantial conformance with the Chula
vista General plan Elements as follows:
1) Land Use Element - The El Rancho del Rey Specific
plan designates the area for medium density
residential, a range of 6-10 dwelling units per acre,

which would permit a maximum of 256 units on the
subject property, which is the number the developer
is proposing to construct.
2) Circulation Element - The development will be served
by a public road system and the adjoining streets
widened and improved to City standards for major
roads.
3) Housing Element - The proposed project will provide
additional housing for the residents of the City of
Chula vista.
4) Conservation Element - The EI Rancho del Rey plan
designates approximately 7 acres of natural open
space on the property. The developer proposes to
provide approximately 8 acres of open space.
5) park and Recreation and Open space Elements - The
proposed development will be required to pay fees in
lieu of the dedication and improvement of park
lands. The map conforms to the Open Space Element.
6) Seismic Safety and safety Elements - No known faults
exist within close prOXimity to the subject
property. The proposed circulation system will
facilitate the movement of emergency vehicles. The
project is well within the response time of the fire
station located at Otay Lakes Road and Elmhurst.
7) Noise Element - All dwellings are to be designed so
as not to exceed a maximum interior noise level of 45
dBA.
8) scenic Highway Element - All manmade cut or fill
slopes will be enhanced by the planting of trees and
variable slopes are proposed along the east-west
segment of Otay Lakes Road.
9) Bicycle Routes Element - The public street system has
been designed to accommodate bicycle movement.

10) Public Buildings Element - No public buildings have
been designated on the subject property.
d. Pursuant to Section 66412.2 of the Subdivision Map Act, the
Commission certifies that it has considered the effect of
this approval on the housing needs of the region and has
balanced those needs against the public service needs of
the residents of the City and the available fiscal and
environmental resources.
BE IT FURI'HER RESOLVED:
That the planning Commission recommends that the City Council approve
the tentative subdivision map for Telegraph Point, Chula vista Tract 82-2,
subject to the following conditions:
1. The developer shall dedicate to the City sufficient right-of-way
along otay Lakes Road (north-south and east-west segments of
otay Lakes Road) as directed by the City Engineer.
2. The developer shall dedicate to the City sufficient right-of-way
along the east-west segment of otay Lakes Road adjacent to the
subdivision to provide for construction of the street
improvements as shown on the typical section for said segment on
the tentative map and the taper described below. Beginning at
the curb return the developer shall dedicate to the City
additional right-of-way to provide a 30:1 transition easterly
from the curb return on the east-west segment of otay Lakes
Road. The northerly right-of-way line shall be 74 feet north of
the "N" line shown on the tentative map at the easterly end of
the curb return and taper to 63 feet north of the "N" line at
the easterly end of the 30:1 taper.
3. The developer shall be responsible for the construction of full
street improvements on the east half of otay Lakes Road
(north-south segment) adjacent to the property in accordance
with the typical section shown on the tentative map. The
developer shall also be responsible for the construction of full
street improvements along the east-west segment of Otay Lakes
Road adjacent to the property in accordance with the typical

section shown on the tentative map and the transition stated in
condition number 3 through the transition. The curb shall
parallel the northerly right-of-way line. Said improvements
shall include but not be limited to A.C. pavement, monolithic
curb, gutter and sidewalk, street lights and drainage facilities.
4. The developer shall construct offsite improvements in Otay Lakes
Road from the eastern subdivision boundary to Rutgers Avenue.
Said improvements shall be the same as shown on the tentative
map typical section for the east-west bound otay Lakes Road.
The developer shall dedicate right-of-way adequate to provide
for said improvements.
5. The westerly access to the project shall be aligned so as to
line up with the access to Charter Point across Otay Lakes Road.
6. Prior to occupancy of any of the residences, four lanes shall be
provided for Telegraph Canyon Road from approximately station
69-50 (the approximate location of Casa Del Rey improvements 2
miles west of the subject property) as shown on Chula Vista
Drawing No. 78-345D, to Rutgers Avenue. The developer shall be
responsible for any transitions that may be necessary on the
east side of the intersection of otay Lakes Road and Telegraph
canyon Road. The four lanes to be provided shall include, but
not be limited to, 57 feet of pavement, curb, gutter and
sidewalk, and A.C. berm.
7. Streets "A, B, C, D, E, and F" shall be offered for dedication
to the City on the Final Map and shall be designed and
constructed in accordance with the typical sections on the
Tentative Map.
8. During the progress of land development operations, the
developer shall take all safety precautions reasonably necessary
to protect adjacent property from damage due to erosion,
flooding, silting and other storm related hazards which are a
consequence of this operation. An erosion and sedimentation
control plan shall be prepared as part of the grading plans.

9. Mitigation measures identified in the Environmental Impact
Report for this project shall be incorporated into the
development work as determined by the Environmental Review
Coordinator.
10. Prior to the approval of the Final Map, the developers shall
enter into a separate agreement with the City of Chula vista
stipulating that they or their successors in interest shall be
required to participate in a reimbursement or other district for
the final construction of Telegraph Canyon Road.
11. The developer shall grant easements to the City for street tree
planting and maintenance along dedicated streets as determined
by the City Engineer.
12. The developer shall grant to the City 10 foot wide easements for
proposed offsite drainage facilities prior to approval of the
Final Map.
13. The developer shall grant sewer and drainage easements as
determined by the City Engineer.
14. Intersections and curves for interior streets shall be designed
to provide for a 25 MPH sight distance.
15. Intersections with otay Lakes Road shall be designed to provide
for a 45 MPH sight distance.
16. "A" street as shown on the tentative map shall intersect with
otay Lakes Road at an angle between 70 degrees and 90 degrees to
centerline.
17. Recommendations of the soils report shall be incorporated into
the project.
18. streets, sewers and drainage facilities shall meet design
criteria of the subdivision manual and the Chula vista Design
and construction standards unless otherwise approved by the City
Engineer.
19. prior to any grading or clearing activities, a qualified field
biologist shall be retained to carry out a program to disperse
individual burrowing owls nesting on the site.

20. A geologist shall be present during grading to observe all cut
slopes for faulting or landsliding.
21. The developer shall record Covenants, Conditions, and
Restrictions (CC&R's) concurrently with the recordation of the
final map and which shall be subjected to the approval of the
City Council.
22. The City of Chula vista shall be made a party to the CC&R's
which shall include but not be limited to the following:
a) Prohibition of garage conversions.
b) Prohibition against the parking of recreational vehicles on
the street and interior driveways.
c) Prohibition against the installation of individual outside
antennae.
d) Provisions for the maintenance of all common areas,
required fencing, recreational areas and building,
driveways and private streets (if any).
e) Provision requiring any garage located closer than 22 feet
from the inside edge of the sidewalk or face of curb to be
equipped with automatic door openers.
23. An irrevocable offer of dedication shall be given to the City of
Chula Vista for Lots 1 and 2 and the developer shall request the
establishment of an open space maintenance district over said
lots. Fees will be imposed upon the owners unless the lots are
maintained to standards acceptable to the City Council, in which
case the City Council may impose fees necessary to insure a
satisfactory level of maintenance. This condition shall be
stipulated in the CC&R's.
24. In the event the streets remain private, the developer shall
request that the City Council adopt a resolution allowing the
City to enforce traffic regulations on private property. Said
request shall be made concurrent with the request for approval
of the final map.

25. The developer shall provide street lights within the
development; the location, type, and material to be subject to
the approval of the City Engineer and Director of Planning.
26. No building permits shall be issued until such time as the
school districts have given written notice to the City that they
are able to provide school facilities for the residents of the
development.
27. The developer shall obtain an encroachment permit for retaining
walls constructed within the public right-of-way. In addition
the CC&R's shall include a statement relative to the maintenance
of those retaining walls by the homeowners association.
28. The streets shall be named as follows:
"A" street - Clemson Avenue
"8" street - Princeton street
"C" street - Hastings street
"D" street - Parsons street
"E" street - Leeds way
"F" street - Case way
29. The project shall be reviewed by the Design Review Committee
prior to consideration by the City Council.
30. Play areas for children shall be included as part of the
landscape plan to be approved by the City's Landscape Architect.

The Planning Commission directs that this resolution be forwarded to
the City Council and a copy be sent to the applicant.
