HomeMy WebLinkAboutReso 1982-10766 RESOLUTION NO. 10766 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING EAST COLLEGE SECTIONAL PLANNING AREA PLAN FOR 34.3 ACRES AT THE NORTHEAST CORNER OF TELEGRAPH CANYON ROAD AND OTAY LAKES ROAD The City Council of the City of Chula vista does hereby resolve as follows: WHEREAS, EIR-80-6A and the CEQA findings which are supplemental to that EIR for the subject property has heretofore been certified by the City Council, and WHEREAS, Ordinance No. 1824, adopted by the City Council on August 15, 1978, adopted a new Specific plan/General Develop- ment plan for the P-C zone of El Rancho del Rey, and WHEREAS, a revised development plan for the East College Sectional Planning Area of the El Rancho del Rey Specific Plan was filed with the Planning Department by Pacific Scene, Inc., and WHEREAS, a hearing was held before the Planning Commis- sion on January 13, 1982 to consider said plan and the Commission recommended that the City Council approve the development plan subject to the conditions set forth in their Resolution No. PCM-82-8. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula vista does hereby approve the development plan for the East College Sectional Planning Area of the El Rancho del Rey Specific Plan in accordance with Planning Commission Resolution No. PCM-82-8. PCM-82-8 RESOLUTION OF THE CITY PLANNIN3 COMMISSION RECOMMENDIN3 TO 'mE CITY COUNCIL THE APPROVAL OF DEVELOPMENr PLANS FOR TIlE EAST COLLffiE SECTIONAL PLANNIN3 AREA OF EL RANCHO DEL REY SPECIFIC PLAN WHEREAS, Ordinance No. 1824, adopted by the City Council on August 15, 1978, adopted a new specific plan/General Development plan for the P-C zone of El Rancho del Rey, and WHEREAS, a revised development plan for the East College Sectional planning Area of the El Rancho del Rey specific Plan was filed with the Planning Department by Pacific Scene, Inc. WHEREAS, the City Planning Commission set the time and place for a public hearing to consider said development plan and notice of said hearing, with its purpose, was given by the publication in a newspaper of general circulation in the city at least ten days prior to the date of said hearing, and WHEREAS, a hearing was held at said time and place, namely 7:00 p.m., January 13, 1982, in the Council Chambers, Public Services Building, 276 Fourth Avenue, before the planning Commission and said hearing was thereafter closed, and WHEREAS, EIR-80-6, covering development plans on the subject property, was certified by the planning Commission on February 13, 1980; and EIR-80-6A (supplemental) covering the revised development plans for the East College Sectional Planning Area was certified by the Planning Commission on December 2, 1981. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. From facts presented to the planning commission, the Commission finds that: a. The proposed Sectional planning Area plan is in COnformity with the general development of the P-C zone, any adopted specific plans, and the Chula vista General plan and its several elements. The proposed 256 units on the property is in keeping with the maximum density allowed by the El Rancho del Rey specific Plan. The 8.2 acres of open space exceeds the 7 acres reflected on the specific plan. f(//07p~ -1- b. The proposed Sectional Planning Area plan would promote the orderly sequential development of the Sectional planning Area. The proposed developnent encompasses the entire East College Sectional planning Area and therefore conforms with this finding. c. The proposed Sectional planning Area plan would not adversely affect adjacent land uses, residential enjoyment, circulation or environmental quality. The proposed grading plan will enable the developer to place the proposed structures 10 to 40 feet below the level of the majority of the single family dwellings to the north, thus minimizing any adverse effect on those uses. The developnent will be served entirely by a public street system which need not be extended to serve adjacent properties. While the proposed grading represents a Significant land form alteration, much of the visual impact is caused by the widening of otay Lakes Road. The variable slopes will help minimize the visual effects of the proposed slopes. 2. The planning Corrmission recommends that the City Council approve the revised sectional Planning Area plan for the East College area of the El Rancho del Rey specific plan, submitted by pacific Scene, Inc., subject to the following conditions: a. The development shall be subject to the regulations of the Municipal Code governing the R-3 zone together with the following: 1) The separation between buildings shall not be less than 20 feet. ) 2) 'lbe minimum distance from a garage door to the street property line shall be not less than 15 feet. 3) No garage shall be converted into a living area. 4) The developnent shall not exceed a maximum of 256 units. 5) No overhead patio coverage shall be permitted. b. All development shall be subject to site plan and architectural approval by the Design Review Corrmittee. 11- /0 7~/r -2- 3. That this resolution be transmitted, along with the proposed development plan to the City Council, and a copy of this resolution be transmitted to the applicant.
