Home My WebLink AboutReso 1981-10707 RESOLUTION NO. 10707 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA DECLARING ITS INTENTION TO ESTABLISH AND LEVY A BUSINESS LICENSE TAX UPON THE AREA INCLUDED IN THE PARKING AND BUSINESS IMPROVEMENT AREA AND TO MODIFY THE BOUNDARIES OF SAID AREA FOR THE PURPOSE OF THE GENERAL PROMOTION OF RETAIL TRADE, AND FIXING THE TIME AND PLACE FOR A HEARING TO BE HELD TO CONSIDER THE ADJUSTMENT OF SAID ADDITIONAL BUSINESS LICENSE LEVY AND MODIFICATION OF THE BOUNDARIES OF SAID PARKING AND BUSINESS IMPROVEMENT AREA, AND DIRECTING THE GIVING OF NOTICE OF SAID HEARING The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, in the past three years since the most recent establishment and levy of the additional business license tax upon the area included in the Parking and Business Improvement Area and the modification of the boundaries of such area, there have been complaints, primarily from professionals within the area, as to the amount of the additional license fee, and WHEREAS, there have also been questions regarding the boundaries of the area. 1. Authority. Pursuant to the authority granted in Sections 36,000 through 36,081 of the Streets and Highways Code; more specifically ~~36,024 and 36,061, the City Council is authorized to make changes in the additional rate or levy upon the parking and business improvement area and to modify the boundaries of said area as enumerated hereinbelow. 2. Intention. The City Council hereby declares its intention to make changes in the additional rate or levy of the business license tax as follows: Class A: Professions: accountant, architect, appraiser, assayer, attorney, auditor, bacteriologist, chemist, chiropodist, chiropractor, dentist, medical doctor, engineer, electrologist, entomologist, geologist, oculist, optician, optometrist, osteopath, pharmacist, physician, physiotherapist, psychiatrist, psychologist, podiatrist, real estate broker, real estate salesman, roentgenologist, stock and bond broker, surgeon, surveyor, taxidermist and veterinarian. Each professional working as a sole practitioner shall pay an amount of one time their business license fee. For all of the professionals working in a partnership or corporation at the same address $50.00 for the senior practitioner and $15.00 for all other practitioners. Class B: All other businesses located within the Downtown Parking and Improvement Area, known as the Downtown Business Area, and shown more specifically on a map designated as Exhibit "A" and attached hereto by reference as if set forth in full, shall pay an assessment equal to two times their business license. Said additional license tax shall be levied, collected and enforced in the same manner, at the same time and with the same penalties and interest as in the case of the general business license tax; provided, further, that no such additional license levy shall be more than one hundred dollars ($100.00) -1- 3. Collection of Additional Taxes. The collection of the additional levy to the license tax proposed by virtue of this proceeding shall be made at the times set forth hereinabove and in the same manner as the ordinary business license tax of the City under the provisions of the Chula Vista Municipal Code, and such tax proposed to be imposed under this proceeding shall be computed in the manner provided in the Chula Vista Municipal Code for each business. 4. Alternatives to Said Proposed Changes in the Additional Rate or Levy. The City Council may at the time and place of the hearing as set forth in this resolution, consider alternatives to the proposed changes in the additional rate or levy as set forth hereinabove or as shown in Resolution No. 9859, adopted on November 20, 1979. 5. Modification of Boundaries of Downtown Business Improvement Area of the City of Chula Vista - Description. The City Council may, at the time and place of the hearing as set forth in this resolution, consider alternatives to the boundaries of the Downtown Business Improvement Area as shown on Exhibit A, and delineated as the Town Center Redevelopment Project, and is incorporated herein by reference. 6. Time and Place of Hearing; Notice. Notice is hereby given that Tuesday, the 22nd day of December, 1981, at the hour of 7:00 p.m. in the Council Chambers of the City Hall, 276 Fourth Avenue, in the City of Chula Vista, is the time and place fixed for the hearing on this resolution of intention to establish additional business license tax. These amendments levy an additional business license tax on the businesses listed according to class. 7. Publication and Mailing of Notice. The City Clerk shall cause this resolution to be published at least once in the Chula Vista Star News, a newspaper of general circulation printed and published in said City. The City Clerk shall also mail a copy of this resolution to each business in the business improvement area. Present ~ " , George D.
