RESOLUTION NO. 10698
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROVING THE TENTATIVE SUBDIVISION MAP FOR
CHULA VISTA TRACT 82-3, STAR ORANGE
The City Council of the City of Chula Vista finds as
follows:
That in accordance with the attached Negative
Declaration, IS-82-6, and the findings therein, the proposed
tentative map will not have a significant impact upon the
environment, and the City Council hereby certifies that the
Negative Declaration was prepared in accordance with the
California Environmental Quality Act of 1970, as amended.
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the Planning commission of the City of Chula
Vista has heretofore approved that certain tentative map of a
subdivision to be known as Chula Vista Tract 82-3, Star Orange and
has recommended that the City Council approve said tentative map
subject to the conditions contained in Planning Commission
Resolution No. PCS-82-3, adopted on the 14th day of October, 1981,
a copy of which is attached hereto and by this reference made a
part hereof the same as though fully set forth herein.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista does hereby approve said tentative
subdivision map in accordance with Planning Commission Resolution
No. PCS-82-3 as amended to add thereto a Condition No. 20 to read
as follONS:
20. The developer shall work with the staff in an
attempt to resolve the problems of development and
maintenance of the City-owned land on the north side
of Orange Avenue facing the proposed project, e.g.,
arrangements to accomplish grading and preparation
of the area for planting or the establishment of a
maintenance district.

RESOLUTION NO. PCS-82-3
RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO
THE CITY COUNCIL THE APPROVAL OF THE TENTATIVE SUBDIVISION
MAP FOR CHULA VISTA TRACT 82-3, STAR/ORANGE
WHEREAS, a tentative subdivison map for Chula Vista Tract 82-3, Star/Orange,
was filed by Star Corporation to subdivide 18.3 acres located on the south side
of Orange Avenue in the vicinity of Brandywine Avenue into a two lot condominiur;1
project consisting of 176 units, and
WHEREAS, Section 66473.5 of the State Map Act provides that approval of
a subdivision map shall be based upon findings of consistency between the subdi-
vision map and the adopted general or specific plan for the area, and
WHEREAS, the Planning Commission set the time and place for a public hearing
to consider said tentative map, and notice of said hearing, with its purpose, was
given by the publication in a newspaper of general circulation in the city at least
10 days prior to the date of said hearing, and
WHEREAS, a hearing was held at said time and place, namely 7:00 p.m.,
October 14, 1981, in the Council Chambers, 276 Fourth Avenue, before the Planning
Commission and said hearing was thereafter closed, and
WHEREAS, the Planning Commission found that the project will have no signif-
icant environmental impact and adopted the Negative Declaration on IS-82-6.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
From facts presented to the Planning Commission, the Commission finds that
the tentative subdivision map for Chula Vista Tract 82-3, Star/Orange, is in
conformance with the City's General Plan, based on the following:
1. The site is physically suited for the type of residential development
proposed.
2. The design of the project will improve the existing public improvements,
such as streets, drainage, sewer, etc., which will be designed to avoid any serious
health problems.
3. Approval of this project will not adversely affect the public service
needs of the residents of the city or available fiscal and environmental resources.
4. The subdivision is consistent with the General Plan and its elements as
fiollows:
a. Land Use - The density of the project of 11 units per acre is in
keeping with the General Plan designation for this area of 4-12 units
per acre.

b. Circulation - The development will improve the southerly half of
Orange Avenue and extend and improve Brandywine Avenue to Orange
Avenue. The private road system will adequately serve the
proposed units. Aside from Brandywine Avenue and Orange Avenue
no other streets are needed to serve adjacent properties.
c. Housing - The proposed project will provide needed housing in the
conmunity.
d. Conservation The steep knoll has been disturbed by a previous borrow
pit operation. While extensive grading will occur it will retain the
basic land form.
e. Parks and Recreation - The development will be required to pay fees
in lieu of dedication and improving park lands.
f. Seismic Safety and Safety - The proposed development will not encroach
into the earthquake fault zone. The site is well within the response
time of the fire station located on East Oneida Street.
g. Noise - The development will be required to construct a 4 foot high
noise attenuation wall along Orange Avenue. In addition, the units
must be of certain construction to achieve acceptable interior noise
levels.
h. Scenic Highways - Orange Avenue is a designated scenic route. The
adopted precise plan guidelines and design review procedure will
insure that the proposed development meets the goals and objectives
of this element.
i. Bicycle Route - The right-of-way of Orange Avenue is adequate to
accommodate the bicycle route established on said street.
j. Public Buildings - The Fire Department has indicated that the fire
station designated in the general vicinity of the subject property
is no longer required.
5. Pursuant to Section 66412.2 of the Subdivision Map Act, the Commission
certifies that it has considered the effect of this approval on the housing needs
of the region and has balanced those needs against the public service needs of the
residents of the City of Chula Vista and the available fiscal and environmental
resources and determined that the subject property is well suited for residential
development.
BE IT FURTHER RESOLVED:
That the Planning Commission reconmends that the City Council approve the
tentative map for Chula Vista Tract 82-4, Star/Orange Condominiums, subject to
the following conditions:

1. An adjustment plat for the proposed property line adjustment shall be
prepared and approved prior to the approval of the final map, or the
present owner's signature shall be placed on said map.
2. Brandywine Avenue shall be super elevated as determined by the City
Engineer.
3. The developer shall acquire and grant to the City offsite drainage and
sewer easements as determined by the City Engineer prior to approval of
the final map.
4. Guard rails shall be provided for fill slopes over 10 feet in height
adjacent to Brandywine and Orange Avenues. The design shall be subject
to the approval of the City Engineer and the Director of Planning.
5. The recommendations included in the soils report for the project shall
be incorporated into the project plans.
6. The private street entrances from both Brandywine Avenue and Orange
Avenue shall be either alley type or conventional street intersections
with minimum curb radii of 25 feet. These intersections shall be so
treated as to clearly indicate that they are entrances to private streets.
If islands are used, a clear exit roadway width of 20 feet shall be
provided. The entrance roadway width may be 15 feet as shown.
7. The developer shall perform offsite grading at the western subdivision
boundary in the vicinity of the prop~sed 10X12 box culvert to prevent a
ponding condition.
8. The developer shall grant to the City 7.5 foot street tree easements on
both sides of Brandywine Avenue.
g. The developer shall grant to the City a 6.5 foot street tree easement
along Orange Avenue adjacent to the subdivision.
10. The developer shall dedicate and improve Brandywine Avenue. Improvements
shall include, but not be limited to, A.C. pavement, monolithic curb,
gutter and sidewalk, and street lights. Construction of sidewalk on the
east side of Brandywine Avenue shall be as determined by the City Engineer.
11. The alignment of Brandywine Avenue shall be such that its intersection
with Orange Avenue will align with improvements in Brandywine Avenue
north of Orange. The southerly portion of the intersection (south of
the line 32 feet north of the curb line) shall be fully improved.
12. The developer shall provide street improvements for Orange Avenue along
its full frontage consisting of but not limited to: monolithic curb,
gutter, and sidewalk; and a paved roadway width of 32 feet measured

from the southerly curb 1 ine. The northerly edge of pavement shall b':?
defined with a redwood header as shall the edge of pavement at the
easterly project boundary. Street lights shall be installed as directed
by the City Engineer.
13. Landscaping on the west side of Brandywine Avenue north of the private
road entrance shall consist of low shrubbery to avoid creation of a sight
distance problem.
14. An open space easement over the southerly open space area on Lot 2 shall
be granted to the City of Chula Vista.
15. The CC&R's shall include, but are not limited to, the following:
a. Provision making the City of Chula Vista a party to the CC&R's for
enforcement purposes.
b. Prohibition against the conversion of any garage into living space.
c. Provisions insuring the maintenance of all private streets, drive-
ways, recreational areas and buildings, and all common areas.
d. Prohibition against any outside antennae.
e. Provision acknowleaging that only 8 units are to be allowed in the
area east of Brandywine Avenue.
16. Garages located closer than 22 feet from any access road shall be equipped
with automatic door openers.
17. No building permit shall be issued until such time as the school districts
have indicated that they can provide school facilities to serve the resi-
dents of the proposed development.
18. The developer shall grant a 10 foot wide sewer easement to the City of
Chula Vista prior to approval of the final map. Said easement shall
approximately parallel the Poggi Canyon storm drain. The specific align-
ment shall be subject to approval by the City Engineer.
19. The developer shall install a 15 inch sewer line within the above easement
and Orange Avenue from the downstream point of connection of the sewer
as shown on the tentative map to the centerline of the Orange Avenue
right-of-way at a point approximately opposite the project's entrance
drive off Orange Avenue.
The Planning Commission directs that this resolution be forwarded to the
City Council and a copy be sent to the applicant.
