State and Local Regulations A. The City of Chula Vista's Solid Waste Enforcement Program operates by authority of Title 7.3, Government Code, Title 14, California Administrative Code, and the U.S. Resource Conservatio~ and Recovery Act of 1976, as amended. The Solid Waste standards for storage, collection, transportation, and disposal for the incorporated areas of Chula Vista are contained in Sections 8.24, 15.36 and 17.12 of the Municipal Code (see attachments A, B and C). In addition, there is an agreement between the City of Chula Vista and the Chula Vista Sanitary Service to collect and dispose of refuse (see attachment D). II. Program Goals and Objectives A. Goals and Objectives To assure that all residential, commercial and industrial solid wastes are stored, transported, transferred/processed and disposed of in a safe, sanitary and environmentally acceptable manner. III. Solid Waste Facilities Permitting Procedures There is one solid waste facility located within the City of Chula Vista city limits. This facility, however, is inspected and/or regulated by the County of San Diego in accordance with a solid waste facilities permit issued by the State of California. IV. Inspection ~ Compliance Procedures A. Solid Waste Collection and/or Transportation Vehicles The City of Chula Vista contracts with the Chu1a Vista Sanitary Service for solid waste collection. The current agreement does not provide for City inspection of their sol id waste collection and/or transportation vehicles. Chula Vista Sanitary Service is required to use such number of trucks and personnel as the quanitity of refuse requires. These trucks must be adequately maintained as to condition and appearance. fi'.;> /015/ 1 B. ,Solid Waste Disposal and Transfer Facilities The solid waste disposal site (Otay landfill) located within the City limits is inspected and/or regulated by the County of San Diego in accordance with a permit issued by the State of California. A Class I transfer facility to be located within the City limits will be regulated by the State Department of Health in accordance with the State's licensing proced ures. C. Local Enforcement Agency compliance program actions are: 1. Verbal notice to collection operator at the time that a violation is reported. In most instances, this action resolves all problems. D. Written or verbal complaints that solid waste services are the source of health environmental hazards or a public nuisance are accepted and investigated by the Director of Building and Housing and the City Engineer. E. The following State and local agencies are closely coordinated in enforcement responsibilities and activities. 1. State Solid Waste Management Board ~!s St~!~ E~llEX' esta~lishes statewide stanaaras, concurs wlth or obJects to solid waste facility permits and aids, assists and oversees local enforcement programs. 2. State Department Health Services, Hazardous Waste Management Section: regulates and permits hazardous and infectious waste transportation and disposal. 3. City Planning Department: establishes land zoning and processes land use permits. V. Staff Training On the job and inservice training is given as necessary. VI. Time Task Analysis Time task analysis is a procedure used to determine the personnel required to conduct an acceptable solid waste enforcement program. Since the City contracts with the Chula Vi sta Sani tary Serv ice for sol id waste removal, thi s section is not applicable to Chula Vista. 1(- /tJ15( 2 VII. Table of Organization See Attachment E. If any provision, clause, sentence or paragraph of this chapter or the application thereof to any person or circumstances is held invalid, such invalidity shall not affect the other provisions or application of the provisions of this chapter which can be given effect without the invalid provision or application, and to this end the provisions of this chapter are declared to be severable. For the purpose of this chapter, the following words and phrases shall have the meanings respectively ascribed to them by this section: A. "Contract agent" means an agent or ,employee of the city or any person or firm or the agent or employee thereof, with whom the city may have contracted to collect or dispose of refuse. B. "Garbage" means food waste from kitchens, dining rooms, and other similar places resulting from the handling, preparation, cooking or consumption of food in any private or multiple dwellings, hotels, restaurants or institutions. C. "Rubbish" means paper, glass, cans, bottles, rags, ashes, and trimmings from lawns, shrubbery and trees. D. "Refuse" means ashes, food plant wastes, garbage, market refuse or rubbish. (Ord. 949 ~ 1 (part), 1965: prior code ~ 16.7.) 8.24.020 Accumulation of materials constituting a fire hazard prohibited. It is unlawful for any person to create or allow to be created, or maintained upon any premises in the city, owned or controlled by such person any accumulation of materials that are dangerous as a fire menace and hazard. (Prior code ~ 16.1.) 8.24.030 Refuse-Disposal in public places prohibited. It is unlawful for any person to place, dump, deposit or throw any rubbish, bottles, glass, tacks, tin cans, wire, automobile parts or bodies, old wagons or buggies, or other vehicles, in whole or in part; citrus fruit, deciduous fruit, vegetables, junk or other refuse of any kind or character whatsoever upon or along the right-of-way of any public highway, street, lane, 225.2 (Chula Vista 11-15-75) { ~ alley or other public place within the corporate limits of the city. (Prior code S 16.2.) 8.24.040 Refuse-Disposal on private property prohibi ted - Exception. It is unlawful for any person to place, dump, deposit or throw any rubbish, bottles, tin cans, wire, automobile parts or bodies, old wagons or buggies, or other vehicles, in whole or in part; citrus fruit, deciduous fruit, vegetables, junk or other refuse of any kind or character whatsoever, upon any private property adjacent or abutting upon any public highway, or public place, or upon any private property whatsoever, within the corporate limits of the city unless such person first obtains the permission of the owner of such property so to do. (Prior code ~ 16.3.) ( 8.24.050 Owner or occupant responsibility to maintain sanitary premises. Every owner, tenant, occupant or person owning or having the care and control of any premises in the city shall keep said premises or those under his care and control in a clean and sanitary condition and no person shall permit any garbage, rubbish, or any other substance which may be or will become offensive to be deposited or to remain in or upon any premises owned or occupied by him or under his care and control except as otherwise provided by law. It shall be the responsibility of such person to provide for scheduled garbage, rubbish, or refuse collection personally or by means of the services of the contract agent of the city. No person shall cause or permit rubbish to accumulate at any place or premises under his charge or control for a period in excess of one calendar week. (Ord. 949 S I (part), 1965: prior code S 16.8.) ( 8.24.060 Garbage and refuse-Collection prohibited when-Burning prohibited. No person shall collect, remove or convey, or cause or permit to be collected, removed or conveyed, any refuse upon or along any public str.eet, alley or any other public place in the city; provided however, the prohibitions of this section shall not apply to authorized employees of the city, or to any person or firm or employees thereof, with whom the city has 4- /(}7sl GARBAGE. AND. LITTER entered into a contract for the collection, removal or disposal of garbage or rubbish or refuse, or to the occupant or owner of any residence from personally removing garbage or rubbish from said residence or commercial establishment. It is unlawful for any person to bum or bury any garbage or refuse as a means of disposing of said garbage. (Ord. 949 ~ I (part), 1965: prior code ~ 16.9.) 8.24.070 Garbage and refuse-Receptacles approved for residen tial use. It is unlawful for any person in a residential area to keep or store any garbage within receptacles except those which are tapered gradually decreasing in diameter toward the bottom of the container, made of metal or plastic with metal or plastic covers and handles and which receptacles shall be watertight and fly-proof and shall not exceed eighteen gallons' capacity. Further, every person having the care or control of any place or premises within the city where refuse accumulates or exists, and such refuse is to be collected by the contract agent of the city, shall cause such refuse to be placed and kept in such receptacles, with lids securely fitted, and in a number adequate to contain the amount of refuse normally accumulating during the interval between collection thereof. (Ord. 949 ~ I (part), 1965: prior code ~ 16.10.) 8.24.080 Garbage and refuse-Placement in receptacles or bundles-Restrictions. All rubbish and trash shall be kept within receptacles of a nature, made of metal or plastic, and shall not exceed eighty pounds in weight when fully loaded, and no rubbish or trash shall be placed in any receptacle so that the same protrudes or extends beyond such receptacle; provided however, that cardboard containers securely tied may be used. Said containers shall also be collected. Newspapers may be placed outside of receptacles if they are stacked and securely tied in bundles of not more than sixty pounds weight. Brush and limbs of trees may be placed outside of containers in tied bundles not more than four feet in length or eight inches in diameter. (Ord. 949 ~ 1 (part), 1965: prior code ~16.11.) 226 ( 8.24.090 Garbage and refuse-Placement of receptacles for collection-Times. No refuse shall be placed for collection in an alley or on the curb of the streets before six p.m. on the day immediately prior to the scheduled collection day. No person shall permit refuse receptacles to remain on the street or alley after eight p.m. of the collection day. Collection point shall be in front of the residential property at the curb line or as close thereto as possible without creating an obstacle on the sidewalk. All refuse placed at such collection points shall be deemed an acceptance or request for service by the city's contract agent. (Ord. 949 ~ I (part), 1965: prior code ~ 16.12.) c 8.24.100 Payment of collection fees required. The council finds and determines that the regular collection of garbage and rubbish and the disposal thereof by the contract agent of the city from all places in the city is a service to the premises from which it is collected. All owners or occupants as set forth hereinabove having the responsibility for keeping the premises clean and sanitary shall pay the monthly collection rate as set forth in the contract schedule contained in the agreement between the city and its contract agent. No person shall wilfully fail, neglect, or refuse, after demand by contract agent, to pay the fees as prescribed in the schedule contained in said agreement. (Ord. 949 ~ I (part), 1965: prior code ~ 16.13.) l 8.24.110 Interference with collection and scavenging prohibited when. It is unlawful for any person or persons other than the contract agent as defined herein and authorized by the city to collect garbage, rubbish, trash and other refuse, to interfere in any manner with any receptacle whether owned by private persons or by the contract agent, containing garbage, trash, rubbish or the contents thereof or to remove any such receptacle from the location where the same was placed by the owner thereof or to remove the contents of any such receptacle except that any person, firm or corporation producing table refuse or other form of garbage, may sell, give or otherwise dispose of the same in such manner as he or it may desire: provided, that any table Ii" l~l5f GARBAGE. AND .LITTER refuse or garbage handled, conveyed or otherwise treated by any person other than an employee of the contract agent of the city, shall be handled, conveyed or otherwise disposed of in a manner strictly in accordance with the rules and regulations of the board of health of the dty and any person, firm or corporation may also sell, give or otherwise dispose of trash or rubbish in such containers in such manner as he or it may desire provided that all laws relating to litter shall be strictly observed. (Ord. 1204 ~ 1, 1969: prior code ~ 16.14.) 8.24.120 Littering-By private persons prohibited where. No person or persons shall leave, discard, deposit, throwaway or cause to be left, discarded, deposited or thrown away, any container of any type material, waste, food, paper, wood, trash or any refuse upon any street, alley, gutter, sidewalk, parkway, park, or recreational area in the city. (Ord. 1204 ~ 2 (part), 1969: Ord. 912 ~ 1 (part), 1964: prior code ~ 16.15.) 8.24.130 Littering-By corporations or persons prohibited where. It shall be and it is declared to be unlawful for any person, firm, company or corporation to deposit upon any sidewalk, or street within the city any sweepings from any sidewalk, stairway or other opening leading to the street or sidewalk. All such sweepings or material from any sidewalk or any other opening leading to the street or sidewalk within the city shall be removed in a pan, shovel or other container and placed in a receptacle for rubbish. (Ord. 1204 ~ 2 (part), 1969: Ord. 912 ~ 1 (part), 1964: prior code ~ 16.16.) 8.24.140 Owner or occupant duty to keep sidewalks free of litter. It shall be the duty of all owners and occupants of buildings in the .city and the duty of all owners of vacant lots in the city to keep the sidewalks adjacent to such premises clean and free of any container of any. type of material, waste, food, paper, wood, trash or any refuse, and all noxious weeds and vegetation. A violation of any provision or the failure to comply with any of the requirements of this chapter constitutes a misdemeanor. Any person convicted of such violation or such failure shall be punishable by a fine of not more than five hundred dollars or by imprisonment in the county jail for a period of not more than six months, or by both such fine and imprisonment. Such nuisance as declared in the preceding section may be abated by the health officer of the city in any manner permitted by law, or by any proceeding or remedy provided by law. It is declared unlawful for any person to permit or maintain any nuisance as provided in Section 8.28.010 within the corporate limits of the city and any person who permits or maintains any such nuisance shall be guilty of a misdemeanor. Such person shall be deemed guilty for each day during any portion of which any violation is committed, continued or permitted and shall be punishable as provided in this code. Said document is adopted prescribing regulations governing conditions hazardous to life and property from fire or explosion, and each and all such regulations, provisioris, penalties, conditions and terms of said Uniform Fire Code are referred to, adopted and made a part hereof as though fully set forth herein, excepting such portions as are hereinafter deleted, modified or amended. There is added to the Uniform Fire Code, 1979 Edition, the amendments to read as set forth in Sections 15.36.040 through 15.36.080. (Ord. 1902 ~ 2 (part), 1980.) 15.36.040 Section 1.205 amended-Authority. Article 2, Section 2.105 is amended to read as follows: "Sec. 2.105. Authority. The chief and all members of the depart- ment shall have the powers of a police officer while performing their duties under this ordi- nance." (Ord. 1902 S 2 (part), 1980.) 15.36.050 Section 10.307(a) amended-Fire alarm systems. A. Article 10, Section 10.301, subsections (f) and (g) are amended as follows: "Sec. 10.301 (f). Installation of Fire Hydrants. Fire hydrants, where required in all subdivi- sions, apartment complexes, commercial de- velopments, etc., shall be installed in an operable condition prior to any combustible construction material being placed on the site. Sec. 10.301(g). Stop Orders. Whenever any combustible material is placed on the site or any work is being done contrary to the provisions of this code, the Chief may order the said material removed from the site or the work stopped by notice in writing served on the owner or agent, and any such persons shall forthwith comply with said notice until autho- rized by the Chief to proceed." B. Article 10, Section 10.307, subsection (a) is amended as follows: "Sec. 10.307(a). Fire Alarm Systems. Every apartment house three stories or more in height, or containing more than fifteen (15) apartments, and every hotel three stories or more in height containing twenty (20) or more guest rooms shall have installed therein an ap- proved automatic or manually operated fire alarm system designed to warn the occupants of the building in the event of fire. Such alarm system shall be so designed that all occupants of the building may be warned simultaneously." (Ord. 1902 S 2 (part). 1980.) 402 (Chula Vista 8-80) MOVING, RELOCATING AND DEMOLISHING BUILDINGS ( ,~" 15.36.060 Section 1O.307(f) added-Sale or installation. Article 10, Section 10.307 is amended by adding a new subsection (f) to read as follows: "Sec. 10.307(f) - Sale or Installation. No person shall sell, offer for sale or install any fIre alarm signaling device or system without fIrst having obtained a permit from the Bureau of Fire Prevention. Such device or system shall be approved by a nationally recognized testing laboratory having reexamination and labeling service, and bears the label Deca1camania, or other evidence of approval by such testing authority." Article 10, Section 10.307 is amended by adding a new subsection (g) to read as follows: "Sec. 10.307(g) - Bond Required. No person shall sell or solicit the sale or installation of any fire alarm signaling system or device designated or intended to indicate a fire emergency without fIrst having filed with the Finance Officer of the City a surety bond in favor of the City in the amount of $1,000, which bond shall be approved as to form by the City Attorney. The condition of said bond shall be that any person injured by any misrepresenta- tion or fraud or breach of contract of the prin- cipal acting in the course and scope of his occu- pation or business, or by any officer, agency or employee of said principal acting in the course and scope of his employment or agency, may re- cover against said bonds damages occasioned by such injury. Said bond shall be held for a period of one year following notification to the Finance Director of the City of Chula Vista that Seller is no' longer engaged in the sale of any fire alarm signaling device or system." Applicability. The provisions of this section shall not apply to fIre alarm signaling systems installed as an integral part of any approved automatic fire ex- tinguishing system or an approved fire alarm signaling system designed or installed as required If-j015! by the building laws of the City and the Health and Safety Code of the State or which are other- wise specifically authorized by a building permit." Where two separate school districts operate schools in an attendance area where the city council concurs that overcrowding conditions exist for both school districts, the city council will enter into an agreement with the governing body of each school district for the purpose of determining the distribution of revenues from the fees levied pursuant to this chapter. Any school district receiving funds pursuant to this chapter shall maintain a separate account for any fees paid and shall file a report with the city council on the balance in the account at the end of the previous fiscal year and the facilities leased, purchased or constructed during the previous fiscal year. In addition, the report shall specify which attendance areas will continue to be overcrowded when the fall term begins and where conditions of overcrowding will no longer exist. Such report shall be filed by August 1st of each year and shall be filed more frequently at the request of the city council. Revised 7/30/81 fiG RESOLUTION NO. 105S5 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA REVISING THE CHUIA VISTA SANITARf SERVICE COLLECTION RATES The City Council of the City of Chula Vista does here~ resolve as follows: WHEREAS, pursuant to Section 2(b) of that certain amended agreement with the Chula Vista Sanitary Service, dated April 6, 1971, approved by Resolution No. 6015, adopted by the City Council of the City of Chula Vista on April 6, 1971, it is mutually agreed that the City Council of the City of Chula Vist.a shall'have the authority and duty from time to time during the term of this amended contract to review, act, establish and modify the rates and charges the Contractor may charge or collect from either single family residential, multiple family residential, commercial or industrial users. The City Council shall have the authority to fix just, reasonable and sufficient rates and charges when the Council, after a public hearing upon consideration of all testimony submitted, finds fran the evidence submitted that the rates existing at the time of said public hearing are either preferential, or substantially at variance from those rates for said services being performed in other communities in San Diego County, and WHEREAS, in accordance with Resolution No. 10547, the City Council has heretofore held a public hearing on Tuesday, July 28, 1981, at the hour of 7:00 p.m. in the Council Chambers of the City of Chula Vista to hear testimony regarding the rate schedule charges by said Contractor for the collection and disposal of garbage, trash and disposable material, and WHEREAS, after hearing all such testimony and considering said testimony, the City Council finds from the evidence submitted that the rates existing at the time of the public hearing are insufficient and substantially at variance from those rates for said services being perfonned in other comllUnities in San Diego, County, and WdEREAS, based upon said evidence, the City Council has determined that said rate schedule should be increased as set forth in Exhibit "A", attached ht.'rato and incorporated herein by reference as if set forth in full. NOW, 'l'Hf::REFORE, BE IT RESOLVED by the City Council of the City of Chula Vista does hereby establish the rate schedule as set forth in Exhibit "A". BE IT FURTHER RESOLVED that said rate schedlle shall be in effect for commercial or industrial service and residential service as of August 1, 1981.
