HomeMy WebLinkAboutReso 1981-10675 RESOLUTION NO. 10675 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA CERTIFYING EIR-78-2-A, ADOPTING CEQA FINDINGS AND STATEMENT OF OVERRIDING CONSIDERATIONS FOR EAST H STREET EXTENSION The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the City of Chula Vista proposes street improvements along the East "H" Street alignment as delineated on the El Rancho del Rey Specific Plan, and WHEREAS, a preliminary draft Environmental Impact Report was prepared by the Environmental Review Section of the Planning Department based on technical reports submitted to the Department or otherwise available, and WHEREAS, the Environmental Review Committee of the City of Chula Vista issued the draft Environmental Impact Report for public and agency review and legal notice of the availability of the draft Environmental Impact Report was given through public- ation in a newspaper of general circulation and a notice of completed was filed with the Secretary of Resources for the State of California, and WHEREAS, the Planning Commission of the City of Chula Vista held a public hearing on the adequacy of the draft Environ- mental Impact Report and a response to all letters of input and testimony at the public hearing was incorporated into the Environmental Impact Report, and WHEREAS, in accordance with the policies of the State of California, the City of Chula Vista may approve a project which has a significant Environmental Impact only if findings are made which would mitigate those substantial and adverse affects and a statement of overriding considerations has been adopted. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista finds that Environmental Impact Report EIR-78-2-A on the proposed extension of East "H" Street has been prepared in accordance with the California Environmental Quality Act of 1970, as amended, the California Administrative Code, and the Environmental Review Policy of the City of Chula Vista, and hereby certifies that it will consider the information in the Environmental Impact Report as it makes a recommendation on the project. BE IT FURTHER RESOLVED that the City Council does hereby adopt the following findings in relation to the proposed project affecting specified Environmental Impacts: 1. Biology: Measures are being taken to transplant sensitive plant species which will avoid significant impact. 2. Geology and Soils: Implementation of the project will follow standard development regulations and the recom- mendations of a soils engineer which will mitigate any significant impact. I I I I ! 1 -1- 3. Paleontology: The presence of a paleontologist during the grading of the property to recover any resources will avoid any significant impact. 4. Land Form Alteration: The proposed grading is necessary to provide safety protection and vehicular circulation throughout the El Rancho del Rey area and much of the eastern Chula Vista planning area. Alternative street alignments to the east of I-80S have been studied and found to be technically infeasible due to traffic safety and land use considerations. (Reference: Rice Canyon Development/Conservation Guide Sedway/Cook 1977). BE IT FURTHER RESOLVED that the City Council does here~ adopt the following overriding considerations: 1. The proposed project will provide a connector link to the Southwestern College area upon the completion of H Street, which would reduce the existing traffic congestion and the heavy traffic on Telegraph Canyon and Bonita Road and be a major convenience to residents in the Southwestern College area. 2. The project is part of the implementation of the El Rancho del Rey specific development plan which will: preserve substantial amounts of natural open space, safety treat geologic and soils problems, reduce land form alteration and reduce erosion and siltation.
