HomeMy WebLinkAboutReso 1981-10640 Revised 9/29/81 RESOLUTION NO. 10640 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ORDERING THE PRICE CLUB REORGANIZATION INVOLVING ANNEXATION TO THE CITY OF CHULA VISTA AND THE DETACHMENT OF THE TERRITORY FROM THE SAN DIEGO COUNTY FLOOD CONTROL DISTRICT-ZONE 3, THE MONTGOMERY FIRE PROTECTION DISTRICT, THE MONTGOMERY SANITATION DISTRICT AND COUNTY SERVICE AREA NO. 62 The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, pursuant to the District Reorganization Act of 1965, commencing with Section 56000 of the Government Code, the City of Chula Vista has received a petition from the Price Company proposing a reorganization consisting of approximately 53 acres (the additional 10 acres more than the acreage specified in Resolution No. 10621, initiating the reorganization and setting a public hearing, consists of the adjacent public streets which LAFCO has included in the territory to be annexed to the City) and the City has initiated the reorganization of certain territory designated as the Price Club Reorganization consisting of the following changes of organization: 1. Annexation of territory to the City of Chula Vista as shown on Exhibit A and more particularly described on Exhibit B. 2. Detachment of territory described in Exhibit B from the San Diego County Flood Control District-Zone 3, the Montgomery Fire Protection District, the Montgomery Sanitation District and County Service Area No. 62. WHEREAS, the City has approved the boundaries of said Price Club Reorganization as shown in said exhibits, and the Local Agency Formation Commission, after conducting a public hearing on September 14, 1981, adopted a resolution approving said proposed reorganization and authorizing the City to initiate such reorganization proceedings, and WHEREAS, the City Council has conducted a public hearing on the 29th day of September, 1981 in accordance with Resolution No. 10621 to receive protests against said reorganization, and WHEREAS, sufficient protests have not been presented to deny the reorganization. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista hereby finds and determines and orders as provided in Government Code Section 56430 et seq. as follows: 1. The territory proposed for reorganization (here- inafter referred to as the Territory) is as described in Exhibit B attached hereto. 2. The description of the boundaries of the Territory conforms to lines of assessment and ownership. -1- 3. The Council does hereby approve the proposed reorganization consisting of annexation of territory described in Exhibit B to the City of Chula Vista and detachment of territory described in Exhibit B from the San Diego County Flood Control District- Zone 3, the Montgomery Fire Protection District, the Montgomery Sanitation District, and County Service Area No. 62. 4. Pursuant to Government Code Section 56340 et seq. and the resolution of LAFCO, the City of Chula Vista does herby order said reorganization . 5. The City Clerk of the City of Chula Vista be, and she is hereby authorized and directed to transmit a certified copy of this resolution in accordance with Section 56450 et seq. of the Government Code. 6. The City Council hereby certifies that it has reviewed EIR-81-4 and the findings therein, and determined that the proposed reorganization will not have a significant impact upon the environment and the City Council hereby certifies that the EIR was prepared in accordance with the California Environmental Quality Act of 1970, as amended. 7. The City Council hereby certifies that the proposed land development is in conformance with the adopted prezoning classification of C-C (Central Commercial) and I-L-P (Limited Industrial - Precise Plan) as designated by Ordinance No. 1942 adopted by the City Council on June 9, 1981. If yes, specify. any existing yes _ no bonded k-1t?b ~cJ Signature Date 'Item Ref. 13 ROSl-13 RESOLUTION OF THE LOCAL AGENCY FORMATION COMMISSION APPROVING AN A1'1ENm1ENT TO THE RESOLUTION DISAPPROVING WITHOUT PREJUDICE THE "PRICE REORGANIZATION" ADOPTED BY TEE COMMISSION ON AUGUST 3, 1981 On the motion of Co~~issioner McClellan , seconded by Co~missioner Lake , the following resolution is adopted: WHEREAS, on August 3, 1981, the Commission adopted a reso- lution disapproving without prejudice the "Price Reorganization" involving annexation to the City of Chula Vista and detachments from the Montgomery Fire Protection District, Montgomery Sani- tation District, County Service Area No_ 62 and San DiegoC~unty Flood Control District - Zone 3; and WHEREAS, on August 10, 1981, the Executive Officer received a request pursuant to Government Code Section 56275 for the amendment of the Co~ssion's August 3, 1981 resolution from the Price Company and the Chula Vista Chamber of Commerce; and WHEREAS, the Executive Officer notified all persons who testified at the August 3, 1981 hearing that the application for amendment of resolution would be presented to the Co~mission at its meeting on September 14, 1981; and WHEREAS, the Executive Officer presented the anplication for amendment of resolution to the Co~ssion at its September 14, 1981 meeting; and WHEREAS, The Commission determined to act upon such applica- tion without further notice and hearing, except that it did allow testimony from those present at the meeting; and WHEREAS, the Executive Officer of this Commission has filed his report relative to said proposed reorganization, which report has been reviewed and considered by this Commission, NOW THEREFORE BE IT RESOLVED THAT THIS COMMISSION HEREBY FINDS, DETERMINES AND ORDERS as follows: 1. That the application for amendment of the Commission's resolution of August 3, 1981 is approved. 2. Officer 01 Slid Commission R081-13 ENVIRONMENTAL SUMMARY AND FINDINGS for Significant Effects of Price Reorganization (Price Company Commercial/Industrial Development) ~ Leaq Agency: City of Chula Vista SUMMARY SOlIs Impact: On-site soils (Huerhuero loam) are extremely erodible and exhibit severe shrink-swell behavior. Mitiqation: A soils engineering study will be required prior to development of the site, and 'grading will have to conform to the City of Chula Vista's Grading Ordinance. Dralnaqe Impact: The project site is located within two drainage basins which experience frequent flooding, and the creation of impermeable surfaces on-site will increase storm run-off. Mltlaation: This potential problem can be alleviated through the design, installation and maintenance of on-and off-site storm drain systems. Aaricultural Impacts: The project site is currently fallow and is partially developed, but has in the past produced year-round toma- toes, flowers and vegetables. Though considered a significant agricultural area at one time, the site is surrounded by urban uses and appears to be no longer agriculturally viable. Mitiqation: None considered necessary due to disturbed nature of area. Noise Impacts: could increase Street. Further development of the site to connnercial uses traffic and thus ambient noise levels along Naples Mitiqation: Because the specific level of noise impact cannot be determined until precise development plans are available, this potential impact will be mitigated at the project development stage. Traffic Circulation Impacts: site could add 22,400 trips to result in some street capacity Ultimate development of the project the local circulation system, and problems. Mitiqation: Provision of dual left-turn lanes for eastbound Palomar Street, separate southland right turn lanes on Broadway, and a median break on Broadway between Naples and Oxford Streets, will provide effective mitigation for these potential impacts. .e-It?,{; 9"d Page I of 2 Fxhibit "BI! i ~ I ENVIRONMENTAL SU~tY AND FINDINGS Price Reorganization Page Two 3 FINDINGS Pursuant to Section l5088(a) of~the State ErR Guidelines, find that the mitigation measures listed above for the identified impacts have been adopted in concept by the City of Chula Vista, and that specific mitigation measures will be finalized at the time of submittal of development plans. Further find that re- sponsibility for implementation of the mitigation measures lies with the City of Chula Vista and not LAFCO because the affected resources and public facilities will be within the jurisdiction of the City of Chula Vista upon annexation. < ~~0~d Page 2 of 2 Exhibit "B" . . .
