RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CHULA VISTA ~PPROVING AN AMENDED
AND RESTATED MEMORANDUM OF UNDERSTANDING
WITH THE HOUSING AUTHORITY OF THE COUNTY
OF SAN DIEGO FOR LOW RENT PUBLIC HOUSING
The City Council of the City of Chula vista does
hereby resolve as follows:
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Chula Vista that that certain amended and restated
Memorandum of Understanding by and between the Housing Authority of
the County of San Diego and the City of Chula Vista for LOW Rent
.Public Housing, attached hereto as Attachment II and incorporated
herein by references as if set forth in full, be, and the same is
hereby approved.

BETWEEN THE CITY OF CHULA VISTA AND THE
HOUSING AUTHORITY OF THE COUNTY OF SAN DIEGO
THIS AMENDED AND RESTATED MEMORANDUM OF UNDERSTANDING, entered into this
16th day of February , 1982, by and between THE HOUSING AUTHORITY OF THE
COUNTY OF SAN DIEGO and THE CITY OF CHULA VISTA.
WHEREAS, pursuant to the authori zation of the el ectors of the City of Chul a
Vista in approving the adoption of an ordinance approving the development, construc-
tion and acquisition of low rent housing projects not to exceed 400 units and scat-
tered on sites within the City of Chula Vista for persons of low income including
senior citizens and the handicapped and in conformance with all applicable federal
rules and regulations, it is understood and agreed that the development of housing
units on scattered sites throughout the City of Chula Vista for such persons will
benefit low income persons in the Chula Vista area; and
WHEREAS, .because the units will be developed in the City of Chula Vista,
the Housing Authority of the County of San Diego desires to work closely with the
City throughout the course of development of such projects and will seek the advice
of the City at all stages of said development from the preparation of the bid
packets, the review of proposals and award of the contract for the development, to
the operation of the units; and,
WHEREAS, the City of Chula Vista now desires that 100 units of Public
Housing be constructed and operated within the corporate territorial limits of the
City of Chula Vista; and,
WHEREAS, the City of Chula Vista desires that the Housing Authority of
the County of San Diego in implementing such development consider the following
recommendations as guidelines for development:
a. All development should conform to the present zoning ordinances
and Design Manual of the City of Chula Vista and meet or exceed
the currently adopted building and safety codes.
b. No Public Housing site shall be located within 300 feet of any
other Public Housing site.
c. Ten percent of Public Housing units constructed shall be for the
handicapped.
d. For family Pub 1 i c Housi ng units, the number of units permi tted
per site shall be consistent with zoning requirements of Title 19
of the City of Chula Vista Municipal Code and shall not exceed
25 units on anyone siteo

of the City of Chula Vista Municipal Code and shall not exceed

f. The developer will be required to adhere to the same procedures
required of all other developers.
g. The City Manager or his designee shall be kept informed as
to all agreements between the Housing Authority of the County
of San Diego and U.S. Department of Housing and Urban Devel-
opment concerning ~blic Housing units in the City of Chula
Vista. In addition, the Housing Authority of the County of
San Diego shall designate said City representatives to assist
in the preparation of the bid documents including site and
design criteria and the review of proposals. The Housing
Authority of the County of San Diego shall consider a City
report relative to the selection of the builders for the
construction of said units.
h. In the event that this Memorandum of Understanding should
conflict with the intent of the Cooperation Agreement existing
between the City of Chula Vista and the Housing Authority of
the County of San Diego for the implementation of the Public
Housing Program in Chula Vista, the said Cooperation Agreement
shall prevailo

THIS MEMORANDUM OF UNDERSTANDING, entered into this 19th day
of February, 1980, by and between THE HOUSING AUTHORITY OF THE COUNTY OF SAN DIEGO
and THE CITY OF CHULA VISTA;
WHEREAS, pursuant to the authorization of the electors of the
City of Chula Vista in approving the adoption of an ordinance approving the
development, construction and acquisition of low rent housing project, not to
exceed 400 units and scattered on sites within the City of Chula Vista for persons
of low income including senior citizens and the handicapped, and in conformance
with all applicable federal rules and regulations, it is understood and agreed
that the development of housing units on scattered sites throughout the City of
Chula Vista for such persons will benefit low income persons in the Chula Vista
area; and,
WHEREAS, because the units will be developed in the City of
Chula Vista, the Housing Authority of the County of San Diego desires to work

Chula Vista as detailed in Title A of the Chula Vista
Municipal Code and shall not exceed 25 units. No site
should be located within 300 feet of any other Public
Housing unit sites. Ten percent of the units con-
structed should be for the handicapped.
c. The City of Chula Vista shall not provide any offsite
improvements and the developer will be required to
adhere to the same procedures required of all other
developers.
d. The City Manager or his designee shall be kept in-
formed as to all agreements between the Housing
Authority of the County of San Diego and the U.S.
Department of Housing and Urban Development concerning
a City report relative to the selection of the devel-
opers for the construction of said units.
e. The City of Chula Vista and the Housing Authority
of the County of San Diego shall enter into said
Memorandum of Understanding concurrently with said
Cooperation Agreement. In the event the 1'1emorandum
of Understanding conflicts with the intent of the
Cooperation Agreement, the Cooperation Agreement
shall prevail.
