HomeMy WebLinkAboutReso 1981-10582 RESOLUTION NO. 10582 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA INITIATING REORGANIZATION PROCEEDING FOR THE PROPOSED ADMA COMPANY/PEPPER TREE ESTATES REORGANI- ZATION UNDER THE PROVISIONS OF THE DISTRICT REORGANIZATION ACT OF 1965 The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the City of Chula Vista desires to initiate the reorganization of certain territory in the unincorporated area of the County of San Diego designated as the ADMA Company/Pepper Tree Estates Reorganization, and WHEREAS, the Local Agency Formation Commission after conducting a public hearing on July 13, 1981, adopted a resolution approving such proposed reorganization and pursuant to Government Code Section 56271.1 authorized the City of Chula Vista to initiate said reorganization proceedings in compliance with Government Code Section 56430 et seq. and the terms and conditions of the LAFCO resolution, and WHEREAS, the lands in question are located in the south- easterly quadrant of the intersection of Pepper Tree Road and Hilltop Drive in the unincorporated territory of San Diego County consisting of six parcels of private property and a portion of the Pepper Tree Road right of way and at the time of application for annexation, the existing prezoning was R-I-IO (10,000 sq. ft. minimum lot size), adopted by Council on October 5, 1971, Ordinance No. 1363, and WHEREAS, on April 6, 1981, Mr. Nathan Adler, president of ADMA Company, Inc. submitted to the City a petition for a reorgani- zation involving annexation of approximately 10 acres of land to the City and detachments from the San Diego County Flood Control District-Zone 3 and the Bonita-Sunnyside Fire Protection District, and WHEREAS, the proponent is requesting annexation to the City in order to obtain an increased level of municipal services over that which is currently provided in the County of San Diego and on June 9, 1981, the City Council approved the tentative subdivision map for this project, and WHEREAS, the City Council, at their meeting of June 9, 1981, adopted resolutions approving the environmental impact report for this project (EIR-81-2) and associated CEQA findings. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby set Tuesday, the 25th day of August, 1981, at the hour of 7:00 p.m. in the Council Chambers of City Hall, 276 Fourth Avenue, Chula Vista, California as the time and place to receive protests against said reorganization. -1- BE IT FURTHER RESOLVED that any interested person desiring to make written protest against said reorganization shall do so by written comrrunication filed with the City Clerk not later than the hour set for hearing and a written protest by a landowner shall contain a description sufficient to identify the land owned by him; a protest by a voter shall contain the residential address of such voters.
