Home My WebLink AboutReso 1981-10570 RESOLUTION NO. 10570 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING AGREEMENT FOR SALE OF PROPERTIES TO OTAY WATER DISTRICT AND AUTHORIZING THE MAYOR TO EXECUTE QUITCLAIM DEEDS AND ACCEPTING AN EASEMENT FOR ACCESS PURPOSES FROM OTAY WATER DISTRICT The City Council of the City of Chula Vista does hereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that that certain agreement between the City of Chula Vista and the Otay Water District, for the sale of property to Otay Water District, dated the 28th day of July 1981, a copy of which is attached hereto and incorporated herein by reference as if set forth in full, be, and the same is hereby approved. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized to execute the quitclaim deeds as stipulated in said agreement. BE IT FURTHER RESOLVED that the City Council of behalf of the City of Chula Vista does hereby agree to accept the grant of easement for road purposes as indicated in said agreement. DATED City Clerk AGREEMENT FOR SALE OF PROPERTIES TO OTm WATER DISTRICT AND AUTHORIZING THE MAYOR TO EXECUTE QUITCLAIM DEEDS AND ACCEPTING AN EASEMENT FOR ACCESS PURPOSES FROM OTAY WATER DISTRICT THIS AGREEMENT, entered into this 28th day of July , 1981, by and between the CITY OF CHULA VISTA, a municipal corpora- tion, hereinafter called "CITY" and the OTm WATER DISTRICT, hereinafter called "DISTRICT"; ----------- WIT N E SSE T H : WHEREAS, the City Owns in fee a strip of property approximately fifteen feet (15') in width by one hundred ninety four feet (194') in length along the northerly edge of the drainage channel on the north side of Telegraph Canyon Road easterly of Paseo del Rey and will acquire an additional triangular piece of property at the intersection of Pas eo del Rey and Telegraph Canyon Road easterly of Paseo del Rey, which property is excess to the needs of the Ci ty for the develpment of the drainage channel, and WHEREAS, the Otay Water District proposes to construct a customer service collection center on the parcel immediately adjacent to said City-owned properties, and WHEREAS, District desires to purchase from City those excess parcels to incorporate it into its customer service collection center development, and WHEREAS, the City is willing to dispose of said property to District at the square foot price which the City paid in exchange for a drainage easement for said property to facilitate continued maintenance of the drainage channel as well as an access easement to serve certain other City-owned property in the vicinity. NOW, THEREFORE, IT IS MUTUALLY AGREED by and between the parties hereto as follows: 1. City shall prepare a quitclaim deed to that certain strip of land along the northerly edge of the drainage channel on the north side of Telegraph Canyon easterly of Paseo del Rey, as more particularly shown on the plat attached hereto as Exhibit "A" and incorporated herein as if set forth in full, reserving in said quitclaim a drainage and access easement for the property to be conveyed. 2. District agrees to pay the sum of $2.56 per square foot for said property estimated to be approximately seven thousand, five hundred dollars ($7,500). 3. City agrees to prepare an additional quitclaim deed for the triangular piece of property located at the intersection of Telegraph Canyon Road and Paseo del Rey easterly of Paseo del Rey if and in the event that the City acquires said property as a part of the settlement of the condemnation action presently pending between the City of Chula Vista and Telegraph Canyon Group, Inc.
