HomeMy WebLinkAboutReso 1981-10556 Form No. 341 Rev. 2-79 RESOLUTION NO. 10556 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING THE TENTATIVE SUBDIVISION MAP FOR CHULA VISTA TRACT 81-8, LANSDOWN VILLAS The City Council of the city of Chula Vista finds as follows: That in accordance with the attached Negative Declara- tion, IS-81-32 , and the findings therein, the proposed tentative map will not have a significant impact upon the environment, and the City Council hereby certifies that the Negative Declaration was prepared in accordance with the California Environmental Quality Act of 1970, as amended. The City Council of the City of Chula vista does hereby resolve as follows: WHEREAS, the Planning Commission of the City of Chula Vista has heretofore approved that certain tentative map of a subdivision to be known as Chula Vista Tract 81-8, Lansdown Villas and has recommended that the City Council approve said tentative map subject to the conditions contained in Planning Commission Resolution No.PCS-81-8 ,adopted on the 24th day of June 1981, a copy of which is attached hereto and by this reference made a part hereof the same as though fully set forth herein. PCS-81-8 RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO THE CITY COUNCIL THE APPROVAL OF THE TENTATIVE SUBDIVISION MAP FOR CHULA VISTA TRACT 81-8, LANSDOWN VILLAS WHEREAS, a tentative subdivision map for Chula Vista Tract 81-8, Lansdown Villas, was filed byB & G Investments to subdivide two parcels containing 0.7 acres into a one lot condominium project consisting of 20 two bedroom units, and WHEREAS, Section 66473.5 of the State Map Act provides that approval of a subdivision map shall be based upon findings of consistency between the subdi- vision map and the adopted general or specific plan for the area, and WHEREAS, the Planning Commission set the time and place for a public hearing to consider said tentative map, and notice of said hearing, with its purpose, was given by the publication in a newspaper of general circulation in the city at least 10 days prior to the date of said hearing, and WHEREAS, a hearing was held at said time and place, namely 7:00 p.m., June 24, 1981, in the Council Chambers, 276 Fourth Avenue, before the Planning Commission and said hearing was thereafter closed, and WHEREAS, the Planning Commission found that the project will have no signif- icant environmental impact and adopted the Negative Declaration on IS-81-32. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: From facts presented to the Planning Commission, the Commission finds that the tentative subdivision map for Chu1a Vista Tract 81-8, Lansdown Villas, is in conformance with the City's General Plan, based on the following: 1. The site is physically suitable for residential development and the proposed development conforms to all standards established by the City for such project. 2. The design of the subdivision will not affect the existing improvements-- streets, sewer, etc.--which have been designed to avoid any.serious health problems. 3. Approval of the project will not adversely affect the public service needs of residents of the city or available fiscal and environmental resources. 4. The subdivision is consistent with the General Plan Elements as follows: a. The project is within an urbanized area of the city where all of the improvements have been installed. The project will not affect the following elements of the General Plan: Land Use, Circulation, 1l-lrJ!,56 Seismic Safety, Safety, Noise, Scenic Highways, Bicycle Routes, Public Buildings, conservation, Parks and Recreation, and Open Space. b. Housing Element - The construction of condominium units will provide an expanded choice of home ownership by increasing the number of units available on this site from four to twenty. - /- BE IT FURTHER RESOLVED: That the Planning Commission recommends that the City Council approve the tentative map for Chula Vista Tract 81-8, Lansdown Villas, subject to the follow- ing conditions: 1. The developer shall enter into an agreement with the City not to protest the formation of a future 1911 (or other) improvement district to widen Vance and Roosevelt Streets. The agreement shall be binding upon subsequent owners. 2. The developer shall obtain a construction permit for the following improvements prior to approval of the final map: a) Remove all existing driveways. b) Construct curb and gutter along Vance Street where driveways are remo ved . c) Reconstruct curb and gutter along Roosevelt Street adjacent to the property. d) Construct driveways as shown on the tentative map. e) Remove and replace approximately 12 feet of depressed sidewalk along Vance Street. 3. The developer shall grant to the City an 8 foot street tree easement along Vance Street and along Roosevelt Street. 4. The developer shall comply with the conditions set forth by the Design Review Committee prior to the issuance of any building permits. 5. Prior to the issuance of building permits the applicant shall fw'nish evidence to the City that the school districts are able to provide services to the future residents of the subdivision. The Planning Commission directs that this resolution be forwarded to the City Council and a copy be sent to the applicant.
