RESOLUTION NO. 10546
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA ADOPl'ING REGULATIONS FOR CANDHi\.TES FOR THE
MAYOR'S OFFICE PERTAINING TO MATERIALS SUBMITTED TO
THE ELECTORATE AND COSTS THEREOF FOR THE NOVEMBER 3,
1981 CONSOLIDATED GENERAL ELECTION
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the general municipal election for the City of
Chula Vista will be held on November 3, 1981, and
WHEREAS, any candidate for the office of Mayor must file
no later than 5:00 p.m. on August 27, 1981, and
WHEREAS, at such time as nomination papers are taken out
by various candidates, said candidates may prepare a candidate's
statement on an appropriate form as provided by the City Clerk in
accordance with Section 10012 of the Elections Code of the State
of California, including the name, age, occupation of said
candidate and a brief description of no more than 200 words of the
candidate's education and qualifications, and
WHEREAS, in compliance with amendments to the Federal
Voting Rights Act of 1965 (Public Law 94-73, August 6, 1975), the
City shall pay the expense of translating the candidates'
statement into Spanish which translation shall be available in the
office of the City Clerk for anyone desiring to obtain a copy
threof.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Chula Vista that the following regulations are adopted as
the regulations of the City of Chula Vista pursuant to Section
10012 of the Elections Code of the State of California:
1. Each candidate shall be allc:wed to prepare a
candidate's statement on a form provided by the City Clerk of the
City of Chula Vista not to exceed 200 words in accordance with the
Elections Code provisions as set forth above.
2. The City does hereby accept the cost of translating
said candidates' statements which statement_shall not be sent out
with sample ballots but will be available from the office of the
City Clerk or shall be distributed by the Registrar of Voters.
3. The City Clerk shall carefully screen such statements
and shall reject any statement which makes references to partisan
poli tical affiliation which does not conform fully to the
requirements of uniformity of size, darkness and spacing of type
and which contains any obscene, vulgar, profane, scandalous,
libelous or defamatory matter, or any language which in any way
incites, counsels, promotes or advocates hatred, abuse, violence
or hostility toward, or which tends to cast ridicule or shame upon
any person or group of persons by reason of sex, race, color,
religion or manner of worship, or any language or matter the
circulation of which through the mails is prohibited by Congress.

4. The City Clerk shall reject any candidate's statement
which is not printed in a uniform print in the manner and custom
normally observed in the printing of the English language. There
shall be no italics, nor underscoring, nor capitalization of words
except as customarily observed. All candidates will be clearly
aware that the statements will be uniform and identical in
printing style to that prepared by any other candidate.
5. The City Clerk is hereby empowered to proceed in Small
Claims Court as necessary to secure payment of any sum owing to
the City of Chula Vista by virtue of the services provided herein
fifteen days following the mailing of the charges levied with
respect to the candidate's statement.
6. The City Clerk is authorized to bill each candidate
providing a candidate's statement for the services set forth above
within fifteen days following the date on which the City Clerk
receives the actual cost breakdown of said printing and handling
of a candidate's statement.
7. These regulations shall apply equally to all
candidates.
BE IT FURTHER RESOLVED that the City Clerk of the City of
Chula Vista is authorized and hereby directed to undertake all
other activities necessary to comply with the provisions set forth
above.
