HomeMy WebLinkAboutReso 1981-10478 RESOLUTION NO. 10478 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ACCEPTING GRANTS OF EASEMENT FRCM JAMES E. AND MARY E. PENDLETON, ROBERT AND ALICE M. NEWQUIST AND WILLIAM F. NORTHRUP, JR. FOR GOLF COURSE PURPOSES The City Council of the City of Chula Vista does hereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that those certain grants of easement for golf course purposes executed by James E. and Mary E. Pendleton, Robert L. and Alice M. Newquist and William F. Northrup, Jr., copies of which are attached hereto and by this reference made a part hereof, the same as though fully set forth herein be, and the same are hereby accepted by the City of Chula Vista for golf course purposes. BE IT FURTHER RESOLVED that the City Clerk of the City of Chula Vista be, and she is hereby authorized and directed to record said easements in the office of the San Diego County Recorder. DATED City Clerk GRANT OF EASEMENT FOR GOLF COURSE PURPOSES FOR A VALUABLE CONSIDERATION, receipt of which is hereby acknowledged, the undersigned do hereby grant to the CITY OF CHULA VISTA, a municipal corporation, an easement for golf course use as course improvement, sod, cart path and trees and water pipe lines over, under, along and across the following described property in the City of Chula Vista, County of San Diego, State of California: The southwesterly 20.00 feet of Lot 2 in Bonita Verde Subdivision recorded as Map No. 5270 in the Office of the County Recorder of San Diego County on September 27, 1963. It is understood and agreed by the parties hereto that the Grantee shall indemnify and hold the Grantor harmless against all claims for damage or suits for loss, including costs and attorney's fees, arising from injury to any person or property or life, caused by or resulting from acts or omissions by Grantee, its successors or assigns, arising from the construction, opera- tion or maintenance of the aforementioned easement, or is using, operating or traveling over the land wi thin the hereinbefore described Grant of Easement. It is further understood and agreed by the parties hereto that the aforementioned easement for golf course purposes shall be in full force and effect to and until such time as the City or its successor in interest shall cease to utilize the easement for golf course purposes or refuse to maintain the easement for such use at which time said easeraent shall be extinguished and shall be of no further force and effect.
