(4/5ths Vote: Yes_Noll ITEM TITLE: a) SUBMITTED BY: REVIEWED BY: In order to initiate the proceedings for the formation of open space districts the City Engineer must prepare and file a report in accordance with the Streets and Hi ghways Code. These reso 1 ut ions wi 11 begi n the process for the formation of open space districts for Canyon View Homes and Otay Rio Business Park. RECOMMENDATION: that Council adopt resolutions a and b. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: Accordi ng to Art i cl e 1, Chapter 2, Part 2 of Di vi s i on 15 of the Ca 1 Horni a Streets and Hi ghways Code, also known as the "Landscapi ng and Light i ng Act of 1972", proceedings for the formation of an assessment district must be initiated by resolution. The resolution must: 1. Propose the formation of the district pursuant to the above referenced Part of the Landscaping and Lighting Act. 2. Descri be the improvements. 3. Describe the proposed assessment district and specify a distinctive designation for the district. 4. Order the City Engineer to prepare and file a report in accordance with Article 4 of Chapter 1 of the Landscaping and Lighting Act. The districts proposed to be formed are Canyon View Homes and Otay Rio Business Park. The City Engineer will prepare the reports for Council's consideration and approval. All of the staff costs will be included in the districts assessments. 10-1 Page 2, Item 10 A-B Meeting Date 5/28/91 A public hearing will be held at a later date to confirm the assessments. Otay Rio Business Park On July 28, 1987 Resolution 13173, the City Council approved the tentative map for Chula Vista Tract 87-6 Otay Rio Business Park Subdivision and on September 19, 1989 by Resolution 15313 approved the final map for Unit 1 of said subdivision (Map No. 12458). One of the conditions of approval of the tentat i ve map requi red the subdi vi der to request the formation of an open space mai ntenance d i stri ct for phases 1 and 2 pri or to recordat i on of the first final map. The developer requested the formation of said district in a letter dated September 15, 1989. The proposed designation for this district is Open Space District No. 23 (OSD 23). Initially, the open space areas to be maintained are the slopes adjacent to Otay Valley Road designated as lots A, B, and C on map 12458 (Unit 1) and the landscaped street medians within that unit (see Exhibit A). The boundary of OSD 23 is the boundary of Chula Vista Tract 87-6 Units 1 and 2 and will be presented in detail in the engineer's report. The improvements to be maintained are the landscape planting, perimeter walls and irrigation facil ities within the open space lots and street medians. Additional open space areas and corresponding improvements will be incorporated in the district as additional phases are developed. Canyon View Homes On August 9, 1988 by Resolution 13726 Council approved the tentative map for Canyon View Homes, Chula Vista Tract 88-8 and also approved the corresponding final map (Map No. 12507) on October 27, 1989 by Resolution 15369. One of the conditions of approval required that the open space lots created by the map be included within an open space maintenance district. The proposed designation for this district is Open Space Maintenance District No. 24 (OSD 24). The open space areas to be maintained are generally the highly visible slopes adjacent to East 'H' Street and Rutgers Avenue designated as lots 'C', 'D', 'E', and 'H' of the final map of the subdivision (see Exhibit B). The boundary of the district corresponds to the boundary of Chula Vista Tract 88-8 and will be detailed in the Engineer's report. The improvements to be ma i nta i ned are the 1 andscape plant i ngs, perimeter walls irrigation and drainage facilities within the open space lots. It is the City's intent to form the open space district at this time. However, the di stri ct wi 11 not be activated unt il such time the City Counci 1 determines that it is necessary to do so. Meanwhile, the maintenance of said open space lots 'C', 'D', 'E', and 'H' will be done by the homeowner's association. In order to do this the open space lots which were granted and accepted by the City at the time of final map approval will be deeded back to 1D ~2. Page 3, Item ~ J9-~ Meeting Date 5/28/91 the homeowner's association. The association will in return provide an i rrevocabl e offer to dedi cate said lots to the City. The lots waul d be accepted and the district activated at a future date if citizen complaints or staff observations indicate that the home owners are not maintaining the 1 andscapi ng to Council's sat i sfact ion. There woul d be a publ i c heari ng to accept input from owners of the subject properties. It will also be necessary to revise the CC&R's for this development to include a requi rement for the maintenance of the open space lots and a statement indicating that the City has the right to form and activate the open space district at any time. The developer estimates that the annual cost of maintaining the slopes will be approximately $400 per unit. FISCAL IMPACT: None, the cost of preparing the report and spreading the maintenance costs will be absorbed by the property owners in their assessment.
