This will transmit the agenda and related materials for the regular City Council
meeting scheduled for Tuesday, May 28, 1991. Comments regarding Written Communications
are as follows:
5a. IT IS RECOMMENDED THAT JAMES STEVENS' LETTER OF RESIGNATION FROM THE RESOURCE
CONSERVATION COMMISSION BE ACCEPTED WITH REGRET AND THAT A LETTER OF APPRECIATION
BE SENT. .
5b. This is a request from a property owner on Fifth Avenue seeking a reduction
in the standard fees a property owner must pay when they connect to the
public sewer. The fee in this instance is currently about $3,250, as indicated
in his letter.
Mr. Lancaster's property is located within the second phase of street improvements
planned for Fifth Avenue, not within the area currently under construction.
Staff cannot recommend consideration of waiving any of the normal sewer
hookup fees but will study the possibility of advancing the cost of installing
sewer laterals to all adjacent unsewered parcels as a part of the street
improvement project in order to avoid in the future the necessity to excavate
the newly installed improvements each time a sewer connection is requested.
The cost of this work could be reimbursed at the time an adjacent property
owner requested a permit to connect to the public sewer. At this point,
we have not had an opportunity to research the number of properties that
are not connected to the sewer, but that analysis will be made and at some
future date the City Council will be apprised of the number of affected
properties and, at that time, will have an opportunity to determine whether
or not the installation of the sewer laterals should become part of the
street improvement project. Staff believes, although we may be incorrect,
that the number of unsewered properties is probably quite limited but, notwithstanding
this possibility, serious consideration should be given to installing sewer
laterals as part of the street improvement project. IT IS THEREFORE RECOMMENDED
THAT r~R LANCASTER'S REQUEST FOR WAIVER OF FEES BE DENIED BUT HE BE ADVISED
OF OUR INTENTIONS TO CONSIDER INSTALLING HIS, AS WELL AS ALL. SEWER LATERALS
AS PART OF THE STREET IMPROVEMENT PROJECT.
5c. IT IS RECOMMENDED THAT THE CLAIMS AGAINST THE CITY FILED BY MARIANNA NAVARRO
AND TONI DEMLER BE DENIED.
NOTE:
At its meetiny on May 21, 1991, the City Council asked staff to investigate
solutions regarding a potentially unsafe situation at the Rienstra
Sports Complex on Max Avenue and to respond at your May 28th meeting.
Staff has not had sufficient time to investigate the various alternatives
and associated costs but will be prepared to respond at Jour June 4.

Mayor Moore,
There is a project that is currently underway in City Planning and City Engineering for the street
improvements on Fifth Avenue between Naples Street and Orange Avenue. My underSlanding is that this
project is funded by a gas tax imposed several years ago and the street improvements should be underway
in August of 1991. I have recently given an easement to the City of Chula Vista for a handicap ramp and
relocation of the traffic signal at the comer of Palomar St. and Fifth Avenue. I have been equitably
compensated for the easement that the city required.
My concern is that I would like to connect to the city sewage system, but the cost is quite expensive. I
was quoted by City Engineering a cost of $3250 for city fees. I talked with Shale Hanson in City
Engineering to see if there was some way we could coordinate the sewer connection with the street
improvements, and possibly reduce the cost of the connection. He stated tbat the city could not reduce
the cost by coordinating the projects.
In past conversations with the engineering and planning departments. it has been my impression that the
city would like to see all properties brought up to code (this includes ridding the city of all septic
systems). However, there is very little incentive to do so. I see this project as a prime opportunity to
convert to city sewer not only my house, but all houses within this project. In my situation, I am going
to be forced (due to financing) to wait until project completion to convert to city sewage. This means
that the new street, curb, gutter, sidewalk and retaining wall will need to be tom out in order to bring the
lateral over to the property line. If the city would offer a reduced fee for connection to city sewer, there
would be incentive to convert at the time of the improvements.
Can the city provide some reduction in cost for converting from septic to city sewer for the project along
Fifth A venue? Please contact me if you have any questions or comments regarding this situation.

On April 22, 1991, a claim within the jurisdiction of the Superior
Court was filed against the City of Chula vista, by Ms. Marianna Navarro,
in connection a single car rollover accident on October 23, 1990, in the
800 Block of Telegraph canyon Road. The claim alleged that the City
created a dangerous condition in regard to the construction underway at the
time by Cass Construction Company. Allegedly, Ms. Navarro was confused by
roadway markings and operated her vehicle in a lane which was closed for
traffic and under reconstruction.

On April 19, 1991, Ms. Toni Demler filed a Claim Against the city
in the amount of $20,534.89. The Claim was filed on behalf of Ms. Erin D.
Demler, a minor, who was injured when a vehicle struck her bicycle at "E"
and Jefferson streets, on October 23, 1990. The Claim alleged the City is
responsible because it failed to provide a crosswalk, allowed inadequate
road markings, inadequate traffic controls, etc.
