This is a letter and petition from Sam Mullis concerning safety problems along Rainer Court and Max Avenue. IT IS RECOMMENDED THAT THIS LETTER BE REFERRED TO THE SAFETY COMMISSION AND TRAFFIC ENGINEERING FOR STUDY AND REPORT BACK. Sc. This is a request to waive fees associated with an application for an extension of the conditional use permit allowing a trailer to be used as temporary office space and present office structure to be used as temporary youth office meeting room for the South Bay Baptist Curch at 960 Fifth Avenue. Based on a policy adopted by the City Council in November 1987, this request meets the criteria set forth in that policy for waiver of fees and IT IS THEREFORE RECOMMENDED THAT ALL FEES BE WAIVED. Attorney at Law P. O. Box 1831 San Diego, CA 92112 On April 22, 1991, San Diego Gas & Electric filed a claim against the City of Chula vista for indemnity in connection with litigation brought against them by Vernon and Jean Pendergraft in connection with the death of their child, Pamela, on January 26, 1990. Claims against the city were previously filed by the Pendergrafts and were denied by the City Council on July 24, 1990. It is the recommen- dation of counsel for the City, Daley & Heft, concurred in by the city Attorney's office, Risk Management and our claims administrators, Carl War- ren & Company that this claim be denied. Claimant No.2: Mr. Saul Torres c/o Joseph V. O'Leary, Esq. Attorney at Law Chula Vista, CA 91910 On April 12, 1991, Mr. Saul Torres filed a claim for an amount within the jurisdiction of the Superior Court. The claim alleged a dan- gerous condition of roadway on the bridge between National City and Chula Vista, which caused personal injuries to Mr. Torres in connection with a bicycle accident on December 10, 1990. Due to remote liability on the part of the City, and the fact that the location of the accident is outside the city Limits of Chula Vista, it is the recommendation of the City's claims administrators, Carl Warren & Company, concurred in by Risk Management, that the claim be denied. Patterson & Assoc. 3131 Camino Del Rio North, suite 500 San Diego, CA 92108 On April 17, 1991, a claim was and Ms. Eva Anton for indemnity in against them by Ms. Ana Arciniaga. personal injuries in connection with a filed on behalf of Mr. Jose Anton connection with litigation brought Ms. Arciniaga allegedly sustained sidewalk trip and fall. Ms. Arciniaga presented by operation of law on December Heft, recommends denial of this in by our claims administrators, a Claim against the city which was denied 14, 1990. The city's counsel, Daley & claim and that recommendation is concurred Carl Warren & Company and Risk Management. Claimant No.4: Claimant No.5: Claimant No.6: Ms. Barbara Mahal Ms. Jennifer K. Mahal Ms. Lara K. Mahal c/o Law Offices of Al Van Slyke 1145 lOth Avenue San Diego, CA 92101 On April 10, 1991, claims within the jurisdiction of the Superior Court were filed against the city by Ms. Barbara Mahal, Ms. Jennifer K. Mahal and Ms. Lara K. Mahal in connection with a traffic collision on October 12, 1990 near the 4300 Block of Bonita Road. The claims allege, among other things, that the City allowed faulty construction of the road- way and improper growth of plants and shrubbery in the parkway. Due to remote liability on the part of the City, it is the recommen- dation of the City's claims administrators, Carl Warren & Company, and Risk Management that these claims be denied. RECOMMENDATION: Deny the above six claims.
