RESOLUTION 1223 APPROVING AN APPLICATION FOR GRANT FDNDS FOR THE ENVIRONMENTAL ENHANCEMENT AND MITIGATION PROGRAM UNDER SECTION 164.56 OF THE STREETS AND HIGHWAYS CODE 1989 FOR THE OTAY VAI.I.bZY ROAD WIDENING AND IMPROVEMENT PROJECT - The widening of Otay Valley Road will cause the destruction of three acres of wetlands adjacent to the southerly right-of-way. The Final Environmental Impact Report for this project requires the restoration of six acres of wetland for the three acres which will be lost (a 2:1 ratio); which is typically what the State Department of Fish and Game requires for mitigation. The State currently has grant funds available for mitigation projects required for public transportation projects. The Agency is being asked to authorize submittal of an application for these funds. Staff recommends that the Agency adopt the resolution. RESOLUTION 1224 APPROVING A CONTINUATION OF THE AGREEMENT WITH SHEPPARD, MULLIN, RICHTER AND HAMPTON FOR LEGAL SERVICES RELATED TO THE PROPOSED CHULA VISTA AUTO PARK PROJECT AND TOWN CENTRE II, AND APPROPRIATING FUNDS THEREFOR : The Redevelopment Agency has contracted with Sheppard, Mullin, Richter and Hampton (S-M-R-H) to provide legal services in connection with the Bayfront, Scripps Memorial Hospital expansion, low and moderate housing issues, Chula Vista Center expansion, and the proposed Auto Park. Several of these projects have outstanding legal issues still to be resolved and the Agency is requesting the continued legal consulting services of S-M-R-H. Staff recommends that the Agency adopt the resolution authorizing the continued set. ices S-M-R-H. 4/Sth's vote required.
