JOINT PUBLIC HEARING ON AMENDMENT NIJMBER ONE TO THE SOUTHWEST REDEVELOP~ PROJECT AREA AND NEGATIVE DECLARATION IS 91-63 Councilman/Member Malcolm stated he did not own property in the old redevelopment area but did own property around it and had abstained in the past in order to avoid any appearance of a conflict. He had participated in the second area as it was over a mile away from the property. City Attorney Boogaard responded that the actions being requested of Councilman/Member Malcolm and Mayor/Chairman Nader would not place either of them in a conflict, therefore they would be allowed to participate in tonight's public hearing. Mayor/Chairman Nader stated the purpose of the hearing was to consider and act upon: 1) the proposed First Amendment to the Redevelopment Plan for the Southwest Redevelopment Project; and 2) the Negative Declaration on the First Amendment. City Attorney Boogaard entered the following documents into the record: 1) Exhibit ~A" - the affidavit of publication of Notice of the Public Hearing; 2) certificate of mailing of Notice of Public Hearing to each property owner in the Project and Amendment Areas as shown on the last equalized assessment roll; and 3) certificate of marling of Notice of Public Hearing to the governing bodies of each taxing agency with the Amendment Area. RESOLLrFION 1175 AND 1176 OFFERED BY COUNCILMAN/MEMBER MALCOLM, reading of the text was waived, passed and approved unanimously. This being the time and place as advertised, the public hearing was declared open. Minutes June 18, 1991 Page 2 Mayor/Chairman Nader outlined the order of procedure. First the staff will present the proposed First Amendment, the Negative Declaration, and other evidence and testimony; second, the City Council/Agency will receive any written comments; and third, receive any evidence or oral testimony from those prefient concerning the First Amendment or the Negative Declaration. He requested that those speaking cont-me their remarks to new comments only. City Attorney Boogaard stated the purpose of the hearing was to consider evidence and testimony for and against the certification of the Negative Declaration and adoption of the First Amendment to the Southwest Redevelopment Project. Evidence will be introduced for consideration by the City Council and Agency in connection with certain findings and determinations that will be made with respect to the Ordinance adopting the First Amendment. The findings and determinations are set forth in Section 33367 of the Health and Safety Code. Lance Abbott, Community Development Specialist, gave a brief presentation on the proposed amendment. Carlos Flores, Roenow-Spevacek Group, highlighted the major areas of blight. The primary blighting conditions found in the amendment area were: 1) the existence of structures that are aged, obsolete, deteriorated, dilapidated, of mixed character or shifting uses; 2) the existing structures show evidence of overcrowding; 3) the existence of parcels of shape and size inadequate for proper development; 4) the existence of lot layouts that are incompatible with topographic or physical conditions; and 5) the existence of inadequate public improvements and public facilities. City/Agency Attorney Boogaard entered Exhibit "D" - Agency Report to the Council into the record. Mr. Abbott stated it was the opinion of the City's Environmental Review Coordinator that the plan level EIR that was conducted for the eleven hundred acres of the Southwest Redevelopment Project was sufficient to report on the environmental impacts of this small addition. City/Agency Attorney Boogaard entered the following documents into the record: 1) Exhibit 'E" - Negative Declaration; 2) Exhibit ~F" - additional letters, comments and responses, if any, from responding agencies; and 3) Exhibit "G~ - written public communications regarding the Negative Declaration. He stated there were no public comments regarding the Negative Declaration. The written comment from MTDB requested that they be included in the project. Mr. Flores then reviewed the text of the First Amendment. City/Agency Attorney Boogaard entered the following documents into the record: 1) Exhibit "H" - First Amendment to the Redevelopment Plan for the Southwest Redevelopment Project; and 2) Exhibit "I" - the Preliminary Report. Mr. Abbott stated there were no written comments received from the public. City/Agency Attorney Boogaard entered the following documents into the record: 1) Exhibit "J" - taxing agencies' response to the First Amendment; and 2) Exhibit ~I~ - public communications concerning the First Amendment. Mayor/Chairman Nader then called for anyone from the public wishing to speak in favor of t_he First Amendment or the Negative Declaration. Minutes June 18, 1991 Page 3 Walter Wells, California School Financial Services, representing Southwest Community College District, stated they were in support of the project. The impacts upon the District were being mitigated by the extension of the provisions of the original agreement to the original area. Mayor/Chairman Nader then called for anyone from the public wishing to speak in opposition of the First Amendment or the Negative Declaration. No comments were received. City/Agency Attorney Boogaard stated that protective recitals had been added to Resolution 1177 regarding the enlargement of the PAC issues. They state that the enlargement area is so small that it does not justify enlargement of the PAC. There being no further public testimony, the public hearing was declared closed. RESOLIYI~ONS 16227, 1177, 1178, 16228 OFFERED AND ORDINANCE 2467 PLACED ON FIRST READING BY COUNCILMAN/MEMBER MALCOLM, reading of the text was waived. City/Agency Attorney Boogaard advised the Council/Agency that they could simultaneously vote on the motion as presented. Mayor/Chairman Nader questioned whether he would be relieved of a conflict of interest as specific transactions regarding property would have to come before the Council/Agency. City/Agency Attorney Boogaard responded that if it was strictly limited to the amendment area, there would not be a Financial conflict. If there is a potential conflict, staff will attempt to present it in a bifurcated manner. VOTE ON RESOLUTIONS 16227, 1177, 1178, 16228 AND ORDINANCE 2467 PLACED ON FIRST READING: approved unanimously. A. (7) Certify that mitigated Negative Declaration IS 91-36 has been prepared in compliance with CEQA, the environmental review procedures of the City of Chula Vista, and that the City Council has reviewed and considered the information in the mitigated Negative Declaration. (8) That the Joint Public Hearing be closed and final action on the proposed First Amendment to the Southwest Redevelopment Project Area Plan and mitigated Negative Declaration IS 91-36 be continued to 6:00 p.m., Tuesday, July 9, 1991.
