Study/Negative Declaration No. 92.07 and approve the waiver of Residential Construction Tax in the amount

RESOLUTION 1217 ADOPTING INITIAL STDDY/NEGATIVE DECLARATION NUMBER 92-07,
APPROPRIATING $153,000 FROM THE LOW-MODERATE INCOME HOUSING FUND MOBILE HOME PARK
(IP, AND APPROVING THE DEVELOPMENT AGRI~I~MENT BETWEEN THE REDEVELOPMENT AGENCY AND
THE SAN DIEGO COUNTY HOUSING AUTHORITY TO CONSTRUCT SIXTEEN LOW INCOME HOUSING
UNITS AT 588 ~L" STREET - On 4/11/78, the voters of Chula Vista approved an Article 34 referendum for
400 units of publicly-owned low income housing on scattered sites. To date, 123 of those units have been
build and an additional 22 units are in the construction process. The County Housing Authority is proposing
to construct a 16-unit project at 588 "L" Street with a mix of two and three bedroom townhomes for
occupancy by low and very-low income families. Staff recommends that the Agency adopt the Initial
Study/Negative Declaration No. 92-07, appropriate $153,000 from the Low-Moderate Income Housing Fund
CIP, and enter into a Development Agreement with the San Diego County Housing Authority to construct
16 townhome-type units at 588 "L" Street. 4/Sth's vote required. (Agency Resolu~on)
City/Agency Attorney Boogaard informed Council that Councilmembers/Members Malcolm and Grasser
Horton had potential conflicts. It was his opinion the Councilwoman/Member Grasser Horton could
l)articipate due to the Rule of Necessity as a 4/5th's vote was required. It was also his determination that
her position on the Board of Realtors would not preclude her from participating.
Councilman/Member Moore questioned whether there was another way to handle this without setting a
trend for waiving fees.
Chris Salomone, Director of Community Development, responded that this issue came up during the
Salvation Army project where a fee waiver was approved. There was discussion at that time regarding the
fee waiver not becoming a common practice. The fee being waived tonight is a residential construction tax
wbich goes into the general fund and is generally used for capital improvement projects on the western side
of the City, projects that are not generally funded by new development as on the eastern side of the City.
City/Agency Attorney Boogaard informed Council that there was a particular provision in the Municipal Code
to waive the residential construction tax in order to expedite the consU-uction of low and moderate-income
housing which was precisely the case before the Council/Agency. He did not feel it would be setting a
precedent in waiving fees or taxes in other cases that may appear before the Council/Agency.
City Manager/Director Goss stated the fee would not go into the general operating fund but into capital
improvements, therefore the impact would be on the CIP although it was a fairly minor amount.
RESOLUTION 16429 AND 1217 O~ BY COUN(ILMAN/MEMBER MOORE, reading of the text was
waived, passed and approved 4-0-1 with Councilman/Member Malcolm absent.
5. RESOLUTION 16430 APPROVING TAXING AGENCY AGRRRME2qTS FOR THE SOLrFI-IWEST
REDEVELOPMENT PROJECTAREA. Staffrecommends Council approve the resolution. (Council Resolution)
RESOLUTION 1218 APPROVING TAXING AGENCY AGI~R~MENTS FOR THE SOUTHWEST
REDEVELOPMENT PROJECT AREA - As part of the Southwest Redevelopment Project Area adoption, Agency
staff have negotiated agreements with affected taxing agencies for the division of future tax increment
revenues. The agreements are with the County of San diego, the Sweetwater Union High School District,
the Chula Vista Elementary School District, and the Southwestern Community College District. These
agreements constitute the mitigation for impacts that may be caused by the Agency's adoption of the
Southwest Redevelopment Project Area. Staff recommends that the Agency adopt the resolution approving

CounciimardMember Rindone stated that upon the recommendation of the City/Agency Attorney he would
not participate on this item.
Chris Salomone, Director of Gommunity Development, informed the Council/Agency that staff recommended
a continuance of this item to a special meeting on 12/10/91.
