RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF CHULA VISTA APPROPRIATING $54.473 FROM THE UNAPPROPRIATED BALANCE IN THE LOW AND MODERATE INCOME HOUSING FUND FOR PAYMENT TO THE OTAY WATER DISTRICT FOR WATER CAPACITY FEES FOR THE VETERANS HOME FACILITy_On 6/22/99, the Agency adopted a resolution approving a 1Q-year deferral agreement between the City of Chula Vista and Otay Water District for payment of developer impact fees for the Veterans Home facility. The appropriation will be paid from the Low and Moderate Income Housing Fund and represents the third and fourth installments on the deferral agreement plus the percentage increase in the Engineering News Record (ENR) Construction Cost Index. AGENCY/COUNCIL COMMENTS ADJOURNMENT The meeting will adjourn to a Closed Session and thence to an adjourned meeting of the Redevelopment Agency on August 14, 2001 at 6:00 p.m., immediately following the City Council meeting in the City Council Chambers. CLOSED SESSION Unless Agency Counsel, the Executive Director, City Councilor the Redevelopment Agency states otherwise at this time, the Agency/Council will discuss and deliberate on the following item!s) of business which are permitted by law to be the subject of a closed session discussion, and which the Agency/Council is advised should be discussed in closed session to best protect the interests of the City. The Agency/Council is required by law to return to open session, issue any reports of final action taken in closed session, and the votes taken. However, due to the typical length of time taken up by closed sessions, the videotaping will be terminated at this point in order to save costs so that the Agency/Council's return from closed session, reports of final action taken, and adjournment will not be videotaped. Nevertheless, the report of final action taken will be recorded in the minutes which will be available in the Office of the Secretary to the Redevelopment Agency and the City Clerk's Office. 6. The deferral agreement states that fees in the amount of $264,000 will be paid on an annual basis in the amount of $26,400 for a period of ten years. The deferral payment is calculated based on the deferral amount of $26,400 times one (1) plus the percentage increase in the Engineering News Record (ENR) Construction Cost Index. RECOMMENDATION That the Redevelopment Agency approve the resolution appropriating $54,473 from the unappropriated balance in Low and Moderate Income Housing Fund for payment to the Otay Water District for water capacity fees for the Veterans Home facility. BOARDS/COMMISSIONS RECOMMENDATION Not applicable. DISCUSSION The request for appropriating $54,473 from the Low and Moderate Income Housing Fund represents the third and fourth installment on the deferral agreement. The third year installment of $27,073 should have been expended from fiscal year 2000-01 funds. The fourth year installment of $27,400 needs to be appropriated into the current year Housing Division budget. Due to budgetary oversight the funds were not budgeted for fiscal year 2000-01 and 2001-02, respectively. (- ( PAGE 2, ITEM NO.: MEETING DATE: 08/07/01 FISCAL IMPACT Funds to pay the third and fourth installment in the amount of $54,473 are available in the unappropriated balance of the Low and Moderate Income Housing Fund. Currently, this fund has an available balance of approximately $5.5 million. RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF CHULA VISTA APPROPRIATING $54,473 FROM THE UNAPPROPRIATED BALANCE IN THE LOW AND MODERATE INCOME HOUSING FUND FOR PAYMENT TO THE OTAY WATER DISTRICT FOR WATER CAPACITY FEES FOR THE VETERANS HOME FACILITY WHEREAS, an June 22, 1999 the Redevelopment Agency adopted resalution 1632 approving a deferral agreement between the City of Chula Vista and the Otay Water District for payment of developer impact fees for the Veterans Home facility; and WHEREAS, the terms of the deferral agreement state that [1] the Otay Water District ("District") agrees to defer payment fram the City of $264,000 currently owed to the District; [2] City agrees to pay the $264,000 water capacity fee over a period of ten years with the first installment of $26,400 due upon execution of the deferral agreement. Payments two through ten will be based upan the first installment payment of $26,400 times one (1) plus the percentage increase in the Engineering News Recard (ENR) Construction Costs Index; and [3] the City shall have the right to payoff the balance owed at any time; and WHEREAS, the third installment payment needs to be appropriated and paid to the Otay Water District in the amount of $27,073 and the fourth installment payment needs ta be appropriated into the fiscal year 2001-02 Housing Division budget. NOW, THEREFORE, BE IT RESOLVED the Redevelopment Agency of the City of Chula Vista does hereby appropriate $54,473 from the unapprapriated balance in the Law and Maderate Incame Hausing Fund far payment to the Otay Water District far water capacity fees far the Veterans Hame facility.
