Staff has been working to construct landscape improvements in the median located east of Nirvana on Main Street (Otay Valley Road). The improvements are proposed to be conducted in two phases at an estimated cost of $400,000. The first phase, consisting of palm trees, is planned to be instalied by April 20, 2000. The second phase is planned for October 2000 and will consist of additional trees, shrubbery and ground plantings. Phase One is estimated to cost $150,000. House of Blues will fund the improvements, subject to the City reimbursement of up to $150,000. Staff proposes that the City contribution be made from unanticipated revenue from the sale of property, in addition to Redevelopment Agency funds. The Amphitheatre opened in the spring of 1998 and House of Blues purchased the amphitheatre from Universal Concerts last year. Bitterlin Development Corporation, the amphitheatre's agent, has proposed to construct enhanced landscape improvements in the median located east of Nirvana on Main Street (Olay Valley Road) (See Exhibit A). The improvements are proposed to be conducted in two phases at an estimated cost of $400,000. The first phase, consisting of palm trees, is planned to be installed by April 20, 2000. The second phase is planned for October 2000 and will consist of additional trees, shrubbery and ground plantings. This two-phase approach will allow the median to be improved for the 2000 amphitheatre and water park season. The proposed installation of palm trees is a departure from the existing median landscape west of Nirvana. The amphitheatre desired a grander landscape to provide a signature element for the area. Phase one is planned to be completed in time for the Jimmy Buffet concerts April 20 and 22, 2000. Phase one is estimated to cost $150,000. House of Biues will fund the Phase I improvements, subject to the City reimbursement of up to $150,000. Staff proposes that the City's contribution be made from unanticipated revenue from the sale of property. The second phase improvements will cost an additional $250,000 and staff is currently reviewing various funding sources for these improvements. That the City Council and Redevelopment Agency approve the reimbursement of up to $150,000 to House of Blues for landscape median improvements and authorizing the Mayor to execute a reimbursement agreement in a form approved by the City Attorney. Not applicable. c::l-I T' - ~ PAGE 2, ITEM- MEETING DATE 03/28/00 As mentioned above, the amphitheatre opened in the spring of 1998. Bitterlin Development Corporation proposed that the landscape median running east from Nirvana be improved with queen palms that were uplit in the evening. The enhanced landscape wouid serve as a gateway for the water park and amphitheatre area. After much discussion with staff, the proposal for the landscape median will ultimately include palm trees, aiders (a deciduous tree), shrubberies, ground cover, lighting and the irrigation and drainage system. Bitterlin proposed to do the Phase 1 improvements in order to complete Phase I by the season opener. The Phase 1 Installation will include: 45-50 fan palms with uplighting (approx. 10 foot trunk height) Drainage and electrical systems Ground cover at the west and east ends of the median Attachment Band C illustrate the Phase I improvements. The second phase improvements are estimated to cost up to an additional $250,000. Staff is currently reviewing funding resources for these improvements. The second phase will include additional trees, ground cover and shrubs, in addition to city streetlights and hardscape. Plans for Phase 2 are expected to be submitted for staff review in the next few months. Phase 2 improvements are planned to commence at the end of the concert season in October or November 2000. Staff will keep the Council/Agency apprised. Ongoing maintenance of the new improvements will be funded through an amendment to the existing open space district No. 23. The waterpark and amphitheatre property are the only parties in the district. The City's reimbursement $150,000 obligation will be contingent on obtaining property owner approval for this ongoing maintenance obligation. In order to ensure that the landscape improvement costs are appropriate, staff will require House of Blues to hire contractors through a competitive bid process. The process applied will be that used when developers are constructing public improvements and seeking reimbursement from the City's Public Facilities Development Impact Fee Fund. Staff believes that this bid process is the most analogous approach to handling this unique situation and will adequately protect the public interests. Staff is proposing to reimburse House of Blues up to the $150,000 after completion of the Phase I improvements and amendment to the maintenance district No. 23 with unanticipated revenue from the sale of property. House of Blues will be reimbursed up to $150,000 after satisfactory completion of the Phase I improvements and amendment to the maintenance district No. 23.
