CHULA VISTA, CALIFORNIA ISTM-334) PROJECT - On 4/17/02, the
Director of Public Works received sealed bids for the "H" Street
Reconstruction, 1-5 to Broadway in the City of Chula Vista, CA. (STM-334)
project. The work to be done includes but is not limited to the following:
excavation and grading, installation of curbs, gutters and sidewalks, curb
inlets and drainage pipe, pedestrian ramps, driveway approaches, corss-
gutters, Portland cement concrete pavement, asphalt concrete pavement
overlay, modification of existing traffic signals, landscape and enhanced
colored pavement, pavement striping, and other miscellaneous items of

STAFF RECOMMENDATION: Agency/Council adopt the resolution.

On April 17, 2002, the Director of Public Works received sealed bids for the "H" Street
Reconstruction, 1-5 to Broadway in the city of Chula Vista, California (STM-334) project. The
work to be done includes, but is not limited to, the following: Excavation and grading,
installation of curbs, gutters and sidewalks, curb inlets and drainage pipe, pedestrian ramps,
driveway approaches, cross-gutters, Portland cement concrete pavement, asphalt concrete
pavement overlay, modification of existing traffic signals, landscape and enhanced colored
pavement, pedestrian lights and entry monuments, pavement striping, and other miscellaneous
items of work.
RECOMMENDATION:
1. That Council accept bids and award the contract for the "H" Street Reconstruction, 1-5 to
Broadway in the City of Chula Vista, California (STM-334) project to Shiva
Construction, Inc. of San Diego, California, for $2,241,589.00.
2. That Council authorize the appropriation of additional funds in the amount of
$979,140.00 from the Transportation Sales Tax balance.
3. That Council authorize the appropriation of additional funds in the amount of
$210,000.00 from the General Fund balance.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION: Included in the FY2000-01 CIP Budget is a project for the reconstruction of
"H" Street between Broadway and 1-5. This segment of"H" Street is deteriorated and because of
several pavement overlays the road has a high crown. The improvements will include the total
reconstruction of the road with Portland Cement Concrete (PCe) pavement, traffic signal
modification at Woodlawn Avenue and "H" Street, minor drainage improvements, installation of
irrigation systems, landscaping, color concrete medians and crosswalks, pedestrian lights and
entry monuments and other miscellaneous items of work.

The preliminary design and original scope of work consisted on asphalt concrete pavement and
minor drainage improvements. When a more detailed design was done, and other options were
considered, engineering staffs decision was to rehabilitate the road with PCC pavement. The
decision to use PCC was based on many factors: the daily vehicle traffic and types of loads that
use this road were considered; to minimize the impact on area businesses and public in general,
since a PCC pavement road would require less maintenance work than a conventional asphalt
concrete would; to avoid possible conflicts with existing underground utilities since an asphalt
concrete pavement and base would require a much deeper structural section.
Because of the addition of improvement items, and changes to the scope of work, the project was
delayed a number of months. Consequentially, the original budgeted amount was no longer
adequate to complete the project. Staffs decision was to request the additional funds at the time
the contract is awarded.
The scope of work also includes traffic signals modifications, and extensive landscape, sidewalk,
and beautification items. Staff from both Public Works and Community Development worked
together on these beautification items. Since "H" Street is a major entryway into the City it will
establish a successful connection with the Gateway project.
Engineering staff and Estrada Land Planning Consultants prepared drawings and specifications.
The project was advertised and on March 13,2002, the City received sealed bids for the project.
Due to bid deficiencies, the City Council rejected bids, and directed staff to re-bid the project. On
April 17, 2002, the Director of Public Works received re-bids for the project.
The City received bids from six (6) contractors as follows:

The apparent low bid, submitted by Shiva Construction, Inc. Paving, Inc. is below the engineer's
estimate of$2,021,575.50 by $78,986.50.
Engineering staff has verified the references provided by the contractor and their work has been
satisfactory. Shiva Construction, Inc. is not listed as excluded from Federal Procurement

Programs (list of parties excluded from Federal procurement or non-procurement programs as of
June 14,2002). Staff has reviewed the low bid and is recommending awarding the contract with
two alternates, to Shiva Construction, Inc. of San Diego, California for $2,241,589.00.
The basis of award is the Base Bid. The Base Bid does not include any alternate bid items.
Alternate bid items are summarized below in ascending order of contractor's Base Bid amount.

Additional funds in the amount of $979,140.00 are requested from the Transportation Sales Tax
balance to cover the basic street and traffic improvements, plus $210,000.00 from the General
Fund balance to cover landscape and irrigation improvements, color pattern median, and
enhanced crosswalks.
Some of the proposed landscape and sidewalk improvements in the project require City
acquisition of right-of-way from adjacent property owners. To date, most such right-of-way has
been acquired; however, negotiations are still pending with four property owners. City staff
remains hopeful that voluntary acquisitions can be timely negotiated to allow for on schedule,
full project development. If, however, this is not the case, the construction allows for the
deletion of the affected improvements with a pro rata reduction in contract costs. If voluntary
negotiations cannot be completed, City staff may be recommending that the City Council
consider acquiring the property by means of eminent domain However, in no way does the
award of this contract precommit the City to acquire properties.

Attachment "A" is a copy of the contractor's Disclosure Statement.
Environmental Status
Categorical Exempt, Sec.: 15301 Class I (Existing Facilities). Notice of Exemption filed on
August 30, 2001. The project is exempt because involves improvements to an existing
right-of-way. There will be negligible expansion of the right-of-way in certain locations to allow
for an improved landscape strip and irrigation lines.

Wage Statement
The sources of funding for this project are Transportation Sales Tax and General Fund.
Contractors bidding this project are not required to pay prevailing wages to persons employed by
them for the work under this project.

The City Council has previously appropriated $698,000.00 for the beautification component of
this project. Staff has used $74,000.00 to cover costs associated with the landscaping and
beautification design work, which leaves a balance of $624,000.00. The total funds needed as
shown in the table above are $833,871.00. Therefore, an additional appropriation of
$210,000.00 is needed from the General Fund to cover the shortfall.
Additional funds, in the amount of $979,140.00, to cover the basic street improvements, traffic
signal modification and contingencies, need to be appropriated from the Transportation Sales
Tax balance.

The total amount of $210,000.00 will be appropriated from the unappropriated fund balance of
the General Fund. Projected repayments of outstanding debt owed by the Redevelopment
Agency to the City will have the effect of backfilling General Fund revenues expended on this
project. This outstanding debt arises from the City's contribution to repayment of the Certificates
of Participation issued for the Chula Vista Center expansion. The Agency pays down this debt
from time-to-time as Agency resources become available.
A one-year maintenance period for landscaping is included in the contract and it will be
performed by the contractor The second year maintenance is also funded by this action.
Thereafter, the improvements will require routine City street and landscaping maintenance.
Future maintenance work beyond the initial two years is estimated to cost $24,000 per year.

Vista does hereby accept the bids and award the contract for the "H" Street Reconstruction, 1-5
to Broadway in the City of Chula Vista, California (STM-334) to Shiva Construction, Inc. of San
Diego, California, for $2,241,589.00.
BE IT FURTHER RESOLVED that the City Council does hereby authorize the
appropriation of additional fund in the amount of $979,140.00 from the Transportation Sales Tax
balance to fund the basic street and traffic improvements for the project.
BE IT FURTHER RESOLVED that the City Council does hereby authorize the
appropriation of additional funds in the amount of $210,000.00 from the General Fund balance to
fund landscape and irrigation improvements, color pattern median, and enhanced crosswalks for
the project.
BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista is hereby
authorized to execute the contract in a final form approved by the City Attorney.
