by one motion without discussion unless an Agency member, a member of the public or City stuff requests that the item be

2. APPROVING AMENDMENT TO TOWN CENTRE I LAND USE POLICY..In 1977, the Agency adopted a land
use policy for the Town Centre I Redevelopment Project Area. That policy which is currently in use includes general land
use guidelines, a list of allowed uses, and a list of uses not allowed in Town Centre I. At the request of the Downtown
Business Association, staff reviewed the current policy and proposes several amendments so that the Agency will be more
responsive to current land use trends, (Community Development Director)

The meeting will adjourn to a closed session and thence to an Adjourned Redevelopment Agency Meeting on September 28,
1999 at 6:00 p.m., immediately following the City Council meeting, in the City Council Chambers.
Unless Agency Counsel, the Executive Director, or the Redevelopment Agency states otherwise at this time, the Agency will
discuss and deliberate on the following item(s) of business which are permitted by law to be the subject of a closed session
discussion, and which the Agency is advised should be discussed in closed session to best protect the interests of the City.
The Agency is required by law to return to open session, issue any reports of final action taken in closed session, and the
votes taken. However, due to the typical length of time taken up by closed sessions, the videotaping will be terminated at
this point in order to save costs so that the Agency's return from closed session, reports of final action taken, and
adjournment will not be videotaped. Nevertheless, the report of final action taken will be recorded in the minutes which
will be available in the Office of the Secretary to the Redevelopment Agency and the City Clerk's Office.

In 1977, the Redevelopment Agency adopted a land use policy for the Town Centre I Redevelopment Project Area.
That policy which is currently in use includes general land use guidelines, a list of allowed uses, and a list of uses not
allowed in the Town Centre I. There are no provisions for conditional uses.
By request of the Downtown Business Association, staff reviewed the policy. Several amendments are proposed to
update and clarify the policy guidelines and a special land use permit category is recommended to be added so that
the Agency will be more responsive to current land use trends. The Downtown Business Association, the Town
Centre Project Area Committee, and the Economic Development Commission have reviewed the proposed
amendments.
That the Redevelopment Agency:
1. Adopt the resolution approving amendments to the Town Centre I Land Use Policy attached thereto as Exhibit
"A", and
2. Determine that the Town Centre I Land Use Permit process be a pdority work item for the Town Centre I
Redevelopment Project Area and that special Agency meetings be called, as needed, to expedite the land use
permit process.
On August 18, 1999, the Downtown Business Association Board voted to recommend the proposed amendment
to the Land Use Policy.
On September 1, 1999, the Town Centre Project Area Committee voted 6-0 to recommend that the
Redevelopment Agency approve the proposed amendments to the Town Center I Land Use Policy. In addition, the
Committee requests that the Agency determine that the Special Land Use Permit process be a staff priority work item
in the Town Centre I Redevelopment Project Area and that special Redevelopment Agency meetings be called if
necessary to expedite special land use permit applications.
On September 1, 1999, the Economic Development Commission members were provided with a copy of the
proposed amendments to the Town Centre I Land Use Policy and asked to forward any recommended changes to
staff by September 8th. No changes were recommended.

In an effort to enhance the land use mix in the Downtown area, the Downtown Business Association requested that
Agency staff re-evaluate the current Land Use Policy for the Town Centre I Redevelopment Project Area. In
cooperation with the Town Centre Project Area Committee, staff reviewed the current policy and recommended the
following amendments (copy of amended policy attached at Attachment 1):
1. Add the adopted Downtown "Vision" Statement to the general statement of policy; and
2. Include a reference to the Municipal Code regulations relative to guideline ~ referring to exterior noise levels,
and
3. Revise the listings of allowed and non-allowed land uses and formally add a Special Land Use permit category.
Rather than a definitive listing of allowed and non-allowed uses, it was recommended that land use categories
be developed with a sample of "typical" uses for demonstration purposes and discretion be given to the Director
of Community Development to determine comparable uses in the future. Most retail and service commercial
uses would be allowed by dght in the Downtown and no special land use review would be required. For those
few uses that would require special review, a special land use category was added. This category will allow
uses that are out-of-the-ordinary commercial classifications but only subject to the Agency's approval by Special
Land Use Permit. This will provide the opportunity for new types of specialty businesses to develop within the
Downtown area as land use trends evolve.
The Downtown Business Association and the Project Area Committee both agreed with the proposed changes to the
existing policy. In addition, the Town Centre Project Area Committee members voted to recommend that the Agency
determine that Special Land Use Permits, when required, be considered as a pdority in the Town Centre I
Redevelopment Project Area and that special Agency meetings be called to expedite the permit process. Staff
agrees with the Committee's recommendation. To further streamline the Special Land Use Permit process, the
application form and instruction sheet have been revised and the process has been formalized (copies attached as
Attachment #2 for Agency information).
As part of the "Vision Statement" implementation strategy, staff also plans to return to the Agency later in the year
with recommendations for the development of a downtown entertainment district.
No appreciable financial impact to the Redevelopment Agency will result from the proposed Town Centre I Land Use
Policy amendment. Depending on the number of Special Land Use Permits requested, additional staff time will be
needed and; if, the Agency directs staff to call special Agency meetings to expedite the process, limited associated
administrative costs would be incurred.

The Town Centre Project Area Committee accepts the land-use goals and objectives embodied
in the Redevelopment Plan, and the developmental guidelines and concepts constituent to the
Town Cc~,'~rc Centre I Design Manual. The Committee, therefore, shall encourage the Project
Area's redevelopment into the South Bay's principal mc~cc~,t![c center for thc p~rvcy~,~c; ;f
specialty retail goods and services and the realization of the Downtown "Vision" to establish
the Downtown as the Business, Entertainment, and Social Center-Point of the Community.
In furtherance of this policy, the committee will base its land-use dcc!c!cnc c~,d
recommendations ~f~on the principles of sound city planning and community development.
The Project Area Committee, furthermore, recognizes that excellence in land-use order and
§ccd town_--scape planning are one and inseparable, and that its land-use decisions must be
coordinated with the decisions and recommendations of the Town Centre Design
Re~ie~vReview Committee--Beef~. The Committee, therefore, will require each land-use
applicant to meet the requirements of the Design Review 9o~rd Committee as a condition of
Committee approval.
B. General Policy Guidelines
1. The Committee will not approve land uses which would preclude or deter the
effective redevelopment of the Project Area.

SPECIAL LAND USE PERMIT PROCEDURAl. GUIDE
The applicant must complete the Special Land Use Permit application form. The completed application is filed
with the Community Development Department and must be accompanied by the following maps and exhibits:
Site plan
Floor plan
Elevations
Sign proposal
A daily and/or weekly profile which describes in detail the
operations and activity levels associated with the use. Note any
days or weeks when operations/activities vary, including any
special or extraordinary events or activity levels.
Completed and signed Disclosure Statement
Any other documents determined necessary by the Community
Development Department to assist in evaluating the request.
The items noted above shall include as much detail as necessary to fully explain the project and drawings must
be to scale.
Note: In accordance with City Council action of January 5, 1984, all site plans must delineate the location and
type of all existing and proposed utilities, both underground and above-ground, along with their size. The
facilities to be shown include, but are not limited to, electric transformer boxes, fuse boxes, telephone
boxes, post indicator valves and fire department connectors (standpipes), etc. All easements, including
utility easements, must also be shown.
Generally ten (10) copies of all plans and documents are required to be submitted with the application.
In addition to the above, one 8-1/2"x11" reduction and one color slide of site plans, floor plans and building
elevations must be submitted for projects that are scheduled for public hearing.

Impact Report, which will extend the time frames. Action on the conditional use permit application may not take
place until the environmental process is complete. The applicant will be informed if environmental review is

Applicants for development projects, including additions and interior/exterior remodels and some proposals
involving a change in land use, are advised that they may be required to install and/or modify on- and off-site
public and private improvements and pay impact fees. Improvements may include on-site structures, paving and
landscaping, and requirements to dedicate, improve and/or modify streets and other public facilities off-site. Fees
may include sewer, traffic and development impact fees.
The necessity for or exact extent of these requirements and fees, if any, are generally not known until an
application has been filed and reviewed by various City departments and outside agencies. Applicants are
encouraged to contact the City regarding the possibility for and the general extent of these requirements at the
earliest possible stage of project consideration. The city departments normally involved with such requirements
are the Department of Planning, Building and Housing, and Fire for private improvements, and the Engineering
Department for public improvements and impact fees.
For major projects, it is often helpful to schedule an initial meeting with appropriate City staff to review issues and
discuss possible requirements prior to formal application. These meetings can be arranged through the
Community Development Department.

RESOLUTION OF THE REDEVELOPMENT AGENCY OF
THE CITY OF CHULA VISTA APPROVING
AMENDMENT TO TOWN CENTRE I LAND USE POLICY
WHEREAS, the Redevelopment Agency adopted a Land Use Policy for the Town
Centre I Redevelopment Project Area on September 1, 1977; and,
WHEREAS, on September 1, 1999, the Town Centre Project Area Committee voted
to amend the existing Town Centre I Land Use Policy by:
1. Adding the Downtown Vision Statement to the general statement of policy,
2. Including a reference to the Municipal Code regulations relative to guideline #4 referring
to exterior noise levels, and
3. Revising the listing of allowed and non-allowed land uses and formally add a Special
Land Use permit category.
WHEREAS, the Downtown Business Association Board voted to support the
proposed amendments to the Town Centre I Land Use Policy and the Chula Vista
Economic Development Commission did not recommend any changes to the proposed
amendment; and
WHEREAS, the amended land use policy is consistent with the Town Centre I
Redevelopment Project Plan and Implementation Plan and will assist with the elimination of
blight in the area.
NOW, THEREFORE, BE IT RESOLVED by the Redevelopment Agency of the City of
Chula Vista to approve the amendment to the Town Centre I Land Use Policy as attached
hereto in Exhibit "A".
