APPROVAL OF MINUTES for the meeting of September 7, 1982 was postponed to the meeting of September 21, 1982. 2. SPECIAL ORDERS OF THE DAY (None) 3. ORAL COMMUNICATIONS a. James Matherly, 401 Oaklawn Avenue, Chula Vista, Ca. 92010, spoke against the Tijuana Trolley and referenced a speech he presented at a meeting of the MTDB the previous evening. b. David D. Curdie, 515 Glover, Apt. #6, Chula Vista, Ca. 92011, requested that the Council look into a traffic safety problem presently existing at his apartment complex. His concern was the nummber of employees from the South Bay Regional Center using the northwest corner of the parking lot and cutting across Garrett Street which is a private road. Mr. Gurdie cited the number of accidents and near-mishaps which have occurred as a result of the negligence of these drivers noting that most of the tenants in this apartment complex are elderly and many have physical handicaps. MSUC (Scott/Malcolm) to refer this to the Safety Commission for a report back so this information can be sent to the County. c. Ernest L. Robbins, 480 Elm Avenue, Chula Vista, Ca. 92011, spoke in opposition of putting parking meters in Rohr Park, Mr. Robbin~ concern was of the unemployed and elderly who cannot afford the 25~ an hour for the metered parking, especially with the recent high inflation rates. The City Manager informed the Council that this topic is scheduled for the next meeting. City Council Meetin9 - 2 - September 14, 1982 d. Mr. Pocklington, 656 Glover Place, Chula Vista, Ca. 92011, complained of an air pollution problem with SDG&E and asked the City to conduct a study on the problem. Councilman Scott noted that the City will be receiving a report on air pollution in the near future. e. Mr. Terry Cloffer, Woodlawn Avenue, Chula Vista, Ca. 92010, said he wished to speak on cardroom regulations and expressed his disappointment about people not being advised of the change in the date this item is scheduled. Council discussion ensued regarding the date to consider the cardroom ordinance. The concensus was to schedule this item for the meeting of September 28, 1982. f. Bob Maxwell, 473 Berland Way, Chula Vista, Ca. 92010; Don Record, 840 Oaklawn, Chula Vista, 92011, and Joe Garcia , 484 5th Avenue, Chula Vista, Cal 92011, spoke in opposition to the air pollution problem caused by SDG&E. Their objections were to the odors in the air from what appeared to be a "coal oil" smell; not being able to sleep comfortably at night with the windows open; and, pollution ruining homes and cars in the area. 4. WRITTEN COMMUNICATIONS (None) PUBLIC HEARING AND RELATED RESOLUTION 5. PUBLIC HEARING CONSIDERATION OF CONDITIONAL USE PERMIT PCC-83-5 TO ESTABLISH A SENIOR CITIZEN RENTAL HOUSING PROJECT AT 432-438 "F" STREET (Director of Planning) a. RESOLUTION llO06 APPROVING CONDITIONAL USE PERMIT PCC-83-5 FOR SENIOR CITIZEN RENTAL HOUSING PROJECT AT 432-438 "F" STREET This being the time and place as advertised, the Mayor declared the public hearing opened. Ken Lee, Principal Planner, explained that the City of Chula Vista Community Development Department, together with the San Diego County Housing and Con~nuni ty Development Department, i s requesting permission to construct a 5g-unit rental housing project for low income senior citizens (62 years of age and older) on approximately one acre of property at 432-438 "F" Street in the R-3 zone. The project is located on the south side of "F" Street between Fourth and Fifth Avenues and directly across from the Civic Center. The site is comprised of six parcels totaling 0.98 acres. The proposed use is a low income senior citizen rental housing project for individuals 62 years of age and older. The tenants will pay no more than 30% of their income toward rent. The property is presently owned by the City of Chula Vista but will be sold to the County of San Diego Housing Authority which will then own and operate the facili.ty. 9/14/82 City Council Meeting - 3 - September 14, 1982 THE RECOMMENDATION OF THE DIRECTOR OF PLANNING AND THE PLANNING COMMISSION IS for approval of the conditional use permit in accordance with Planning Commission Resolution PCC-83-5. Councilman Scott asked if the City contract has a reversion clause, whereby, if the developer did not provide for senior citizen housing, the property would revert to the City of Chula Vista. Dave Gustafson, Housing Coordinator, responded that HUD control s the language in the deed; the County would operate the apartments as low and moderate income housing; and there was no reversion clause until the expiration of the contract with HUD which could be extended for up to 75 years. Mr. Gustafson informed the Council of the procedures regarding low income and moderate housing regulations of HUD. Mr. Lee outlined the amenities included in the project. Councilman Malcolmm questioned the expense per unit and felt the Council and staff should look into this further. Mr. Mitch Thompson, Planner with the County Housing Authority, discussed the ratios of parking to apartment units. Councilwoman McCandli ss inquired as to the allowances made for special appliances for the elderly and was informed by Mr. Thompson that a business group was contacted by the Authority to do a study on amenities for the handicapped and elderly. Mr. Pocklington, 656 Glover Place, Chula Vista, Ca. 92011, discussed his concern of citizens paying taxes for this project. There being no further comments, either for or against, the hearing was declared closed. Councilman Malcolm noted that a breakdown indicates that the cost would be approximately $40,000 for one 550 square foot unit, which he felt was extrodinarily high. RESOLUTION OFFERED BY COUNCILWOMAN McCANDLISS, the reading of the text was waived by unanimous consent, passed and approved by the following votes: AYES: Councilmembers Cox, McCandliss, Scott Noes: Councilman Malcolm Absent: Councilman Moore CONTINUED MATTERS AND SECOND READING OF ORDINANCE 6. ORDINANCE 2003 AMENDING MUNICIPAL CODE CHAPTERS 5.15, 5.54 AND 5.58 PERTAINING TO AUTOMOBILES FOR HIRE, TAXICABS, AND TOW TRUCKS, RESPECTIVELY - Second Reading and Adoption (City Manager/City Attorney) The proposed Municipal Code changes (1) transfer of the overall processing responsibility for taxicabs from the City Clerk to the Police Department, as is already the case for automobiles for hire and tow trucks; (2) eliminates 9/14/82 City Council Meeting - 4 - September 14, 1982 the requirements for the City Council itsel f to grant taxicab certificates by authorizing the Director of Public Safety to grant taxicab certificates; (3) eliminates the current requirement that a taxicab certificate holder must register and pay a fee for all taxicabs owned by the certificate holder, regardless of whether the owner intends to operate all of the cabs in Chula Vista; and, (4) increases the public liability insurance minimum requirements. The ordinance was placed on first reading at the meeting of September 7, 1982 and is now ready for second reading and adoption. MSUC{Cox/Scott) to place the ordinance on second reading and adoption, the reading of the text was waived by unanimous consent, passed and approved unanimously. 7. REPORT OF THE CITY MANAGER Report on Program Budgeting for FY 1983/84 At the regular City Council meeting of August 3, 1982, the Council requested the City Manager to assess the advantages of instituting a program budget for FY 1983-84. Mr. Lane Cole submitted the report stating that staff has been working towards the development of a program approach to budgeting since 1980 in an effort to assist fiscal decision making and to better assess service impact on the community. While the program budget framework has been developed and is now being refined, the City Manager anticipates that the new City Manager would prefer the opportunity to work with staff in establishing the type of program budget that he/she feels will be most effective. The City Manager Recommended that Council l) direct staff to continue the development and refinement of basic program budgeting components which can be utilized within a line item approach; and 2) defer the full development and implementation of a program budget until a new City Manager is in a position to contribute to that process. MSUC{Scott/McCandliss) to accept the staff recommendations. MSUC{Cox/McCandliss) to adjourn Council ~eting to September 16 following Redevelopmerit meeting in order to consider awarding contracts on five bids received for remodeling of the Court Building. REPORTS OF CITY OFFICERS AND DEPARTMENT HEADS 8. Re~ort: Request to Support SANDAG's Policy on Offshore Petroleum Drilling (D~rector of Planning) The SANDAG Board of Directors considered Secretary James Watt's announcement of the Department of the Interior's Five-Year Outer Continental Shelf Leasing Program. Two of the proposed Lease Sales, No. 80 and No. 95, could impact the San Diego Region and are scheduled for January 1984 and January 1985, respectively. The Board directed its staff to transmit SANDAG's existing policy on offshore petroleum developmment to the Association's member cities in order to facilitate their response and input on the matter of proposed Lease Sale No. 80. 9/14/82 City Council Meeting - 5 - September 14, 1982 THE DIRECTOR OF PLANNING IS RECOMMENDING that Council oppose Lease Sale No. 80 and instruct the City Clerk to transmit a written record of this position to the Board of Directors of the San Diego Association of Governments. MS(Cox/McCandliss) to accept the staff's report. MSUC(Malcolm/Scott) to table this item. 9. Report: Recommendation to Adopt "Take Home Patrol Car" Program (Director of Public Safety) In the early 1970's the City of Indianapolis, Indiana implemented a Take Home Car Plan for patrol officers: each uniformed patrol officer had a patrol car assigned which was driven at work and to and from home. A few years ago, the City of Visalia, California conducted a thorough study on this Plan and the results of this study were so positive for the Take Home Car Plan that Visalia fully implemented the plan over two years ago. Just this year, the City of Escondido, following the lead of Visalia, went with a 'Take Home Car Plan'. Chula Vista has carefully evaluated the Visalia Plan and feels it has great merit and would like to partially implement a Take Home Car Plan. The Recommendation of the Director of Public Safety is that Council l) approve the initial phase of a "Take Home Patrol Car" Program and approve the appropriation of $16,900 to be used to buy equipment for the six (6) patrol units; 2) that Council concurrently approve increasing the patrol car fleet from 16 to 22 cars and the assignment of ll of the 22 cars to individual officers; and 3) instruct staff to return with a second and final phase proposal to fully implement a "Take Home Patrol Car" Program for the Patrol Divison. Councilman Scott stated he would like to have more information on this program regarding the cost and amount of cars needed. MSUC (Scott/Malcolm) to send the report back to staff to take into account what the cost and what the savings may be if the whole program was implemented. lO. MAYOR'S REPORT a. Appointment of Parking Place Commissioner MSUC (Cox/Malcolm) to ratify the appointment of Gary Harper as Parking Place Commissioner. b. Lafco has approved the annexation of the Blatt property south of the Price Club to the City of Chula Vista. c. The groundbreaking for the RV Park at the "j" Street Marine will take place at 12:00 noon tomorrow, September 15, with construction completion expected by February 1983. 9/14/82 City Council Meeting - 6 - September 14, 1982 MSUC (Cox/Malcolm) the Council direct staff to have someone from the City staff attend and report back on tomorrow night's public hearing of the Southern California Hazardous Waste Management Project scheduled for this Council Chamber. MSUC (Cox/McCandliss) to move the Beautification Awards banquet from the October date to sometime in February or March 1983. ll. COUNCIL CO~tENTS a. Councilman Scott noted the memo from the City Manager regarding citing trespassers at the Chula Vista Golf Course. He expressed disappointmment that the trespassers are not cited immediately but are given warning first. b. Councilman Malcolm agreed that stronger enforcement of rules on the golf course should be made. c. MSUC (McCandliss) to look into the problem of bad odors coming from the bay, whether it be the bay water or sewage.
