ORDINANCE NO. 1757 AN ORDINANCE OF THE CITY OF CHULA VISTA AP�NDING SECTIONS 19 . 36 . 030 AND 19 . 40. 030 OF TITLE 19 OF THE CHULA VISTA MUNICIPAL CODE ALL RELATIPIG TO THE INCLUSION OF CARDROOMS SUBJECT TO A CONDI- TIONAL USE PERMIT IP7 THE C-C AND C-T ZOpIES Itd THE CITY OF CHULA VISTA, AND CERTIFYING THE NEGATIVE DECLARATION . WHEREAS, a notice of the proposed negative declaration on the proposed zoning text amendment relating to the inclusion of cardrooms subject to a conditional use permit in the C-C and C-T zones in the City of Chula Vista was given in accordance with the Environmental Review Policy, and WHEREAS, the Environmental Review Committee found that tne_=pioposed: zoning text amendment would have no possible significant impact on the environment and forwarded the attached Negative Decla- ration, IS-77-41, to the City Council of the 'City of Chula Vista for their consideration, and WHEREAS, said Negative Declaration has been available to agencies having jurisdiction by law, all responsible agencies , and to the public for an adeguate period of time for their review and comment, and WHEREAS, the information contained in said negative declar- ation has been considered by the City Council of the City of Chula Vista prior to its action on the discretionary item before the City Council, NOW, THEREFORE, the City Council of the City of Chula Vista finds as follows : 1. That the City Council of the City of Chula Vista adopts as its record of this finding of no possible significant _impact the Council agenda statement on this agenda item• and all of the attach- ments thereto. ' ' 2 . That the City Council of the City of Chula Vista finds in accordance with the recommendation of the Environmental Review Committee and the attached Negative Declaration that the proposed zoning text amendment will not have' any possible significant impact on the environment, and the attached Negative Declaration, incorporated herein by reference as if set forth fully, has been prepared in accor- ' dance with the California Environmental Quality Act of 1970, as amended, 3 . That the Environmental Review Coordinator is hereby authorized and directed to file said Negative Declaration with the County Clerk of the County of San Diego subsequent to the prepara- tion of a notice of determination on this project. The City Council of the City of Chula Vista does ordain as follows : ' SECTION I : That Sections 19 . 36. 030-and 19 . 40 . 030 of Title 19 of the Chula Vista Municipal Code be , and the same are • hereby amended to read as follows : - 1 - Sec. 19 . 36 . 030 Conditional Uses . Conditional uses in the C-C zone include: A. Car washes , subject to the provisions of Section . 19. 58. 060; . � B. Skating rinks , subject to the conditions of Sec- tion 19 . 58. 040; C. Signs in excess of maximwa as established in Sec- tion 19. 36. 040 of this chapter; D. Automobile rental and towing service; E. Billiard parlors; F. Bowling alleys, subject to the provisions of Sec- tion 19. 58. 040; . G. ,Social and fraternal organizations (nonprofit) , subject to the provisions of Section 19. 58, 100; H. Trailer rentals; I . Veterinarian clinic, subject to the provisions of Section 19 . 58. 050; J. ,Unclassified uses, See Chapter 19 . 54; K. Automobile service stations , subject to the pro- visions o£ Section 19 . 58. 280; L, R-3 and R-3-G residential uses as regulated in the R-3 zoning districts; M. Cardrooms . Sec. 19. 40. 030 Conditional Uses . Conditional uses in a C-T zone include: A. Used car lots and motorcycle sales and repair, subject to the provisions of Section 19 .58. 070; B. Trailer and equipment sales and rental establish- ments and towing service; � C. Drive-in theaters, subject to the provisions of Section 19. 58 ,120 , and provided that the screen shall be so located and designed that it is not visible from adjacent thoroughfares , and said screen shall be set back not less than one hundred feet from any street or thoroughfare; D. Automobile service stations, garages for major and minor repairs, as defined herein, and car washing establishments , subject to the provisions� of Sec- tions 19. 58. 060 and 19 . 58. 280; � • E. Carpenter shop, electrical, plumbing or heating shops; F. Dance halls , subject to the provisions of Section 19 .58. 040; - 2 - S� G. Truck and trailer service, including major repair; H. Building material sales yard, not including concrete mixing; I . Automobile storage, contractor' s equipment storage yard, or storage, sale and rental of equipment commonly used by contractors; J. Signs in excess of maximum, as established in Section 19. 40. 040; K. Bait and tackle shops; ' L. Commercial recreation facilities (outdoor) ; M, Upholstery shops; N. Automobile paint and body shops; 0. Wholesale bakeries; P, Laundries, except industrial; and cleaning and dyeing plants; Q. Used clothing sales; R. Lumberyards; S, Radiator repair shops; T. Unclassified uses, See Chapter 19 . 54; U. Knitting and weaving shops; V. Cardrooms . W. R-3 residential uses as regulated in the R-3 . zoning district, subject to the provisions of Section 19. 40. 160.
