Fulasz, City Clerk of the City of Chula Vista, DO HEREBY CERTIFY that this is a full, true and correct copy of an order by the City Council at the meeting of March 24, ]983 City of Chula Vista, California MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA Thursday, March 24, 1983 Council Conference Room 4:10 p.m. City Hall ROLL CALL Councilmembers present: Mayor Cox, Councilmembers McCandliss, Scott, Malcolm, Moore Councilmembers absent: None Staff present: City Manager Goss, Assistant City Manager Asmus 1. 2% AT 50 DISCUSSION City Manager Goss commented that the City Council has been involved in this discussion for some time; however, this is new to him - as far as Chula Vista is concerned. He added that basically, this 2% at 50 workshop is an opportunity for him to be informed and learn about all the issues involved. In answer to Councilwoman McCandliss' query, Mr. Goss stated that in all the other cities he has worked in, they have had their~w~ local plan. Assistant City Manager Asmus commented that the Council had asked for this type of workshop in order to get more information concerning the request for 2% at 50 retirement for Public Safety Officers. Both the police and fire personnel have made presentations to the Council in the past. Material has now been submitted to the Council from both groups along with that from staff. Principal Administrative Analyst Marilyn Leuck and the Director of Personnel Signe Thorsen will be making the presentation to the Council this afternoon. Principal Administrative Analyst Leuck referred to the packet of information submitted to the Council explaining and discussing the bargaining process which incorporates the Myers, Millias, Brown Act; the good faith bargaining aspect; management rights; PERS retirement plan profile the four retirement plans for the safety members: 1/2 at 55 - Chula Vista's present plan, 2% at 50, 2% at 55 and the 2% at 60 which is available to the miscellaneous employees. Mrs. Leuck then referred to a chart giving the average salary of a peace officer ($1,920) for a 36-month average salary per month and the retirement benefits the officer would get under the four different plans. Also discussed by Mrs. Leuck were the comparison of retirement plans; the average major benefits of public and private retirement plans, the cost of retirement plans; the history of Chula Vista employer retirement rates and the employee City contribution ratio; the rate history of eleven selected California cities; the retirement census summary; the present service retirements in the City along with the industrial disability retirements; the retirement rates before and after the reduction of 2% at 50 plan; the manner of retirement as determined by the payout break-point and the promotional opportunities that would be available under this plan. The conclusions of the report were as follows: Council Conference - 2 - March 2~ 1983 1. Most PERS plans provide for retirement - ages 55 to 60 - 30 years. 2. 2% at 50 provides for retirement - ages 50 to 55 - 25-30 years. 3. 2% at 50 will cost approximately $400,000-$450,000 more than 1/2 at 55. 4. 1/2 at 55 is calculated on "age at entry" which would lead to significant inequities. 5. The cities current retirement plans pay at or below median income. 6. Generally, public plans pay better than private plans; however, in some circumstances social security could close the "gap". 7. PERS rates have been increasing since 1976. Similar cities having 2% at 50 have rates ranging from 24% to 33.5% - Chula Vista would fall in that range. 8. The City has no control over PERS rates. 9. Regardless of the type of plan provided - medical retirements will still occur at a substantial level. lO. As a practical matter a peace officer or fire fighter has difficulty performing the full range of his duties after age 50+. ll.Through 1988 the 2% at 50 will provide a potential for 30 police and 15 fire promotional opportunities. 12. 2% at 50 could provide an opportunity for departmental reorganization. (During the presentation Mayor Cox was called away from the Dias - 4:30-4:50 p.m.) Council discussion followed regarding the various aspects of the staff's presentation. Assistant City Manager Asmus and the Director of Personnel answered the Council's questions pertaining to the steps that an employee must take in order to get a disability retirement; all of the disability retirements now in the City are valid ones; the percentage of employees in the public safety departments that are over 50 years of age; the IRS re9ulations concerning disability retirements. A recess was called at 4:15 and the meeting reconvened at 4:30 p.m. Police Agent, Tom Basinski, presented and discussed various fact sheets and graphs declaring that the bottom line of the request for 2% at 50 is that it will cost the City approximately $400,000 a year which he indicated is not that much when you look at the entire budget. Agent Basinski stated that his message to the Council was that the City is getting good police service with not a lot of people and the City is obtaining it cheaply. He added that he hoped the Council would seriously consider the entire request and not look at it as "the big monster " Agent Basinski emphasized the high level of dedication of the police personnel. Council Conference - 3 - March 24, 1983 Fire Captains Don Scofield and Jim Dyar submitted a statistical packet to the Council which included charts and graphs. They discussed; (1) the per capita cost of fire protection in the ten larger fire departments in San Diego County notin9 that Chula Vista had a cost per capita of $30.92 with a 67.5 department size; (2) a comparison of wa9es for the ten largest fire departments in San Diego County in order of size noting the salaries of the Chief, Batallion Chief, Captain, Engineer, and Fire Fighter; (3) general statistics regarding the operation of the fire departments the number of fires, responses, the number of supressions etc. Captain Dyar noted that last year the department had one death from a heart attack and two open heart surgeries among the fire fighter personnel. A general discussion followed during the presentation regarding the number of fire fighters who will be eligible for retirement under this plan: the Council will have as much control over the 1/2 at 50 as they do now with the 2% at 55; the reasons for optin9 for the retirement rather than for an increase in salaries for both the police and fire; the mandatory age of 60 for retirement in the fire department; the secret ballot taken of the police officers in which the unanimous vote was for retirement benefits rather than the salary increase; and the request by both the fire fighters and the police for the Council to give serious consideration to their request for the 2% at 50. Mayor Cox noted all the information presented to the Council from the police, firefighters and staff. He questioned whether anyone had an exception they wished to take to any of the factual data presented today. Agent Basinski, Captains Dyar and Scofield indicated they had no disagreements with the information presented. Assistant City Manager Asmus declared that staff had no exceptions - that there may be some slight errors in the compilation of the material presented (from police and fire); however; these would be minimal and would not distort any of the facts presented to the Council. Mayor Cox thanked the police and fire representatives for the open discussion and the information presented stating that since all parties were in agreement that all the information was factual, the Council will now consider this during the budget sessions. 2. CITY MANAGER'S REPORT a. City Manager Goss stated that at 4:00 p.m today, they began letting out more water from the Sweetwater Reservoir. Mr. Asmus commented that he got a call from Golf Pro Joe Warburton concerned about the loss of playing time on the course due to the waters and the heavy rainfall. 3. MAYOR'S REPORT a. Mayor Cox announced that he will not be going to Sacramento on Friday, March 25, 1983. Council Conference - 4 - March 24, 1983 4. COUNCIL COMMENTS a. Councilman Malcolm reported that the Legislative Committee is recommending endorsement of SB 48. This concerns an 18-month period of time to study the ruling of the Public Utilities Commission (PUC) regarding new constructions which must pay their own way in supplying their own electrical power. Because of the impact it would have on Chula Vista, the Legislative Committee felt Council should support SB 48 and find out what kind of financial impact it would have on the price of housing, industrial parks, etc. MSUC (Scott/Malcolm) to support SB 48.
