RESOLUTION NO. 1172
RESOLUTION OF THE REDEVELOPMENT AGENCY OF
THE CITY OF CHULA VISTA APPROVING SEMI-
EXCLUSIVE NEGOTIATION AGREEMENT WITII
PACIFIC SCENE INCORPORATED FOR COMMERCIAL
SHOPPING CENTER AT SOUTH SIDE OF PALOMAR
STREET BETWEEN INDUSTRIAL BOULEVARD AND
BROADWAY; AUTHORIZING CHAIRMAN TO EXECUTE
SAID AGREEMENT; AUTHORIZING EXECUTIVE
DIRECTOR TO ENGAGE IN ACTIVITIES AND ENTER
INTO CONTRACTS AS NECESSARY TO DEVELOP THE
EXPANDED CENTER PLAN FOR AN AMOUNT NOT TO
EXCEED $100,000; AND APPROPRIATING $250,000
THEREFOR
THE REDEVELOPMENT AGENCY OF THE CITY OF CHULA VISTA does hereby
resolve as follows:
NOW THEREFORE BE IT RESOLVED that The Redevelopment Agency of the
City of Chula Vista does hereby approve the Semi-Exclusive Negotiation Agreement with
Pacific Scene Incorporated for a commercial shopping center at the south side of Palomar
Street between Industrial Boulevard and Broadway, attached hereto and incorporated herein
as though fully set forth. '"
BE IT FURTHER RESOLVED that the Chairman of The Redevelopment Agency
is authorized to execute said agreement.
BE IT FURTHER RESOLVED that the Executive Director of The Redevelopment
Agency is authorized to engage in activities and enter into contracts as necessary to develop
an expanded center plan as called for in said agreement for an amount not-to-exceed
$100,000, said activities and contracts to potentially include, but not be limited to:
1. Extending owner participation rights to the extent required and permitted by
law.
2. Negotiate a Disposition and Development Agreement or an Owner
Participation Agreement.
3. Hire appraisers and obtain appraisals.
4. Extend good faith offers to acquire, contingent upon Council/Agency approval
of the expanded center plan.

5. Retain such consultants and attorneys as staff finds is necessary and obtain
expertise as staff determines is necessary.
6. Obtain entry necessary to conduct on-site studies, and, if necessary, to obtain
court orders for entry.
7. Conduct such environmental studies as is necessary to comply with State and
Federal law and as will permit the Council to.evaluate the environmental
consequences.
8. Sponsor any City and/or State permitting procedures as may be necessary to
comply with law, including zoning permits as may be necessary.
BE IT FURTHER RESOLVED that unappropriated reserves of Bayfront/Town
Centre I Project Area in the amount of $250,000 are hereby loaned to the Southwest
Redevelopment Project Area and appropriated to the Trolley Center Project account.
