HomeMy WebLinkAboutReso 1974-7198 RESOLUTI~~ N0. 7198 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING USE AGREEMENTS BETWEEN THE CITY OF CHULA VISTA AND CHULA VISTA COLT LEAGUE; CHULA VISTA BOBBY SOX LEAGUE; SOUTH BAY SENIOR AND LITTLE LEAGUES; CHULA VISTA NATIONAL SENIOR AND LITTLE LEAGUES; SOUTH PONY LEAGUE; CHULA VISTA AMERICAN SENIOR AND LITTLE LEAGUES; NORTH PONY LEAGUE; PARKVIEW SENIOR AND LITTLE LEAGUES AND MISS AMERICA SOFTBALL LEAGUE, AND AUTHO- RIZING THE MAYOR TO EXECUTE SAID AGREEMENTS The City Council of the City of Chula vista does hereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED that those certain use agreements between THE CITY OF CHULA VISTA, a municipal corporation, and the Youth Baseball Leagues: CHULA VISTA COLT LEAGUE CHULA VISTA BOBBY SOX LEAGUE SOUTH BAY SENIOR AND LITTLE LEAGUES CHULA VISTA NATIONAL SENIOR AND LITTLE LEAGUES SOUTH PONY LEAGUE CHULA VISTA AMERICAN SENIOR AND LITTLE LEAGUES NORTH PONY LEAGUE PARKVIEW SENIOR AND LITTLE LEAGUES MISS AMERICA SOFTBALL LEAGUE dated the 19th day of February , 1974, copies of which are attached hereto and incorporated herein, the same as though fully set forth herein be, and the same are hereby approved. BE IT FURTHER RESOLVED that the Mayor of the City of Chula vista be, and he is hereby authorized and directed to execute said use agreements for and on behalf of the City of Chula vista. FACILITY,USE AGREEMENT THIS AGREEMENT, made and entered into by and between the City of lula Vista, a municipal corporation, hereinafter called "City", and Chula Vista Colt League a youth athletic league, hereinafter .lled "League". ~~IEREAS, the League a non-profit corporation, proposes to render lvantageous and desirable services by and through its extensive baseball ld character building programs for boys or girls living in and adjacent ) the City; and WHEP~AS, it is the desire of the City to aid and assist said League l the furtherance of its said program, the same being consistent with the _ty I S recreation programs. NOW, THEREFORE, IT IS AGREED BETWEEN THE PARTIES AS FOLLOWS: 1. TERi'1: The term of this agreement shall be for one year from January 5, 1974. II. CONDITIONS: The City shall: A. Act as liaison between the League and the Sweetwater Union High School District and/or the Chula Vista City School District, for the purpose. of procuring the use of facilities on . District property for practice and/or game sites. B. Prepare a schedule of use, showing the allocation-of school and city facilities for practice purposes. Scheduling will be done to insure that all leagues will receive equal treatment on the assignment of fields. C. Assist the League in the promotion of its program by printing and distributing information about the League and its registra- tion dates. .- The League shall: A. Adhere to all rules and regulations governing the use of City or District facilities. ~1/91 B. Abide by the assignment of practice and/or game sites prepared by the City. Field assignments will be done according to the following principals: 1. League needs shall be considered in relation to like needs of all other leagues located within the City to determine assignment of practice and/or game sites. 2. Each league will be assigned a practice and/or game site which is best suited for its particular league's needs. 3. Fields will be assigned within the geographic boundaries of leagues whenever possible. 4. At the conclusion of the registration period, practice field assignments may be adjusted according to the acutal number of teams in each league. S. Any changes in assigned schedules will require written approval from the Director of Parks arrdRecreation or a designated representative. 6. No teams will be allowed on the school facilities until 5:00 p.m. after daylight savings time commences. C. Assignment of practice areas, game sites and time schedules: LEAGUE PRACTICE AREA GAME SITE Chula Vista Colt League Bonita Vista High . School Varsity Field & Grass Area C.V. High Va.rsity Field -(After April 13) or (Southwestern Field whenever possible) D. Obtain permission to install additional facilities or make any alterations on City or District property for League use. All installations become the property of the City or the District. E. Agree to hold the City and/or the District free and harmless for any loss, claim or judgment for the injury to person or property, resulting from or arising out of, its activities, and the League shall obtain and keep in full force and effect, liability insw.:auce ~.r;/9;j in minimum amounts to be approved by the City Attorney, naming the City as a co-assured, in order to carry out the provisions of this paragraph. A certificate of said insurance shall be sub- mitted to the City Attorney for his approval and thereafter filed with the City Clerk. F. Provide for cleanup of all litter at the end of each day's activities, and place litter in the dumpsters or other receptacles provided by the City or District. G. Provide for the training of all personnel in its program, for equipping all League teams, and for supervising all activities related to practice or games. H. Provide representatives to meet with City representatives periodically as deemed necessary by the City, to review assignments or specific problems related to the use of City or District facilities. I. The terms and conditions set out herein shall not be modified without the consent of both parties and this agreement shall continue in full force and effect until terminated by either participating party. Should' the City or the District find that the use by the League interferes with the City's or District's use, the agreement may be terminated upoh 30 days written notice. J. The Director of Parks and Recreation or his miscellaneous appointed representative shall meet annually for the pur- pose of preparing a c?mprehensive schedule for the use of the City's and District's baseball fields. K. The City shall have the right after notifying the League to temporarily close their assigned baseball areas for reasons of health, safety or urgent repair. THIS AGREEMENT, made and entered into by and between the City , Chula Vista, a municipal corporation, hereinafter called "City", and SOUTH BAY SENIOR & LITTLE LEAGUES " a youth athletic league, ,reinafter called "League." WHEREAS, the League a non-profit corporation, proposes to render ivantageous and desirable services by and through its extensive baseball ld character building programs for boys or girls living in and adjacent ) the City; and WlIEREAS, it is the desire of the City to aid and assist said ?ague in the furtherance of its said program, the same being consistent ith the City's recreation programs. NOW, THEREFORE, IT IS AGREED BETWEEN THE PARTIES AS FOLLOWS: I. TERH: The term of this agreement shall be for one year from January 5, 1974. II. CONDITIONS: The City shall: A. Grant a nonexclusive use permit of City property at according to the schedule outlined in , Section "c" -' 'Field Assignments for Game Sites & Practice Areas. B. Act as liaison between the League and the Sweetwater Union High School District and/or the Chula Vista City School District, for the purpose of procuring the use of facilities on District property for practice sites. C. Prepare a schedule of use, showing the allocation of school and city facilities for practice purposes. Scheduling will be done to ins1.1re that all'leagues will receive equal treat- ment on the assignment of fields. D. Provide grounds maintenance on a year-round basis on city property, with the scheduling and type of maintenance to be determined by the Chula Vista Parks and Recreation Depar~nent~7/r~ . E. The City will assume all utility costs. (Except for concession stand) . r. THIS AGREEMENT, made and entered into by and between the City f Chula Vista, a municipal corporation, hereinafter called "City", and Leagues tula Vista American Senior & Little , a youth 'athletic league, ereinafter called "League." WHEREAS, the League a non-profit corporation, proposes to render dvantageous and desirable services by and through its extensive baseball rrd character building programs for boys or girls living in and adjacent o the City; and WHEREAS, it is the desire of the City to aid and assist said eague in the furtherance of its said program, the same being consistent ith the City's recreation programs. NOW, THEREFORE, IT IS AGREED BETWEEN THE PARTIES AS FOLLOWS: I. TERM: The term of this agreement shall be for one year from January 5, 1974. II. CONDITIONS: The City shall: A. Act as liaison between the League and the Sweetwater Union High School District and/or the Chula Vista City School District, for the purpose of procuring the use of facilities on District property for practice sites. Scheduling will be done to insure that all' leagues will receive equal treat- ment on the assignment of fields. D. Provide grounds maintenance on a year-round basis on city property, with the scheduling and type of maintenance to be determined by the Chula Vista Parks and Recreation Department. Field assignments will be done according to the following principals: 1. League needs shall be considered in relation to like needs of all other leagues located within the City to determine assignment of practice sites. 2. Each league will be assigned a practice site which is best suited for its particular league's'needs. 3. Fields will be assigned within the geographic boundaries of leagues whenever possible. 4. Any changes in assigned schedules will require written approval from the Director of Parks and Recreation or a designated representative. , 5. At the conclusion of the registration period, practice field assignments may be adjusted according to the actual number of teams in each league. 6. No teams will be allowed on the school facilities until 5:00 p.m. after daylight savings time commences. C.
