CAMPBELL, to provide cert.ain public improvements as a condition precedent to the division of land by parcel map in the City of Chula Vista dated the 29th day of January , 1974 , a copy of which is attachedhereto and incorporated herein, thesame as though fully set forth herein be, and the same is hereby approved. BE IT FURTHER RESOLVED that the City Clerk of the City of Chula Vista be, and she is hereby authorized and directed to record said agreement in the office of the San Diego County Recorder. BE IT FURTHER RESOLVED that the Mayor of the City of Chura Vista be, and he is hereby authorized and directed to execute said agreement for and on behalf of the City of Chula Vista. THIS AGREEMENT, made and entered into this ';'4 t~';I.~y pf TA"',A.~( , 1974, by and between THE CITY OF CHUL1I";V~ST~J a municipal corporation, hereinafter referred to as "City", and HARDING C. CAMPBELL, 248 Bay Blvd., Chula Vista, California 92010, hereinafter referred to as "Subdivider"; WIT N E SSE T H : WHEREAS, Subdivider, Harding C. Campbell, has heretofore filed with the City of Chula Vista a parcel map providing for the division of land, more particularly described as follows: Being a division of a portion of the Northwest Quarter of the Northwesterly Quarter of Quarter Section 162 of Rancho de la Nacion according to Map thereof No. 166 filed in the Office of the County Recorder of San Diego County, May 11, 1869 WHEREAS, in order to comply with the requirements of condi- tion no. 7b of the approval of the tentative parcel map, dated Decem- ber 7,1973 (PM 28-73), it is necessary that an agreement be entered into guaranteeing the completion of said improvements. NOW, THEREFORE, IT IS MUTUALLY AGREED by and between the parties hereto as follows: 1. The City Council hereby authorizes the City Engineer to approve the Parcel Map of that certain property described hereinabove on condition that all public improvements as required by the approval of the tentative parcel map dated December 7, 1973 (PM 28-73) be either completed or guaranteed. 2. Subdivider hereby agrees to provide necessary public im- provements as heretofore required by condition no. 7b of the approval of the tentative parcel map dated December 7, 1973 (P~\ 28-73), which condition is as follows: "7. Prior to the approval of the final parcel map: b. All public improvements shall be constructed or guaranteed." It is understood and agreed that Subdivider may defer completion of said improvements upon the execution of this agreement, provided, however, that no building permits will be issued for Parcel No. 2 of said Parcel Map until the aforementioned condition is either completed or financially guaranteed by the deposit of cash monies or the posting of necessary bond. 3.
