RESOLUTION NO. 7166
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROVING THE TENTATIVE MAP OF A SUBDIVISION
TO BE KNOWN AS ZENITH II
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the Planning Commission of the City of Chula vista
has heretofore approved that certain tentative map of a subdivision to
be known as Zenith II and has recommended that the City Council approve
said tentative map subject to the conditions as recommended in their
letter dated September 27, 1973, and
WHEREAS, said tentative map was heretofore disapproved by
the City Council of the City of Chula vista at a public hearing con-
ducted on October 16, 1973, and
WHEREAS, the Superior Court of the County of San Diego,
State of California did, on January 3, 1974, issue a Writ of Mandate
ordering the City Council of the City of Chula Vista to reconsider
the approval of said tentative map of Zenith II limiting their con-
sideration to the design elements of the tentative map and its effect
upon surrounding areas within the framework previously established by
the Council as to road circulation patterns and disregarding those
considerations relative to potential land exchanges and reorientation
of property ownerships between the City and the developer.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Chula vista that said Council does hereby approve said tenta-
tive subdivision map in accordance with the recommendations of the
Planning Commission of the City of Chula vista.

Subject: Request for approval of tentative subdivision map of
Zenith II - PCS-73-2
Following the adoption on September 12, 1973 of the City of Chula Vista's
Environmental Impact Report for the Zenith II tract (Resolution EIR-73-l2),
the City Planning Commission reviewed the tentative subdivision map for
Zenith II on September 26, 1973.
The Zenith II subdivision proposes 74 single family units on 29.6 acres,
7 of which are in the SDG&E power line easement and are considered open
space. The net density of the project is 4.5 dwelling units per acre,
which is compatible with surrounding densities and in conformance with
the General Plan.
The Planning Commission recommends approval of this tentative map subject
to the following conditions:
1. Prior to issuance of building permits the applicant shall submit to
the Planning Department, for review and approval:
a. The design of the slump block wall for lots 1, 27,46,47 and 48
along East Palomar Street. Note: Lot 48 will require a combination
of retaining wall and decorative wall because of proposed grades.
b. Solid wood fence designs for the following lots:

2. Prior to the issuance of buildin9 permits, the applicant shall submit
to the Planning Department for review, the design of the walls and berms
at the rear of lots 7-16 backing up to the 1-805 freeway. According to
the EIR adopted on September 12, 1973 by the Planning Commission, the
following dimensions shall be included in the wall design:
a. For lots 9, 10, 14, 15, and 16, a 10-12 foot noise barrier (combin-
ation of wall and berm).
b. For lots 11, 12 and 13, a 9 foot noise barrier.
c. For lots 7 and 8, a 6 foot noise barrier.
3. The lots adjacent to the 1-805 freeway shall utilize single story
dwellings whenever feasible, given site planning considerations. When a
two story structure is utilized it shall adhere to elements outlined in
Sec. 91.0706 (a), (b), and (c) of the draft of the San Diego Noise Ordin-
ance, for the achievement of a 30 dBA noise loss through the walls.
4. Specific plot plans for lot 47 shall be submitted, showing the location
and dimensions of the dwelling, orientation of the driveway, and location
of fencing.
5. The pressure regulation station, shown on lot 74, shall be placed in
an underground vault.
6. Prior to approval of the grading and landscaping plans, the applicant
shall prepare and execute an agreement (in a form suitable for recording)
guaranteeing perpetual maintenance of landscape materials on the graded
portions of lots 75 and 76. Such agreement shall be binding on any
successors and shall specify that if the slopes are not maintained to the
satisfaction of the City, that the City shall have the power to enter upon
the property, perform the necessary work and place a lien against the
property to recover costs.
7. Prior to the issuance of building permits, park fees and school fees
shall be paid in accordance with Ordinance 1492 and Resolution 6140,
respectively.
8. The following specific conditions of the Engineering Division shall
be met:
a. The developer shall construct full street improvements on all
streets within the subdivision in accordance with Ordinance No. 1369,
standard drawings and standard specifications of the City of Chula
Vista. The developer shall construct 64 feet of pavement, curb,
gutter and sidewalk on both sides of East Palomar Street. The developer
shall construct 36 feet of pavement, curb, gutter and sidewalk on both
sides of Street "Cu.

b. The strip of land lying between the easterly right of way line
of "c" Street and the subdivision boundary shall be deeded to the
City; or the street may be realigned so that the easterly right of
way line coincides with the subdivision boundary.
c. All drainage and sewer facilities shall be accessible for
maintenance operations.
d. Street structural sections shall be designed by the City Engineer
based upon "R" Value tests submitted by the developer. The minimum
structural sections shall be 3" A.C. on 4" A.B.
e. The sewer main in "8" Street shall be extended easterly to the
subdivision boundary on the easterly side of "C" Street. This sewer
shall be designed so as to serve by gravity any future development to
the east.
f. The alignment of Raven Avenue between East Palomar Street and
Street "A" will be subject to detailed approval by the City Engineer.
9. The following general conditions of the Engineering Division shall
be fulfilled:
a. All work within public right of way shall be done in accordance
with the ordinances, resolutions, standard specifications and standard
drawings of the City of Chu1a Vista.
b. Required bonds and fees:

c. Specific methods of handling storm drainage are subject to
detailed approval by the City Engineer at time of submission of
improvement plans. (General methods of hand1in9 drainage, types of
drainage facilities, and general location of easements will be shown
on tentative map.) Drainage easements shall be provided as required
by the City Engineer.
d. Water system shall be installed in accordance with the standards
of the Otay Municipal Water District and shall be maintained and
operated by said district.
e. Fire hydrants shall be installed in accordance with standard
drawing No. 115, City of Chu1a Vista.

f. Other Utilities:
Sewer - City of Chula Vista (8" V.C.P. mlnlmum lines)
Gas & Electric - San Diego Gas & Electric Company
Telephone - Pacific Telephone Company
g. Letters from utility companies will be provided to eliminate
rear and side yard easements.
h. All utilities shall be underground; easements shall be provided
as necessary.
i. Subdivider shall provide and install street light standards and
fixtures in the type and number approved by the City Engineer.
j. Curb return radii and property line radii shall be in accordance
with standard drawing 101, City of Chula Vista.
k. Grading and landscaping shall be constructed in accordance with
Ordinance No. 1455 of the City of Chula Vista.
1. Evidence shall be provided of having obtained slope rights upon
adjacent property, where required, for the construction of lot pads
and at the end of all stub streets.
m. The subdivision boundary shall be tied to the Lambert projection
for California coordinate system Zone VI. This shall be accomplished
by typing the subdivision boundary to a minimum of two established
horizontal control monuments on file in the office of the City Engineer.
This requirement may be waived by the City Engineer upon receipt of a
written request.
