RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA GRANTING APPEAL BY BALBOA BANK OF
PLANNING COMMISSION DENIAL OF VARIANCE FOR
INCREASE IN PERMITTED SIGN AREA AT 410 "H" STREET
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the Planning Commission has heretofore denied a
request for variance for the increase in permitted sign area to
Balboa Bank, located at 410 "H" street, in the City of Chula Vista,
and
WHEREAS, Balboa Bank appealed said denial to the City
Council, offering a modification of the original variance requested
as shown on Exhibit A, on file in the office of the Planning Depart-
ment of the City of Chula Vista, and
WHEREAS, said plan would allow a sign variance authorizing
a 120 sq. ft. sign on the west elevation of Balboa Bank, and an 84 sq.
ft. sign on the east elevation, and
WHEREAS, the City Council, on Tuesday, January 8, 1974,
conducted a public hearing and after hearing testimony regarding the
variance, made the following findings of fact:
1. That a hardship exists peculiar to the property
in that the building, as located on the property, is
located close to the boundary line separating the
C-O and C-C Districts, so that businesses adjacent
to the zoned boundary line in the C-C District are
allowed a greater sign area than the bank building
is allowed, thus creating a clear inequity. Further,
there is a practical difficulty in such a development
of the property since the bank is set back 175 feet
from Fourth Avenue, creating a difficult visibility
problem.
2. The variance is necessary in order to preserve
the enjoyment of substantial property rights possessed
by other properties, for the reasons set forth herein-
above, and by virtue of the fact that the color of the
building, as approved by the Planning Department, would
not provide a good color background for freestanding
letters, which were preferable.
3. The variance will in no way constitute a sub-
stantial detriment to adjacent properties since the
adjacent properties are allowed the signing in excess
of that which is granted by the variance and the
variance, as granted, would not, in any way, increase
the area of the sign copy, but only the background area,
which would exceed the regulations of the ordinance.

4. Said variance will in no way affect the general
plan of the City of Chula Vista or the adopted plan
of any governmental agency.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Chula Vista that the appeal by Balboa Bank from the denial
of a variance from the Planning Commission, in accordance with the
terms set forth hereinabove, be and the same is hereby granted.
