HomeMy WebLinkAboutReso 1974-7147 RESOLUTION NO. 7147 RE~OLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ENDORSING THE PASSAGE OF SECTION 202(c) OF S2589 IN THE UNITED STATES SENATE, LIMITING MANAGEMENT OF PARKING SUPPLY AND PARKING SURCHARGES The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the City Attorney's Office has reviewed S2589, which is the Emergency Energy Act and includes sections which restrict regulations promulgated by the Clean Air Act of 1970, and WHEREAS, the regulations promulgated by the Environmental Protection Agency, and enumerated in part below, would impose a severe and unjustified burden upon the City of Chula Vista and its citizens, a. The regulation of building of new commercial parking lots above certain sizes only with direct EPA approval; b. The regulations imposing a surcharge upon free commercial parking provided by both the City and private industry; c. The regulations requiring employers, includ- ing the City, to assess their employees sums of money for the use of what had previously been free parking; d. The regulations which purport to supersede local land use regulations adopted by the City of Chula Vista, rendering them null and void in the event they conflict with the federal regulations. and, WHEREAS, Section 202(c) of S2589, if enacted by the United States Senate, would effectively preclude the enforcement of the EPA regulations which detrimentally affect both the City of Chula Vista and its citizens, as well as rendering moot current legal activities commenced against the EPA. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby urge the adoption of Sec. 202(c) of S2589, limiting parking surcharges, the management of parking supply and preferential bus/carpool lane regulations, by the United States Senate. BE IT FURTHER RESOLVED that the City Clerk of the City of Chula Vista be, and she is hereby authorized and directed to forward a certified copy of this resolution to members of Congress represent- ing San Diego County voters.
