HomeMy WebLinkAboutReso 1974-7374 RESOLUTION NO. 7374 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA kMENDING RESOLUTION NO. 6779 APPROVING THE TENTATIVE }1AP AND PRECISE PLAN OF THAT CERTAIN SUB- DIVISION KNOWN AS RANCHO ROBINHOOD The City Council of the City of Chula Vista does hereby resolve as follows: .VHEREAS, the City Council on February 22, 1973 approved the tentative map of that certain subdivision known as Rancho Robinhood, which approval incorporated the precise plan requirements as set forth in the incorporated findings, and WHEREAS, the Planning Commission voted 4-1 on June 26, 1974 to recommend that the City Council approve the revision to the precise plan for lot #116 of Rancho Robinhood Subdivision, in accordance with Resolution No. PCZ-74-G, and WHEREAS, said recommendation is based upon the fact that the subject property will not be used for park purposes and good zoning practice makes it desirable that the precise plan be revised to incorporate it so that this undeveloped property can be developed in coordination with, and in the same manner as, the surrounding pro- perty in the same ownership, and WHEREAS, the General Plan indicates the general land use for this area as park, however, the City has expressly chosen not to purchase it; therefore, a General Plan revision will be the responsi- bility of the City at the next time the General Plan is amended. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that Resolution No. 6779 be, and the same is hereby amended in accordance with Planning Commission Resolution No. PCZ-74-G, attached hereto and incorporated herein by reference as if set forth in full. PCZ-74-G \~'I' 'I ' ,\" , ., A .I. ,~... ,., -I h :l.kll\\.\Jt-- .1 RESOLUTION OF TilE CITY PLANNING COMMISSION RECOMMENDING TO THE CITY COUNCIL TilE APPfWVAL OF A REVISION TO PRECISE PLAN FOR RANCIIO ROI3INHOOD TO INCLUDE APPROXIMATELY 5 ACRES LOCATED WEST or ALLEN ELEMENTARY SCHOOL WHEREAS, the approved Precise Pl an for Rancho Robinhood, as required by zone change Resolution PCZ-72-S, was for a '116 lot subdivision on 73.4 acres, including 114 residential lots, one open sp~ce lot and one lot containing approximately 5 acres reserved for possible purchase by the City of Chula Vista as a park, and WHEREAS, on January 22, 1974 the City Council decided not to acquire the 5 acre site and advised the owner to submit a development plan on the property, and WHEREAS, on April 25, 1974 Robinhood Homes, Inc. submitted an appl ication for revision of the original Precise Plan to include the development of the additional 5 acres as Rancho Robinhood Unit 2, and WHEREAS, Environmental Impact Report EIR-74-7 on the proposed development was adopted by the City Planning Commission on June 26, 1974, and WHEREAS, the Planning Commission set the time and place for a hearing on the proposed revision to Precise Plan, and notice of said hearing, together with its purpose, was given by the publication in a newspaper of general circulation in the City at least 10 days prior to the date of said hearing, and WHEREAS, a hearing was held at said time and place, namely 7:00 p.m. June 26, 1974 in the Council Chamber, Civic Center, before the Planning Commis- sion, and said hearing was thereafter closed. NOW THEREFORE I3E IT RESOLVED AS FOLLOWS: 1. From facts presented to the Commission, the Commission finds that public necessity, convenience, general welfare and good zoning practice require the revision of the Precise Plan for Rancho Robinhood to include approximately 5 acres, as shown on attached exhibit A, provided that development of 4.6 acres of the property shall conform to an approved subdivision map. 2. The findings of fact in support of said determination are as follows: . . a. Inasmuch as the subject property will not be used for park purposes, good zoning practice makes it desirable that the precise plan be revised to incorporate it so that this undeveloped property can be developed in coordination, and in the same manner, as the surround'ing pl'operty ill the same ownershi p. !l7c3 7y, b. The General Plan indicates the general land use for this area as a park, however, the City has expressly chosen not to purchase iti therefore, a General Plan revision will be the responsibility 9f the City at the next time the General Plan is amended (October 1974). 3. The Planning Commission reconunends to the City Council that said revision to Precise Plan be granted. 4. That this resolution be transmitted, along with the application, to the City Council, and a copy of this resolution shall be transmitted to the appl icant. PASSED and APPROVED by the CITY PLANNING COMMISSION of CHULA VISTA.
