RESOLUTION NO. 7344 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA CALLING A PUBLIC HEARING TO DETERMINE HHETHER PUBLIC NECESSITY, HEA~TH, SAFETY OR HELFARE REQUIRES THE FORMATION OF AN U~DERGROUND UTILITY DISTRICT ON BROAm~AY FROH "H" STREET TO "I" STREET The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, Ordinance No. 1128 establishes a procedure for the creation of underground utility districts and requires as the initial step in such procedure the holding of a public hearing to ascertain whether public necessity, health, safety, or ~lelfare requires the removal of poles, overhead wires and associated over- head structures and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service in any such district, and vlliEP~AS, it has been recommended that such an underground utility district, hereinafter called District, be formed on that portion of Broadway in the City of Chula Vista, more particularly described as follows: All those properties fronting upon Broadway, between the northerly right of way of "H" Street and the southerly right of way of "I" Street, as shown on the map of the District marked Exhibit "A" and numbered 105. NOl~, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista as follows: 1. NOTICE IS HEREBY GIVEN that a public hearing will be held in the Council Chambers of the City of Chula vista at 276 Fourth Avenue in said City on Tuesday, the 23rd day of July, 1974, at the hour of 7:00 p.m., to ascertain \^lhether the public neces- sity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures and the under- ground installation of wires and facilities for supplying electric, communication, or similar associated service in the District here- inabove described. At such hearing, all persons interested shall be given an opportunity to be heard. Said hearing may be continued from time to time as may be determined by the City Council. 2. The City Clerk sh~ll notify all affected property owners as shown on the last equ~lized assessment roll and utilities concerned of the time and place of such hearing by mailing a copy of this resolution to such property owners and utilities concerned at least ten (10) days prior to the date thereof. 3. The area proposed to be included in the District is as shown on the plat attached h$reto and made a part hereof by reference. ~~~ Lane F.
