HomeMy WebLinkAboutReso 1974-7326 RESOLUTION NO. 7326 RESOLl'TION OF THE CITY COUNCIL OF' THE CITY OF CHULA VISTA APPROVING THAT CERTAIN MEMORANDUM OF UNDER- STANDING CONCERNING v-TAGES AND OTEER TERl'1S AND CONDITIONS OF EMPLOYMENT BETWEEN THE CITY OF CHULA VISTA AND LOCAL 2180, INTER~ATIONAL ASSOCIATION OF FIRE FIGHTERS ./\FL-CIO, FOP FISCAL YEAR 1974-75 The City Council of the City of Chula Vista does hereby resolve as follows: ~mEREAS, the Management Negotiation Team representing the City Manager of the City of Chula Vista, acting for and on behalf of the City Council of the City of Chula Vista, have heretofore met and conferred with Local 2180, International Association of Fire Fighters, AFL-CIO, an organization representing certain members of the classified employees in the City of Chula, in accordance with the provisions of Section 3500 et seq. of the Government Code of the State of California, and l~{EREAS, the Memorandum of Understanding jointly prepared by said parties as a result of meeting and conferring has been presented to the City Council and is contained in Exhibit "A", attached hereto and incorporated herein by reference as if set forth in full. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby approve and accept said Hemoral"dum of Understanding as contained in Exhibit "p.," for fiscal year 1974 -7 5. DATED City Clerk MEMORANDUM OF UNDERSTANDING CONCERNING WAGES AND OTHER TERMS AND CONDITIONS OF E~PLOYMENT BETWEEN THE CITY OF CHULA VISTA AND LOCAL 2180, INTERNATIONAL ASSOCIATION OF FIRE FIGHTERS AFL-CIO, FOR FISCAL YEAR 1974-75 (July 1,1974 - June 30, 1975) .~ EXHIBIT ~ WHEREAS, the representatives of the City Manager of the City of Chula Vista, acting for and on behalf of the City Council of the City of Chula Vista, have heretofore met and conferred with Local 2180, International Association of Fire Fighters, AFL-CIO, an organization representing members of the Chula Vista Fire Department from Fireman up through the rank of Fire Captain, in accordance with the provisions of Section 3500 et seq. of the Government Code of the State of California, and WHEREAS, as a result of meeting and conferring in good faith with said group, agreement has been reached on the following terms and conditions of employ- ment as applied to those employees who are members of and represented by Local 2180, and said representatives of the City Manager and of Local 2180 do now jointly prepare a written Memorandum of Understanding concerning said agreed terms and conditions of employment for presentation to the City Council of the City of Chula Vista for determination, to-wit: PREAMBLE This agreement is entered into by and between City of Chula Vista, hereinafter referred to as the Employer, and Local 2180 International Association of Fire Fighters, hereinafter referred to as the Union. It is the purpose of this agreement to achieve and maintain harmonious relations and full communications between the Employer and the Union, to provide for equi- table and peaceful adjustment of differences which may arise, and to establish proper standards of wages, hours and other conditions of employment. RECOGNITION The Employer recognizes the Union as the exclusive bargaining agent for all Fire Captains, Fire Engineers, Firefighters and any other equivalent uniformed class of the Fire Department. Those holding the rank of Battalion Chief, Assistant Fire Chief, and Fire Chief are excluded from representation by this bargaining unit. WAGES 1. Effective July 1,1974, a seven and one-half percent (7-1/2%) salary increase shall be granted for members of the Fire Department from Firefighter up through the rank of Fire Captain. 2. Effective July 1, 1974, the classification of Firefighter shall be subject to a seven (7) step salary range. The additional two steps shall be added to the lower level of the established salary range. Step "1" shall be 10% less than "A" Step and Step "2" shall be 5% less than "A" Step. The normal hire rate shall be Step 1 provided, however, k 1'j)G that an exceptionally well-qualified candidate may be hired within the established range based upon the recommendation of the appointing au- thority and Director of Personnel and approved by the City Manager. Provision shall be made that will provide for advancement from Step "1" to Step "2" after six months satisfactory service at Step "1" and from Step "2" to Step "A" after six months satisfactory service at Step "2" provided, however, increases for outstanding performance may be provided by: (1) granting a Firefighter's normal merit increase in advance of the regularly scheduled date, or (2) granting a double step increase at the time the Firefighter's normal merit advancement is scheduled. All requests shall be initiated by the individual's supervisor, recommended by the department head and the Director of Personnel and approved by the City Manager and the Civil Service Commission. The effective date of exceptional merit increases shall be the beginning of the pay period following approval. OVERTIME PAY Effective July 1, 1974. In the event that a need for overtime should occur in the Fire Department because of an emergency, sickness or other unforeseen con- ditions, overtime shall be paid at one-and-one-ha1f times the basic rate of pay subject to the following conditions: (a) All employees covered by the terms of this agreement who are called back to work from off-duty shall be paid at least two (2) hours minimum at one-and-one-half times the basic rate of pay. (b) All employees covered by this agreement who are held over their normal work shift due to fire or other emergencies, shall be paid at one-and-one-ha1f times the basic rate of pay for all time in excess of 30 minutes. Upon return from such fire or emergencies, subject employees shall be permitted 30 minutes clean-up time which may be included in the overtime computation. (c) All employees required to work over 15 minutes beyond their regular shift for reasons not included in (b) above, shall be paid at least one (1) hour minimum at one-and-one-half times the basic rate of pay. OUT OF CLASSIFICATION ASSIGNMENT Effective July 1,1974, the Union and the City hereby agree that an employee assigned duty as an Acting Fire Engineer or Acting Fire Captain for a period in excess of seven (7) continuous work shifts (24-hour period) shall receive compensation at a rate equal to Step "A" of the classification to which assigned in said capacity. UNSCHEDULED HOLIDAYS Effective July 1, 1974, members of the Fire Department from Firefighter up through the rank of Fire Captain shall work unscheduled holidays at their regular hourly rate of pay. If employees have that day as a scheduled day off, they will not receive compensation for the unscheduled holiday. -:? (:r~t. MEDICAL AND INSURANCE COVERAGE 1. The following changes shall be incorporated in the employees' medical and insurance coverage. These changes shall be paid for by the City of Chula Vista, effective July 1,1973. a. Life insurance coverage shall be increased to $3,000. b. Basic hospital room and board coverage shall be increased to $45 per day. c. Change from $100 deductible per each cause to $100 for all causes, the deductible to be paid once each calendar year. d. Major medical maximum coverage shall be increased to $50,000. 2. The following changes shall be incorporated in the dependents' medical insurance. Total cost of dependents' medical insurance shall be paid by the City of Chula Vista, effective January 1,1974. a. Basic hospital room and board coverage shall be increased to $45 per day. b. Change from $100 deductible per each cause to $100 for all causes, the deductible to be paid once each calendar year. c. Major medical maximum coverage shall be increased to $50,000. SICK LEAVE REIMBURSEMENT Civil Service Rule IX, Section 3, shall be amended to include Fire Department Personnel represented by Local 2180, International Association of Fire Fighters AFL-CIO. Fire service employees on a 60-hour workweek using 48 hours of sick leave, or less, during the fiscal year, shall have the option of converting twenty-five percent (25%) of their remaining yearly sick leave to pay. If the pay option is not selected, all remaining yearly sick leave shall be carried over and accumulated. Fire service employees on a 40-hour workweek will be subject to the same sick leave reimbursement plan as provided for miscellaneous employees, as found in Civil Service Rule II, Section 3(a). Pay shall be computed based on the following schedule and all computations shall be rounded to the nearest whole hour: Remaining Yearly Sick Leave 40-hr. Workweek, 60-hr. Workweek, Misc. & Fire Fire Pay Option (25%) 40-hr. Workweek, 60-hr. Workweek, Misc. & Fire Fire 12 days 11 days 10 days 9 days 8 days 7 days (or less) 144 hrs. 132 hrs. 120 hrs. 108 hrs. 96 hrs. 84 hrs. 3 days 2 days, 6 hrs. 2 days, 4 hrs. 2 days, 2 hrs. 2 days o days 36 hrs. 33 hrs. 30 hrs. 27 hrs. 24 hrs. o hrs. ~.1~.' < ~ This benefit becomes effective July 1,1973; however, payment made for the period from July 1, 1973 to June 30, 1974, during July 1974, will be computed at one-half (1/2) the normal entitlement, or 12.5%. Thereafter, such benefit will be on a basis equal to the 25% factor utilized regarding regular mis- cellaneous employees. UNIFORM ALLOWANCE Members of the Fire Department from Fireman up through the rank of Fire Captain shall receive a uniform allowance as follows: An annual allowance of one-hundred dollars ($100) for uniform and equip- ment maintenance. Said annual allowance to be paid on a fiscal year basis with no carryover from year to year. This benefit becomes effective January 1, 1974. Payment made during January 1974, shall be fifty dollars ($50), based on a six-month entitlement period. THREE PLATOON AD HOC STUDY COMMITTEE Effective July 1, 1974, the three (3) platoon Ad Hoc Study Committee shall be disestablished. DEPARTMENTAL OPERATIONS AND SAFETY ADVISORY COMMITTEE Effective July 1,1974, the Departmental Operations and Safety Advisory Committee shall be disestablished. DEPARTMENTAL SAFETY AND HEALTH COMMITTEE Effective July 1, 1974, a Safety and Health Committee shall be established durin9 the fiscal year 1974-75 comprised of three representatives of the Union and at least three members of Management, which shall meet no less than once a month on a scheduled basis. Additional meetings may be called by either party subject to 10 calendar days notice. All meetings shall be subject to an agenda of items pertaining to safety and health matters, with special emphasis in the area of employee or public safety. The nature of these meetings will be to discuss areas of concern, to improve communications, and to provide a basis for interchange of ideas. Any proposal agreed to by a majority of this group will be forwarded to the Fire Chief and will receive a written response in that regard. It is under- stood that it is not the function nor intent of this committee to infringe on management rights, but in a consultive way to perform meaningful safety and health advisory services to management. DEPARTMENTAL RULES AND REGULATIONS COMMITTEE Effective July 1, 1974, a Departmental Rules and Regulations Committee shall be established during the first six (6) months of fiscal year 1974-75 comprised of three representatives of the Union and at least three members of Management, which shall meet no less than once a month on a scheduled basis. Additional meetings may be called by either party subject to 10 calendar days notice. All meetings shall be subject to an agenda of items pertaining to the review, revi- sion and updating of departmental rules and regulations. It is understood that these meetings will provide a means whereby the Union will be consulted regarding .J,') f---) , .. I-<t- said rules and regulations. The nature of these meetings will be to explore areas of concern, to improve communications, and to provide a basis for inter- change of ideas. Any revisions or updating agreed upon by a majority of this group will be forwarded to the Fire Chief and will receive a written response in that regard. It is understood that it is not the function nor intent of this committee to infringe on management rights, but in a consultive way to perform meaningful advisory services to management. The initial review, revi- sion and updating shall be completed during fiscal year 1974-75 and semi- annually thereafter. PAYROLL DEDUCTION OF DUES The employer agrees to deduct, once each pay period, dues and assessments in an amount certified to be current by the Secretary-Treasurer of the Local Union from the pay of those employees who individually request in writing that such deductions be made. The total amount of deductions shall be remitted by the Employer to the Treasurer of the Union. This authorization shall remain in full force and effect during the term of this agreement. DISCRIMINATION The Employer agrees not to discriminate against any employee for his activity in behalf of, or membership in, the Union. The Employer and the Union agree that there shall be no discrimination against any employee because of race, creed, or religion. The Union agrees to comply with the intent and direction of the City's Affirmative Action Policy and Program. MEETINGS/DOCUMENTAION Section 1. Up to three (3) designated members of the Union negotiating team are authorized time off duty for participation 1n all meetings to be mutually scheduled by the Employer and the Union. Section 2. Employees elected to Union office and/or to the Board of Directors of the Union are authorized to conduct meetings of the Officers and/or Board of Directors in City facilities during duty hours, at no cost to the City. Section 3. The Employer shall provide distribution of the following official City documents to the Union: One each to President: Agendas and Minutes of All City Council meetings, Civil Service Commission meetings, open Council Conferences, and Safety Committee meetings Fire Dept. Section: Preliminary City Budget One Copy: Final City Budget BULLETIN BOARDS The Employer agrees to furnish and maintain space for suitable bulletin boards in convenient places in each station and work area to be used by the Union. The Union shall limit its posting of notices and bulletins to such bulletin boards. -I :'."l/ 11/ _1-<(": RESPONSIBILITY FOR EQUIPMENT The City will hold employees harmless for equipment damaged or lost, except for acts of gross negligence, vandalism, or intoxication. SHIFT EXCHANGE Subject to a Shift Commander's approval, employees shall have the right to exchange shifts or parts of shifts when the change does not interfere with the operation of the Fire Department. DEATH IN FAMILY LEAVE In the event of a death in the immediate family of an employee, the employee shall be granted up to two (2) shifts off with pay. The immediate family shall be defined as spouse and children of the member, mother, father, brother, sister of the member., and those of the member's spouse as approved by the Civil Service Commission, or any other person as defined by the Internal Revenue Service as a dependent. Paid absence for family death shall be charged to accumulated sick leave. It is understood that the City Manager will recommend this change to the Civil Service Commission. UNION REPRESENTATION Section 1. A Shop Steward shall be any bargaining unit member designated in writing by the elected Union President. The Union shall provide and maintain a current list of designated Shop Stewards, not to exceed eight (8) in number, and such lists shall be filed with the Office of the City Manager and the Fire Chief. Section 2. The City grievance procedure will be adhered to on any matter which appropriately falls under that procedure. Any other matter which is within the scope of representation regarding the Union may also be discussed on a special basis at a time to be mutually agreed upon by both parties, Management and the Union. It is understood that reasonable advance notice of 10 calendar days is required unless both parties consent to a shorter period in the interests of expediting the handling of a matter. Effective July 1, 1974, the Union and the City hereby agree that upon request of a Firefighter, Fire Engineer or Fire Captain, a Shop Steward may be in attendance and represent the employee at any step after the first step of the grievance procedure. EMPLOYEE PERSONNEL RECORDS Any member shall be entitled to see the contents of his personnel records. Availa- bility of these records to the employee will be subject to the normal business hours affecting the position or office who has routine custody of these records. J-f.?'J/ ~ ' / b<v Any letter of reprimand, as defined in Administration Regulation dated September 25, 1972, included in the personnel records of any member of the bargaining unit shall be removed from the record one year from the date of the letter, if such employee has a current performance rating of satisfactory or better. The scope of removal does not apply to any other document which may mention the specific letter of reprimand, such as an employee performance report or other documents which may only refer to the reprimand as a matter of reference. MILEAGE ALLOWANCE Effective July 1, 1974, members of the Fire Department from Firefighter up through the rank of Fire Captain shall be subject to the City's Mileage Reim- bursement Program when required to use their private automobiles for authorized Fire Department business. 15~ - 1st 200 miles 10~ - next 300 miles 6.4t - over 500 miles CLEAN-UP TIME Effective July 1, 1974. Except in cases of fire or other emergencies, employees covered by this agreement shall be granted thirty (3D) minutes personal clean-up time immediately prior to the end of each working shift. VACANCIES - PROMOTIONS When a permanent vacancy occurs in any position, it shall be filled in accordance with Civil Service Rule V, Section 1. PERSONNEL REDUCTION In the case of a personnel reduction of permanent employees, employees with unsatisfactory ratings shall be laid off first. Thereafter, the order of layoffs shall be in the reverse order of seniority within the classification in which the layoff is being made. While this agreement is in effect, no new employee shall be hired until the laid-off employees with satisfactory or better ratings have been given the opportunity to return to work. CONTINUATION OF EXISTING BENEFITS It is further understood and agreed that any other benefits and working con- ditions and the terms and conditions thereof presently in effect shall remain unchanged (except for amendments to the Civil Service Rules which liberalize employee benefits) unless and until said terms and conditions shall be modified as a result of meeting and conferring in good faith between the City and the Chula Vista Fire Fighters Local Union 2180, AFL-CIO, pursuant to the provisions of Section 3500 of the Government Code of the State of California. 7~ . SAVINGS CLAUSE If any provision of this agreement, or the application of such provision, should be rendered or declared invalid by any court action or by reason of any existing or subsequently enacted legislation, the remaining parts or portions of this agreement shall remain in full force and effect. , ~ ~)/1!Jtk~~ 10m .
