HomeMy WebLinkAboutReso 1974-7274 RESOLUTION NO. 7274 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA, RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD IN SAID CITY ON THE 9th DAY OF APRIL, 1974, DECLARING THE RESULT THEREOF AND SUCH OTHER MATTERS AS ARE PROVIDED BY LAW The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, a regular general municipal election was held and conducted in the City of Chula Vista, County of San Diego, State of California, on Tuesday, the 9th day of April, 1974, as required by law, and WHEREAS, notice of said election was duly and regularly given in time, form and manner as provided by law; that voting pre- cincts were properly established; that election officers were ap- pointed and that in all respects said election was held and conducted and the votes cast thereat, received and canvassed and the returns made and declared in time, form and manner as required by the pro- visions of the Elections Code of the State of California for the holding of elections in cities, and WHEREAS, pursuant to Resolution No. 7263, adopted the 2nd day of April, .1974, the City Clerk of the City of Chula Vista canvassed the returns of said election and has certified the results to this City Council, said results are received, attached and made a part hereof as "Exhibit A". NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista as follows: Section 1. That there were ninety-three (93) voting pre- cincts established for the purpose of holding said election, con- sisting of consolidation of the regular precincts in the City of Chula Vista and the Chula vista City School District, as established for the holding of state and county elections. Section 2. That said regular general municipal election was held for the purpose of electing the following officers of said City and City School District as required by the Charter of the City of Chula Vista, to-wit: Two (2) Members of the City Council for a full term of four (4) years; Two (2) Members of the Board of Education of the Chula vista School District for a full term of four (4) years. Section 3. That at said regular general municipal election, the following measures were submitted to the electors of said City, to-wit: PROPOSITION A An amendment to the Charter of the City of Chula Vista amending Article III, Section 300 by assigning numbered seats to each Council position to be selected by lot. - 1 - Sec. 300. Members and Terms. (Paragraphs 5, 6 and 7 to be added) Each Councilman shall be assigned a numbered seat to be selected by lot. Said seats shall be numbered 1 through 4 respectively and any person seeking election to the City council shall at the time of filing his nomination papers, select one of said seats as the Council position for which he seeks election. Said election process by numbered Council seats shall commence at the general municipal election to be conducted in April of 1976, and all persons running for a Councilmanic office shall designate one of the two numbered Councilmanic seats as selected by lot and memorialized by resolution of the City Council of the City of Chula Vista on file in the office of the City Clerk. Should a vacancy ojcur at any time in a Coun- cilmanic seat or seats, if said vacancy is to be filled by a special election as provided in Section 303 of the Charter, candidates for said vacancy shall similarly designate the appropriate numbered seat on their nominating papers. In order for any person to be elected for any num- bered Council seat 1 through 4 or the office of Mayor for which he has filed his nomination papers, he must receive a majority of all votes cast for said Council seat or the office of Mayor, and if, and in the event that no candidate for such numbered Council seat or office of Mayor, receives a majority of the votes cast, the two candidates receiving the highest number of votes for said seat shall run in a special runoff election to be conducted on the second Tuesday in June fOllowing the general municipal election on the second Tuesday in April in even numbered years, and in the case of the office of Mayor, a special election shall be scheduled for the second Tuesday in June following the general municipal election on the second Tuesday in April conducted for the purpose of electing the Mayor. PROPOSITION B Amend Article XI, Section 1106 thereof, of the Charter of the City of Chula vista to be, and to read as follows: Sec. 1106. Tax Limits. (a) Property Taxes. The City Council shall not levy a property tax, for municipal purposes, in excess of one dollar and eighty cents ($1.80) annually on each one hun- dred dollars of the assessed value of taxable property in the City, except as otherwise provided in this Section, unless authorized by the affirmative vote of a majority of the electors voting on a proposition to increase such levy at any election at which the question of such addi- tional levy for municipal purposes is submitted to the electors. The number of years that such additional levy is to be made shall be specified in such proposition. - 2 - f(7~7Y (b) Additional Taxes. There shall be levied and collected at the time and in the same manner as other property taxes for municipal purposes are levied and collected, as additional taxes, if no other provision for payment thereof is made: 1. A tax sufficient to meet all liabilities of the City for principal and interest of all bonds or judgments due and unpaid, or to become due during the ensuing fiscal year, which constitute general obligations of the City; and 2. A tax sufficient to meet all obligations of the City to the State Employees' Retirement System for the retirement of City employees, due and unpaid or to become due during the ensuing fiscal year. PROPOSITION C Amend Article VI, section 605 thereof, of the Charter of the City of Chula Vista to be, and to read as follows: Sec. 605. compensation. Vacancies. The members of boards and commissions shall serve without compensation for their services as such, but may receive reimbursement for necessary traveling and other expenses incurred on official duty when such expenditures have received authorization by the City Council; provided, however, that members of the Planning Commission shall receive in addition, as com- pensation for their services, the sum of TWENTY DOLLARS ($20.00) per meeting, which sum shall not exceed a total of SIXTY DOLLARS ($60.00) per month. Any vacancies in any board or commission, from whatever cause arising, shall be filled by appoint- ment by the City Council. Upon a vacancy occurring leaving an unexpired portion of a term, any appoint- ment to fill such vacancy shall be for the unexpired portion of such term. If a member of a board of commission absents himself from three regular meetings of such board or commission, consecutively, unless by permission of such board or commission expressed in its official minutes, or is convicted of a crime in- volving moral turpitude, as determined by a court of competent jurisdiction, or ceases to be a qualified elector of this City, his office shall become vacant and shall be so declared by the City Council. Section 4. That the whole number of votes cast in said City (except absent voter ballots) was 10,469. That the whole number of absent voter ballots cast in said City was 496, making a total of 10,955 votes cast in said City. - 3 - !17cl7tJ Section 5. That the names of persons voted for at said election for Member of the City Council of said City are as follows: James E. Hobel Will T. Hyde Lorraine Bales Frederick A. R. Drew David A. Linsley Irma June Morris Paul F. Whitten, Sr. and That the names of persons voted for at said election for Members of the Board of Education of the Chula Vista City School District are as follows: Lawrence J. (Larry) Clark Gloria A. Johnson Michael T. McQuillen Jon M. Miller Charlotte M. Moreno Noel A. smith and That the propositions voted upon at said election are as set forth hereinabove, and That the number of votes given at each pre- cinct and the number of votes given in the City to each of such person above named for the respective office for which said person was a candidate and for and against the propositions set forth herein are as shown in Exhibit "A" attached hereto and made a part hereof by reference. Section 6. That the City Council does declare and deter- mine that: James E. Hobel was elected as Member of the City Council of said City for a full term of four (4) years; will T. Hyde was elected as Member of the City Council of said City for a full term of four (4) years; Gloria A. Johnson was elected as Member of the Board of Education of the Chula Vista School District for a full term of four (4) years; Jon M. Miller was elected as Member of the Board of Education of the Chula Vista school District for a full term of four (4) years; and That as a result of said election, a majority of the qualified voters voting on Propositions "B" and "C", did not vote in favor thereof, and that said changes were not carried and shall not be deemed adopted and ratified, and That as a result of said election, a majority of the qualified voters voting on Proposition "A" did vote in favor thereof, and that said proposition carried, and shall be deemed adopted and ratified. - 4 - f! 7~/c/ Section 7. That the City Clerk shall enter on the records of the City Council of said City a statement of the results of said election showing: (1) The whole number of votes cast in the City, and the Chula Vista City School District; (2) The names of the persons voted for; (3) The propositions voted upon; (4) The office for which each person was voted for; (5) The number of votes given at each precinct to each person and for and against each proposition; (6) The number of votes given in the City and the Chula vista City School District to each person and for and against each proposition. Section 8. That the City Clerk shall immediately make and, upon compliance by the persons elected with the provisions of Sections 11550 and 11559 of the Elections Code of the State of California, shall deliver to each of such persons so elected a Certificate of Election signed by her and duly authenticated; that she shall also administer to each person elected, the Oath of Office prescribed in the State Constitution of the State of California and shall have them subscribe thereto and file the same is her office. Whereupon, each and all of said persons so elected shall be inducted into the respective office to which they have been elected. Section 9. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original Resolutions of said City; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted.
